HomeMy WebLinkAbout2009-05-05 - PB TOWN OF ULYSSES PLANNING BOARD 05/05/09 APPROVED 06/02/09 Present : Chairperson Ken Zeserson, Planning Board Members : Stan Beames, Rod Hawkes, Rebecca Schneider, John Wertis, Deputy Supervisor Dick Coogan , Excused : Rick Rainey Public : Scott Sherwood Mr. Zeserson stated they had a quorum as of 6 : 58 pm thus would like to start the meeting as they have a lot of material to cover tonight. He noted that Mr. Sherwood was not in attendance but he was informed of the meeting. He stated it was his intent to get through the development district for a final draft to be reviewed and sent to the Town Board at the next meeting. He noted a discrepancy between the old zoning and the draft thus was concerned and would like to go line by line comparing the old to the new.. Ms . Carlisle Peck explained at the 04/07/09 meeting ° he Board had opted to use Mr. Sherwood ' s wording . This should have been in red however was not due to an error. Mr. Sherwood arrived at the meeting approximately 7; 05 pm- : The discussion led to using the Draft with Mr. Sherwood' s and Mr. Beames comments as the working document . a_ Mr. Zeserson noted he had received comments from Mr. Rainey and Ms . Schneider which he would reference when the related sections are discussed. He noted that Ms . Schneider would beTlate but would be attending this meeting. Ms . Schneider arrived at the meeting approximately 7 : 20 pm. Mr. Zeserson proceeded to' review/edit <the,document with the members . The following changes/revisions were proposed after lengthy discussion for the draft proposal as listed at the end of this document. 16.3. 1 (arALLOWED USES : e 2 . The wording "intent to b& used for campers" should be included as well as definitions of the various accommodations : e . g. tents, recreational vehicles, recreational park vehicles and camping cabins will be inserted for clarification. 3 . The members agreed extending the season to October 31st was acceptable . Mr. Zeserson stated Mr. Rainey had submitted a comment of restricting the number of snowmobiles allowed. The number of snowmobiles was discussed, the members agreed on 4 per site with a maximum allowed of 100 for the campground. 4. The specific commercial sales allowed should be detailed in this section. 5 . The discussion regarding the zoning regulations , specifically assigning this area a "district" for compliance within the regulation. A review of the current zoning districts was discussed, the members agreed the Standards for Campgrounds-Seasonal was the most appropriate, this would also continue their support of enforcing this area as a conservation zone in establishing 100 feet stream setbacks for future sites . The sites currently will be required to maintain a minimum of 20 feet natural stream setbacks through plantings and natural growth of vegetation. It was noted the group need to have the most up to date map on file with current sites to review and reference in this document. Mr. Coogan stated he would research this information. Planning Board 2 05/05/2009 16.3 . 1 (b) District Area Boundaries The discussion related to area boundaries concluded with removal of the house as this has been split per Mr. Coogan. The metes and bounds using hedgerows was discussed, Mr. Coogan stated he would pull the map from when the house was divided from this lot. He informed the group this would be sent to the Town Attorney, who would review the document as well as review the metes and bounds . 16.3 . 1 (c) Specification for Campsites 6 . The map with current sites should be referenced for this document . 7 . The maximum number was discussed, the final conclusion through member motions and voting concluded with 10% for the Recreational Park Trailers for a maximum of 43 . The number of camping cabins concluded with 10% for a maximum of 43 as these do not have running water to these units . 16.3 .1 (d) Sewage and Garbage Disposal ! ` : 5 . Ms . Schneider expressed concern regarding the useof sewage facilities on the sites adjacent to Willow Creek. ' . Mr. Sherwood stated they do not have sewage:storage on these sites . Tompkins County Health Department inspects the facilities and grants his permit-. Ms . Schneider stated she understands,-this however would like to speak with the Health Department regarding the procedure they follow. She understands this Board does not have jurisdiction over this process however it is a•.growing concern within NYS regarding outdated systems and would like to review this procedure . She/stated she would contact the Health Department directly . 16.3 . 1 .(e) Water 2. The members discussed and agreed the restriction of any cleaning activities in Willow Creek should be designated i / 16.3. 1 (0-Maintenance 2 . Mr. Beames submitted"wording regarding the inspection of recreational vehicles and recreational, park vehicles sewage tanks for the Willow Creek sites as well as discharging chlorinated ,water from theswimming pool . The member discussed and concluded with inserting a revision of Mr. Beames ' suggestions in the district. 16.3. 1 (h) Commercial'=Sa1es 1 . The decision to limit up to 6 units on display in area map 05/ 16/07 was concluded. 4. Allowing the new units to be displayed on an existing site was held, it was decided it would not be an issue as the district is limited to a maximum of 43 . The new units are allowed to be displayed on an existing site. 5 . Change wording from a unit to the unit for second hand sale. 6 . Retain retail store with sales of camping related items . 16.3. 1 . (j) Buffers 3 . Include from the original district as it was omitted from the draft. 4 . The discussion regarding enforcing this as the conservation zone, sites existing and meeting requirements of zoning, past practices have included having existing designated as legal and conforming, any future building would have to be in full compliance. The maps were reviewed for the number of sites this would impact, as well as future sites it may impact . The members and applicant agreed natural buffers are in the best interest of ;ri gip. i. 3. The discussion concluded with 20 foot buffers on existing sites, any future sites would be required to be in compliance with the 17 . 9 . 1 Campgrounds-seasonal zoning regulation that requires 100 feet stream setback requirements . The members agreed they would review the document for the 05/ 19/09 meeting . Mr. Sherwood requested a copy be sent to him as well. The meeting was adjourned at 9 : 00 pm . Respectfully Submitted, Robin Carlisle Peck Secretary DRAFT SPRUCE ROW DEVELOPMENT DISTRICT- 05/05/09 16.3 . 1 Development District 1 : Spruce Row Campsite (Formerly Development District 1 , as amended October 8 , 1991 ,2-%, , 2009) 16.3 . 1 (a) Allowed uses The purposes for which the district may be used are as follows : 1 . Campsites . = ' 2. Living accommodations for campers shall be Tents, Recreational Vehicles, Recreational Park trailers (with the intenttto be campers).or camping cabins. A Tent shall be defined as a portable shelter, as Of camas, stretched over a supporting framework of poles with ropes and pegs. A Recreational Vehicle shall be defined as ayehicle that can be moved on the highway without a special permit from the New York State D.O.T, (therefore no � % wider than 8Ffeet)built onca single chassis, mounted on wheels, with gross trailer area not to exceed 400 square,feet in area. a A Recreational Park Trailer shall be defined as a vehicle that can be moved on the highway with a special permit from the New York State D. O.T (therefore may be wider than 84feet) built on,<a single chassis, mounted on wheels with gross trailer area not to exceed 400 square feet in area. A Camping Cabin shall be defined as a hard sided tent or shelter less than 400 square feet in area which is on skids or otherwise designed to be readily moveable. 3 . The campgrounds shall be open for the season camping annually from May 1 through October 31 . Off-season no more than 20 percent occupancy at any given time for temporary camping (85 ) units . Length of stay no more than seven (7) consecutive days during off-season. (This is designed to accommodate such recreational activities as hunting, fishing, skiing, etc .) Snowmobiles will be limited to 4 per site with a maximum of 100 allowed in the campground. 4. Commercial sales of Recreational Vehicles, Recreational Park Trailers and Retail Sales of camping related items shall be an allowed use. 5. The site plan as listed on the map October 1991 for this district is listed as a legal and conforming uses. Any future buildings, site changes/additions will require compliance with the Zoning Regulations Section 17. 9. 1 Campgrounds-Seasonal. Planning Board 4 05/05/2009 16.3 . 1 (b) District Area Boundaries The area of said district shall be approximately 83 acres . The district boundaries are as follows : All that tract or parcel of land situated in the Town of Ulysses, County of Tompkins and State of New York, being part of Military Lot 16 in said Town and bounded and described as follows : BEGINNING at a point in the centerline of Kraft Road approximately 2 ,643 feet from the west line of Military Lot 16 , thence south parallel to the west line of Military Lot 16 approximately 2 , 061 feet to the south line of Military Lot 16 ; thence west along the said south line of Military Lot 16 approximately 2 ,643 feet to the west side of said Military Lot 16 (being the east line of military lot 15) ; thence north along the west line of Military Lot 16 approximately 1 , 188 feet to a point; thence northeasterly along a hedgerow and woodlot about 528 feet; thence southeasterly along the said hedgerow and woodlot about 462 feet; continuing in a southeasterly direction along the said hedgerow about 792 feet to a second hedgerow which runs north and south; thence north along said second hedgerow about 792 feet to a third hedgerow which runs east and west; thence west and parallel to Kraft Road approximately 88 feet to a point; thence north and perpendicular to Kraft Road approximately 351 feet to a. center line of Kraft Roads;;i ence east along center line of Kraft Road 1 ,034 feet to the point of beginning ; 7 16.3 . 1 (c) Specifications for Campsites ' 1 . East of the driveway (to the left as entering the campgrounds) campsite- numbers 1 -9 , 11 , 20, 21 and 20A are to remain as they are, no closer thal275 feet from the center line of Kraft Road; natural vegetation to remain as it is today ; campsites to remain' as they are on the map, no new campsites are to be added withm thearea. 2 . Parking : Two hour temporary parking north of the hedgerow (labeled as Hedgerow # 1 on the map) for patrons and their guests. , '4/47 b. t Irk /743 3 . The six (6) temporary hookups to the south of`this hedgerow; three (3 ) locations, two in each location; shall be no closer than 275Ifeet from Kraft Road; they are for temporary overflow and no further campingin this area is', allowed . The buffer area created by this hedgerow shall remain, and the plants shall be encouraged to grow.4 . Each campsite shall have a designatedgarea< for a campfire and shall be located, cleared w : and protected in accordance with recommendations of the Trumansburg Fire Chief ° . u 4s•y, 5 . The nu ber of campsites in the district is not to be more than 425 sites . There shall be a minimum number of 2 , 500frsquare feet per campsite as directed by New York State and Tompkins County,, Health Department rules . V 6. The sites as listed inthe map dated October 1991 shall be considered legal, and conforming according to existing zoning regulations. All new and additional campsites are required to be in compliance with the Zoning Regulation Section 17.9. 1 Campgrounds-Seasonal 7. Recreational Park Trailers will be limited to 10 % of total sites within the district for a maximum of 43 sites. 8 . Camping Cabins will be limited to 10 % of total sites within the district for a maximum of 43 sites . 16.3. 1 (d) Sewage and Garbage Disposal 1 . Sewage and garbage disposal shall meet all requirements of the Tompkins County Health Department. 2 . Rodent-tight refuse containers shall be provided so that there shall be a minimum of one container for every four campsites. . } Planning Board 5 05/05/2009 3 . There shall be absolutely no dumping of any type of refuse whatsoever in Willow Creek. 4. Garbage shall be picked up at least twice per week during the months of June, July and August, and at least once per week the remainder of the season. 5. Underground sewage receptacles should not be allowed within 100 feet of the edge of Willow Creek-all recreational vehicles within that area must have self-contained sewage holding tanks. 16.3 . 1 (e) Water 1 . Drinking water shall be provided and conform to the standards of the Tompkins County Health Department. 2 . There shall be no cleaning activities (activities that include soaps, shampoos, or cleansers) in Willow Creek, e.g. bathing, car washing, and dishwashing. 16.3. 1 (f) Maintenance 1 . The entire district shall be kept free and clear of all litter and be&maintained in a neat and orderly manner. '. 2. A monthly visual inspection shall be conducted of the sewage holding tanks of all Recreational Vehicles and Recreational Park Trailers located along and ,upgradient of Willow Creek shall be conducted. � = , 3 . Chlorinated water from the swimming pool will not be discharged . F 16.3 . 1 (g) Signs 4.‘ namesake sign or bulletin board not exceeding eighteen ( 1°8) square feet is allowed . Said sign shall not be self-illuminating and;the bottom of;said sign shall not be more than five (5) feet from the ground 16.3. 1 . (h) CommerciahSales ** 1 . There shall be commercial sales allowed° in this district. The area listed on survey � . �. •: . map dated"05/16/07 ewi11 be limited to a maximum of 6 units being displayed. 2. Commercial sales of Recreational Vehicles are allowed in this district. 44 \ 3. Commercial sales of Recreational Park Trailers are allowed in this district. , 4. The new units are allowed on a camping site for purpose of commercial sales. 5. An individual vacating a used unit may display the unit for second hand sale on a site within the district. 6. Retail store with sales of camping related items such as firewood, ice, sundry items for the accommodations of the campers and their guests. 16.3 . 1 (i) Storage Storage of recreation vehicles and boats on trailers is allowed, with the provision that no more than 60 percent of the campsites (255) can be used for storage, one unit per campsite and ten units stored at a location to be designated by the property owner. In- season storage shall be limited to the campsites themselves or the area designated for storage on the overall map . 16.3 . 1 (.1) Buffers All natural buffers are to remain, and in addition : Planning Board 6 05/05/2009 1 . From the current driveway, east, approximately 40 feet from the centerline of the road in line with the current tree line, a hedge (indicated as Hedgerow #2 on the map) of evergreens is to established, using a minimum spacing of 6 feet, with the minimum size of trees to be planted of 4 feet and with the hedgerow to be two rows of trees deep . If any trees die, they are to be replaced. 2 . The hedge by the dumping station is to be interplanted with evergreen trees and shrubs, from the entrance road to the west boundary. The purpose is to create a dense visual barrier to hide vehicles and activities and to provide privacy for regular users and campers as well as neighbors . Minimum size of plants at planting shall be 4 feet. 3 . All natural covers on the remaining boundaries shall remain and natural growth of said hedgerows shall be encouraged. 4. The existing sites along Willow Creek map dated October 1991 will be maintained with a natural vegetative buffer adjacent to the stream with a minimum of 20 feet. All future sites will be in compliance with Zoning Regulation Section 17.9. 1 which states no campsite, buildings, structures , or parking areas shall be located within one hundred ( 100) feet of a stream edge or any wetland as defined by state or federal law. y 16.3 . 1 (k) Mobile Home 40r; , One mobile home, larger than 750 square feet, shall be permitted in the Development District, in the location of the southwest corner of the barn; 100 feet west, 200 feet south, back 300 feet east, 200 feet northwest to the corner if.: hesbarn.
