Chairman Austen opened the meeting at 7 : 03 p . m . and stated that all posting , publication and notification of the public hearing had been completed and that proper affidavits of same were in order . The first Appeal to be heard by the Board was the following : APPEAL OF ROBERT AND CAROL FAY , APPELLANTS , JAMES HILKER , AGENT , REQUESTING AUTHORIZATION BY THE BOARD OF APPEALS PURSUANT TO ARTICLE XII , SECTION 54 , OF THE TOWN OF ITHACA ZONING ORDINANCE , FOR THE PROPOSED CONSTRUCTION OF A SCREENED PORCH AND THE ADDITION OF A ROOF OVER AN EXISTING WOOD DECK , AT AN EXISTING NON - CONFORMING BUILDING / LOT , LOCATED AT 318 EASTWOOD AVENUE , TOWN OF ITHACA TAX PARCEL NO . 6 - 60 - 1 - 35 , RESIDENCE DISTRICT R- 15 . Robert Fay and explained the proposed construction to take place . Mr . Andrew Frost presented photos of the property as it is today . Chairman Austen opened the public hearing . No one appeared to address the Board . Chairman Austen closed the public hearing . Environmental Assessment By Mrs . Joan Reuning , seconded by Mr . Pete Scala : RESOLVED , that , in the matter of the Appeal of Mr . and Mrs . ® Robert Fay for the proposed construction of a screened porch and the addition of a roof over an existing wood deck , at an existing non - conforming building / lot located at 318 Eastwood Avenue , the Town of Ithaca 2 Zoning Board of Appeals October 23 , 1991 Town of Ithaca Zoning Board of Appeals make and hereby does make a negative declaration of environmental significance based on the recommendations of the Town ' s Assistant Planner Mr . George Frantz . A vote on the Motion resulted as follows : Ayes - Reuning , Scala , King , Hines , Austen . Nays - None . Carried unanimously . ( The Short Environmental Assessment Form is attachted hereto as Exhibit # 1 . ) MOTION By Mr . Robert Hines , seconded by Mrs . Joan Reuning : RESOLVED , that the Town of Ithaca Zoning Board of Appeals grant and hereby does grant special approval permission to the applicants , Robert and Carol Fay , and a variance to permit construction of the additions as shown on their application , with the following findings : 1s that the access to the lot from a private easement is adequate and the Board has previously ruled on the situation on a prior application , and that the City street terminates within a few feet of this private driveway . 2a that there is no public hazard involved in the occupancy of this lot by the residential dwelling . 39 that the improvements requested are consistent with the architecture in the neighborhood . 4o that there is practical difficulty in forbidding the applicants using their property in the manner requested . 5a that no one spoke against the project . A vote on the Motion resulted as follows : Ayes - Hines , Reuning , Scala , Austen , King . Nays - None . The Motion carried unanimously . • Town of Ithaca 3 Zoning Board of Appeals October 23 , 1991 The next Appeal to be heard by the Board was the following . APPEAL OF SAVINO AND CARMEN FERRARA , APPELLANTS , JAMES HILKER , AGENT , REQUESTING VARIANCES FROM ARTICLE V , SECTION 21 , OF THE TOWN OF ITHACA ZONING ORDINANCE , FOR THE PROPOSED CONSTRUCTION OF A SINGLE FAMILY HOME , TO BE LOCATED AT 145 EAST KING ROAD , TOWN OF ITHACA TAX PARCEL NO . 6 - 44 - 2 - 4 , RESIDENCE DISTRICT R- 30 . SAID CONSTRUCTION PROPOSES AN EAST SIDE YARD BUILDING SETBACK OF 26 FEET AND A WEST SIDE YARD SETBACK OF 24 FEET , WHEREBY 40 FEET SIDE YARD BUILDING SETBACKS ARE REQUIRED . THE BUILDING LOT HAS A WIDTH OF 100 ( + OR - ) FEET , WHEREBY 150 FEET IS REQUIRED , HOWEVER THE LOT IS CONSIDERED NON - CONFORMING . Mr . Jim Hilker appeared before the Board with Mr . and Mrs . Savino Ferrara . Mr . Frost stated that the Town obtained a copy of the deed and it has been determined through legal counsel that the property precedes the requirements for an R - 30 lot . He said that the lot as it exists now is narrower than the 150 feet required for an R - 30 ® zone but the date of the deed makes it legal non - conforming . Mr . Frost presented photos of the property in question . Mr . King stated that the Ferrara ' s is one lot of a 5 lot subdivision ; theirs being lot # 4 . Chairman Austen opened the public hearing . No one appeared to address the Board . Chairman Austen closed the public hearing . Discussion followed on the subdivision and the width and depth of the lots . MOTION By Mr . Edward King , seconded by Mrs . Joan Reuning : RESOLVED , that the Town of Ithaca Zoning Board of Appeals grant and hereby does grant to the applicants , Savino and Carmen Ferrara , area variances for the proposed construction of a single family home , to be located at 145 East King Road , with the following findings and conditions . 1e that the easterly side yard , from the house to the east lot line , not be less than 24 feet . ® 2 * that the west side yard not be less than 22 feet . Town of Ithaca 4 Zoning Board of Appeals October 23 , 1991 3 * that this particular lot existed as a separate lot in the subdivision prior to the enactment of the Town ' s Zoning Ordinance . 49 that the lot adjacent east is developed with a house that is 20 feet or more from the common lot line between them and there is no house built on the lot to the west . 56 that there would be unnecessary hardship to the applicants in siting a house on this lot to conform with the ordinance as it now stands . 69 that there was no objection from the neighbors or adjacent owners . A vote on the Motion resulted as follows : Ayes - King , Reuning , Hines , Austen , Scala . Nays - None . The Motion carried unanimously . The final Appeal to be heard by the Board was the following . APPEAL ( ADJOURNED FROM OCTOBER 9 , 1991 ) OF HARRY S . NEWMAN , APPELLANT , REQUESTING A DETERMINATION BY THE BOARD OF APPEALS THAT A GROUP OF FOUR UNRELATED PERSONS , RESIDING AT 116 WARREN ROAD , TOWN OF ITHACA TAX PARCEL NO . 6 - 66 - 2 - 5 , RESIDENCE DISTRICT R - 15 , IS THE FUNCTIONAL EQUIVALENT OF A FAMILY , SUCH DETERMINATION SHALL BE MADE UPON REVIEW OF THE STANDARDS ENUMERATED IN ARTICLE I , SECTION I , " DEFINITIONS " , PARAGRAPH 5 , SUB - PARAGRAPH ( F ) , OF THE TOWN OF ITHACA ZONING ORDINANCE . Chairman Austen re - opened the public hearing on this matter . Mr . Paul McIsaac , 107 Forest Home Drive , spoke in opposition to the request . He stated that he is worried about setting a precedent in the area and he feels that it would be a detriment to the community . Mr . Ron Hoy , 124 1 / 2 Judd Falls Road , spoke to the Board against the proposal . He stated that it would not be a good precedent to set for the community . Mrs . Lou McIsaac , 107 Forest Home Drive , also spoke in opposition to the proposal . She feels that the area should remain a residential area . • Town of Ithaca 5 Zoning Board of Appeals October 23 , 1991 Mr . Bruce Brittain , 135 Warren Road , addressed the Board . He stated that his concern is that of setting a precedent and allowing what has been a tightly knit residential community to evolve into a rental district . He stated that he would recommend finding the parties involved in violation but postpone enforcement until the end of the academic year . Ms . Becky Schmidt , one of the parties involved with the house in question , stated that she and the other students also want the area to remain residential and she does not believe that they in any way challenge that . Mr . Scott Newman handed out a packet of documents that the Board requested at the meeting on October 9 , 1991 showing the persons involved in this matter actually do reside at the address and do meet the requirement of residency as defined in the ordinance . The documents are attached hereto as Exhibits # 2 - # 14 . Discussion ensued regarding the documents presented to the Board . ® Chairman Austen closed the public hearing . Mr . Hines stated that he would like to submit a proposed decision in writing to the Board for voting at its next meeting . He said that his vote would be to deny this application but he thinks it is too important a matter to vote on tonight . Mr . King stated that it is important to correctly interpret the Ordinance . He said that he is inclined at this point to say that he does not think this is a functional equivalent of a family under this Ordinance . Mrs . Reuning stated that she has a problem with setting a precedent in this matter . Mr . Scala stated that he would vote against the application . He said they are not a family unit but that it certainly is a convenient arrangement . Chairman Austen stated that he has difficulty with this group meeting the non - traditional family requirements as noted in the Ordinance . • Town of Ithaca 6 Zoning Board of Appeals October 23 , 1991 MOTION By Mr . Robert Hines , seconded by Mrs . Joan Reuning : RESOLVED , that the matter of the Harry S . Newman Appeal be adjourned for consideration of a written decision by Mr . Hines until the next meeting of the Zoning Board of Appeals which will be held on November 13 , 1991 , without further public hearing at that time .
