Applicants :
Chairman George Tselekis called the meeting and a duly advertised public hearing to
order at 7 : 30 pm. He stated they are considering a request by John Howe to construct a
freestanding carport located at 6224 Mayo Road, Trumansburg. An application was
denied under Article VII Section 7 . 6 . The problems are the proposed yard setback is less
than 50 feet required, the lot is less than 2 acres, and the frontage is 159 fett (250 ft is
required) . He asked Mr. Howe to present a description of the project.
Mr. Howe asked what the 50 feet requirement is .
Mr. Tselekis noted the 50 feet requirement is on the Legal Notice .
Mr. Howe stated he thought it was 75 feet .
Mr. Tselekis stated they would review that later, he asked Mr. Howe to present his
project.
Mr. Howe stated he had a freestanding canopy to cover his boat . He took this down and
would like to erect a 18 x 21 carport structure to cover his boat. It is 16 feet from the
Denmark ' s (neighbor) property, he has checked with them and they do not have an issue
with this installed . It would be freestanding, on a gravel base with spikes in the ground
for stability. It would not be a garage it is open all around. He stated he keeps his
property in good condition.
Mr. Tselekis noted the neighbors had all been informed and they had not received any
correspondence nor were there any members of the public at the meeting.
He noted there are three issues to review, the first is the front yard setback, it is 75 feet
from center of road or 50 from edge. It was noted he did not meet this requirement as he
is 69 feet to center of road. The lot is less than 2 acres, this lot is less than 1 acre. The
frontage is 159 feet not 250 feet.
Mr. Glasner stated the neighbors are obviously not impacted. He did a quick drive by on
Mayo and noted it is elevated and cannot be pushed back. This is the only alternative he
has due to the location and it is not visually seen by the neighbors .
Mr. Howe stated he did not realize the Board would drive by but appreciated the
comment .
Mr. Tselekis asked if they had any other questions . No questions were offered . He asked
if a member would like to make a motion .
Mr. Glasner made the MOTION, seconded by Mr. Mann.
Whereas, there will no undesirable change to the character of the neighborhood,
Whereas, there is no detriment to nearby property confirmed by non receipt of
correspondence received for requested variance„
Whereas, the benefits sought by the applicant cannot be achieved by a feasible
alternative method other than an area variance, and

Whereas, the variation is not substantial (10%) in comparison to the previous
requirements,
Whereas, the variance requested will not have an adverse impact on the physical and
environmental conditions in the neighborhood and the other two variances are not
exacerbated by this variance,
Whereas, the alleged difficulty was not self-created,
Be it therefore resolved that the Town of Ulysses Zoning Board of Appeals approve an
area variance to construct a freestanding carport. Area variance is granted to John
Howe, 6224 Mayo Road, Trumansburg, NY, Town of Ulysses, Tax Parcel 22. -4-25. 1

The variance was approved unanimously.
Ms . Carlisle Peck stated they have minutes that need to be approved . They have 11 / 19/08
minutes to review .
Mr. Mann made the MOTION to approve the minutes of 11 / 19/08 as presented,
Mr. Glasner seconded the MOTION. The vote was unanimous, 11 / 19/08 MINUTES
APPROVED .
Mr. Tselekis stated the Town of Lansing is sponsoring a training on April 13th . He noted
the Board is required to have training on a yearly basis . He received the notice from
Marsha Georgia, if any members are interested they can contact her or him directly.
Mr. Tselekis asked if there was a motion to adjourn.
Ms . Bristow MADE the MOTION to adjourn, Mr. Glasner seconded the MOTION.
The meeting was adjourned at 7 : 39pm.
