HomeMy WebLinkAbout2009-08-18 - PB TOWN OF ULYSSES PLANNING BOARD 08/18/09 APPROVED 09/01/09 Present: Chairperson Ken Zeserson, Board Members : Stan Beames, Rod Hawkes, Rod Porter, John Wertis, Deputy Supervisor Dick Coogan, Excused : Rick Rainey, Rebecca Schneider Public : Tommy Maim, Alan Carstensen Mr. Zeserson called the meeting to order at 7 : 02 pm. He stated they had two items on the agenda to review tonight. Tommy Mann from Grassroots would be attending to describe a project they have for their Agard Road property. They are currently not in compliance but as they have been "good citizens" are coming to the Board to be in compliance. The other item is continuing with the Conservation Zone. He stated the Town Board had suggested a Development District. Mariette (Town Attorney) during a meeting suggested they may want to have a Special Permit for Parking. This would cover the other areas in Ulysses that have parking areas during Grassroots such as the 8th Grade parking at Shursave. They would then review the Agard Road property as an overnight campground which is part of our zoning. The Town Board rescinded the resolution requesting this Board review as a Development District but have requested they review as an Overnight Campground and Special Permit process for events parking. He asked Mr. Mann to describe the project. Mr. Mann stated they own 60 acres on Agard Road, their Board have discussed and would like to put an ancillary building on this property for storage. They have many items they use on a yearly basis they rent space to store the festival equipment. Along with this they thought as long as they are looking into making this a permanent spot they would like to have their office on this site. They currently rent space from the Masonic Temple thus this would be an economic reason to do this as well . They would like to have more camping and less parking on the site as the camping really pays for the functions on this site . They have to pay for water, electricity, the bus to transport campers to the festival . They need 400 sites to cover the costs of this site. Rosa Puryear has spoken to NYS DOH and they restricted by DOH as to the numbers, the overall approval, permits etc . Mr. Hawkes asked why they would need a permit to build a building onsite. Mr. Coogan stated the zoning restricts ancillary buildings without a primary residence on the lot. A lengthy discussion resulted with the following comments/concerns from the Board and Mr. Mann : This area is in an Al district which allows campgrounds . Zoning law 17 . 9 . 2 is the section which regulates campgrounds however could not locate any reference to buildings being allowed. Grassroots would be using this year round as their office, as well as selling tickets, camping passes, etc . Would this be an allowable use in an Al district as a business . Grassroots onsite would increase the value of the property as full utilities would be on the site. Planning Board 2 8/ 18/2009 Grassroots has already done a stormwater management plan. Concern with establishing another Development District while there is zoning for Overnight Campground could be considered spot zoning. Once the permit process was established they could have other events once the proper permits were obtained. When Spruce Row came in for permit, there were no standards for campgrounds thus the Development District was created. Overnight camping requires 30 x 50 feet, Grassroots acknowledged they could accommodate the size requirements and they would have to be in compliance with DOH regulations which limit tents to within 5 feet of each other. Mr. Zeserson stated they needed more information from Mr. Rachun and Mariette for clarification on a few items has asked Mr. Coogan to address the following : 1 . Would a 12 month office on location be problematic . 2 . Where in the zoning regulations are buildings allowed. 3 . Could Mr. Rachun attend the next meeting to answer questions directly. He further asked the Board members to review the zoning section 17 . 9 .2 which indicate the standards for Overnight Campgrounds for the next meeting. Mr. Maim stated he would go back to his Board with the concerns of the year round operation . They have not put anything "in stone" thus this may not be a concern for them . Mr. Coogan stated this Board would make a recommendation, the approval would come from the Town Board . Mr. Zeserson stated this Board wants to do this the right way thus would appreciate the feedback from Mariette and Mr. Rachun . Mr. Coogan stated he would request this information. The Board expressed their thanks to Mr. Mann for attending and stated they would all get the information needed and review again at the next meeting. Mr. Mann stated he would check with his Board and thanked the members for their time . Mr. Wertis asked about the Site Plan Review process for subdivision ' s . Mr. Coogan stated that is how they addressed this item in the zoning by the Town Board . Mr. Zeserson asked Mr. Coogan if this could be addressed with the Town Board to determine the procedure they should follow. Mr. Coogan stated he would . Mr. Zeserson the last item on the agenda was the Conservation Zone . He asked the members if they had all reviewed the revised draft . The members acknowledged they had not had a chance and requested additional time to do this . Mr. Zeserson agreed it would be better to review the zone for the next meeting. Mr. Hawkes stated he had drafted a Ulysses Planning Board/Ulysses Town Board Award to recognize outstanding property improvement projects . He distributed the draft to all the members .
