Special Town Board Meeting
May 28 , 2009
PRESENT : Supervisor Douglas Austic ; Council David Kerness, Elizabeth Thomas and
Lucia Tyler; Rod Ferrentino absent ; and Town Clerk Marsha L . Georgia.

Changes made to the Draft Comprehensive Plan
Objective # 1 . 3 — B - delete wood and fossil fuel burning mechanisms — replace with —
outdoor furnaces .
Objective #2 . 3 - E — delete as appropriate — replace with — for appropriate population
density.
Objective #2 .4 — C - in first sentence add at the end — if design, development and
implementation has a 10 year pay back
Objective #2 . 5 — H — delete the last sentence
Objective #5 . 1 — H — delete develop (first word) — change to Explore
The Board discussed the business and Planned Unit Developments that are currently
designed on the existing zoning map and that none of them on the future land use map .
Mr. Austic feels that they should all be placed on the future land use map in the new
comprehensive plan and if they are not it is more or less making a statement that the
Town does not want to protect them .
Ms . Thomas was wondering if all were agreeing with what it states now in the plan if
there is an existing business and it goes out of that owner and so that now there is a new
owner or there is an existing building and wants to be used by a new business are we all
saying yes that is better to have a building filled or are some of us saying no that that
building should be empty and taken down, because that is the way the comprehensive
plan reads now . Ms . Thomas said she is not agreeing with that .
Ms . Tyler thinks it depends what it is .
The Board discussed this further. Mr. Austic said they way the future map would be or
could be interpreted are that the existing businesses are not wanted where they are and
would be grandfather in. Grandfather means that you want to get rid of them in years to
come .
Mr. Kerness said that the business are now zoned commercial and in the future when the
new zoning is created from the new comprehensive plan they could stay commercial .
Mr. Austic said that because they are not designated on the future land use map the
creation of new zoning would not see any commercial zones designated accept for the
Krums Corners location. The Comprehensive Plan is to be used as a guideline for new
zoning.
IMr. Kerness said that as a guideline it shouldn ' t be there but from a practical standpoint
he believes it should be there .
Ms . Tyler said she is saying that there are times perhaps when you would want to
grandfather business and she thinks and is sort of in an in-between position that most of
the business she would agree to have on the map but say you have a business that is
spewing plastic waste or something.
Mr. Austic said if we had a business like that we could grandfather it but we do not have
any like that.

Ms . Tyler said that her point is zoning is in the details and the comprehensive plan is not
detailed it is overall ; it is a vision of the future and want to encourage .
Mr. Austic said that any future zoning has to be based on this plan; so if it is not in the
comprehensive plan them it should not be in the future.
Ms . Thomas needs to think about it further.
Mr. Kerness said to put the business on the map and Mr. Austic agrees .
Ms . Tyler feels that they should not be on the map and put an asterisk to be considered on
a case by case basis .
Ms . Thomas thought that they could get into trouble and does not feel they should be
handled that way.
Mr. Kerness said that he has been talking to Mr. Rachun about this situation on business
and PUD ' s and something like putting a twenty-five year review period and say that in
twenty-five years they will be reviewed because now it only comes up for review if a
person wants to change something, which can put a limitation on the use. Mr. Kerness
says he does not know if that could be done on a commercial property.
The Board continued this discussion.
Ms. Thomas said that this section certainly needs to be re-visited and will try and come
up with some language that will cover this .
Mr. Kerness said that Mr. Rachun ' s recommendation was to put them on the Future Land
Use Map and he said that after a lot of deliberation he is not troubled by doing that . Mr.
Kerness said that if you want to take a short cut in language that does the same thing.
Mr. Austic does not feel that a short cut in language would be the same thing.
Ms . Tyler said that she is not in favor of putting the business and PUD ' s on the future
land use because that is a vision of what they would like to see .
Ms . Thomas said that she is in agreement that something needs to be in the
Comprehensive Plan that preserves the possibility of using the buildings in the
commercial zones now.
Mr. Austic said that it would be extremely hard to word it.
Ms. Thomas will work on some sort of wording to address that.
The Board went back to the review.

Second paragraph — first sentence delete uneasy — change to — by a mixture
Sixth paragraph — delete support — change to related
Village Residential
Delete the third photo and delete the last sentence under that photo .
Lakeshore
Second Paragraph — 2"a sentence — ad in thin soils
Second paragraph — 4th sentence — after overlay zones — ad in septic testing

Environmental Protection Area
Mr. Austic said that the description may be alright but he has a problem where it is
located on the map and is a broad based design .
Ms . Thomas said that she had talked with Ms . Poelvoorde about this .
The Board agrees that they need to talk with Bergmann so that they can explain the
rational to as where they put the outline of this area on the map . Someone will ask Andy
with Bergmann to explain this when he comes down for the meeting.
Ms . Tyler would like to see included in the explanation about lands with thin soils (will
look for a better word) . It was noted that this same statement should be under Lakeshore
Area.
Ad the following sentence in the Lakeshore Area
The environmental sensitivity of this area demands establishing strong zoning
regulations to guide appropriate scale development and protect the significant natural
resources in this area.
4th paragraph delete scale historically — and replace with current scale
Conservation Area
Take the last sentence in paragraph 2 and ad this to the Lakeshore Area description
Office and Technology Mixed Use
No changes were made in the description the Board discussed the area designated on the
map and made some changes. This is another area that the Board would like explanation
as to why this particular area was chosen and the size .
Ms . Thomas took the map and made some changes to indicate what the Board was
thinking.
Transitional Commercial
Delete small-scale before grocery store in the last paragraph.
The Board ended the review on page 51 .
The next scheduled meeting is for June 1St, 2009 at 7 : 00 pm.
