Special Town Board Meeting
April 23 , 2009

SEAR for Comprehensive Plan
Mr. Austic asked what the Board wanted to do with the SEQR application for the
Comprehensive Plan.
Mr. Coogan reported that the 79 acres of disturbed property mentioned in the SEGR
application for The Comprehensive plan was arrived by Bergman from the information
given to them from Tompkins County. Mr. Coogan spoke to Ed Marx, Commissioner of
Planning, concerning the SEQRA process and the discrepancies in figures between the
Bergmann and our Part 1 for SEQRA. Tompkins County is using LIDAR (Imaging
Radar) and produced Methodology Report for classifying land use. Mr. Marx said that
they have noticed differences in acreage with the change in technology but feels that the
new methodology is the way to go . Also in the new methodology are many more land
use/cover categories and this is where "disturbed" comes in. As Mr. Marx explained it,
this is not the same as "disturbing" in that the SEQRA for a Comprehensive Plan is not a
project in the sense that land disturbance is not occurring and as such "disturbed" would
not trigger an Environmental Impact Study (EIS ) when it is greater than 5 acres.
Mr. Coogan said that after talking with Mr. Marx, Mr. Rachun and he decided that the
more reasonable course would be to use the SEQRA prepared by Bergmann using
the current methodology of the County. Bergmann's SEQRA should be corrected to
show that only part of Cayuga Lake is in the Town by acres not the entire 42 ,956 acres
(ref 16 . b) .
The Board continued discussing the 79 acres in the SEQR application. It was decided that
Mr. Coogan goes back to the County and get a definite answer to what the 79 acres
represents .
The Board discussed the filing of Article 239 l&m with the County and the SEQR
application has to be done for this . The other item that is being held up is the "lead
agency" letters .
Another item that was discussed is the draft copy that is being reviewed. The Board most
definitely wants a true final draft copy with all the changes included.
Ms . Thomas asked if everyone was in agreement that ounce the 79 acres was resolved
that Mr. Rachun could go ahead and send out the letters for the "lead agency". Mr.
Austic and Mr. Kerness agreed with that.
Mr. Rachun would like to wait until he has a completed package to send them out ;
completed to Mr. Rachun is the SEQR and the final Draft Comprehensive Plan.
The Board discussed getting ten final draft copies from Bergman.
Local Law #1 - 2009 "Increase Supervisor Salary"
The Town Board held a duly published public hearing on April 14th, 2009 . No comments
were heard from the public . Ms . Thomas moved, seconded by Mr. Kerness the
following : -
BE IT RESOLVED that the Town Board of the Town of Ulysses approves Local
Law # 1 -2009 subject to a permissive resolution.

Ms . Thomas received three bids for the design of the Ulysses web page ranging from
$ 1000 to around $4000 that she shared with the Board members . Ms . Thomas would like
to review them further and talk to the applicants and feels at this time the bid for the
lesser amount would be fine. Ms . Thomas moved, seconded by Mr. Kerness the
following :
BE IT RESOLVED that the Town Board of the Town of Ulysses approve that
Ms . Thomas complete the review and accept the bid from Andrew Pushlar up to
$2000 for the design of the Ulysses Web-page.

Review of the Draft Comprehensive Plan

Mr. Kerness said Ms . Poelvoorde gave them a document with the final changes to the
Comprehensive Plan and it is very difficult to follow and ad these changes to the draft
copy that they all have for review dated January 2009 .
Ms. Thomas will get back with Ms. Poelvoorde to define the change sheets .
Mr. Austic questioned some words or phrases he felt needed explanation such as "small
scale", "historical" and "appropriated level" were some he mentioned . Who determines
these things like appropriate level?
Ms. Thomas said she would suggest that if there is a word or phrase come up with a
replacement and see if everyone agrees on it and move through it .
Mr. Kerness also said the word "appropriate" is used throughout the document and he
does not know what it means .
Mr. Rachun said that the zoning will become the appropriate.
Mr. Austic said that the Comprehensive Plan is the direction for the zoning so you have
to understand what it means .
Ms . Thomas said that a document like this must be somewhat vague . Ms . Thomas asked
for bigger issues now that can be talked about.
Mr. Austic brought up some things he had read like :
• Only building two-story houses in Jacksonville
• Use historical farming practices in the Conservation Zone — and he does not know
what that means
• Does not allow for mixed use in Jacksonville
Mr. Kerness said his problem is going through the document and some things jump out
and other things are okay.

Mr. Rachun said one of his big issues and the Board may have gotten his emails on it and
that is the large moderate density zone on the south end of town and his feeling is that
there is prime soil down there and a lot of good farms. Mr. Rachun does not see
moderate density being in that location.
Ms. Thomas said that was changed .
Mr. Rachun said that he feels that the Hamlet of Jacksonville should be a really
diversified hamlet and his opinion it should have single, two-story, multi story buildings,
store fronts, get some vibrant development and be a walk able community.
Ms . Thomas said that the committee had that intent and if the wording needs to be
revisited and change the language.
The Broad discussed the category of "Office and Technology Mixed Use" in the Krums
Corners location.
Mr. Austic said he did not like this location because of the dangerous intersection.
Mr. Coogan said that the County Planning would have rather not seen that area made this
but you also have to look at what has happened there and is likely to continue happening
there.
The following are the changes that the Board made to the draft Comprehensive Plan after
much discussion :
Table 1 — Summary of Future Land Use Plan Categories (pages 36 & 37)
• Mixed Use Hamlet Center — added in — small scale transitional commercial
and entertainment facilities
• Transitional Commercial - removed - small scale before grocery store
Mr. Kerness brought it up that none of the blue, brown or pink districts are included on
the Future Land Use Plan that is on the Zoning Map, which are the Business Districts, the
Planned Unit Developments and the Mobile Home Parks .
Mr. Rachun said that these areas would them become grandfather in and he is not
comfortable with the grandfather clause because these areas would forever have to stay
what they are now and would not be able to enlarge and could become unusable.
Mr. Kerness and Mr. Austic both felt the better approach would have these districts on
the Comprehensive plan for the future. After all they are the businesses in the Town of
Ulysses and should be protected.
The next meeting was scheduled for April 30th, 2009 at 4pm till 6pm.
Hearing no further discussion the meeting adjourned at 9 : 30 pm .
