Code Enforcement; Susan Brock, Attorney; Paulette Rosa, Town Clerk Call to Order Ms. Meier Swain called the meeting to order at 7:01 p.m. Second agenda item, Limb Walkers, was postponed until the January 21" meeting. AGENDA ITEM 1 Consideration of Preliminary and Final Subdivision Approval for the proposed subdivision of 1073 Ellis Hollow Road, Town of Ithaca Tax Parcel No. 62.-2-9, Low Density Residential Zone. The proposal involves subdividing 1.30 +/- acres from 1073 Ellis Hollow Road (Parcel B - Tax Parcel No. 62.-2-9) to consolidate with 1069 Ellis Hollow Road (Parcel A - Tax Parcel No. 62.-2-10). The remaining portion of Parcel B will be consolidated with an adjacent parcel (Tax Parcel No. 62.-2-11.2). The project will not create any new lots. Ms. Gutenberger gave an overview of the project saying that there is a residence or "improvement" on the property which is under a land -leased from Cornell. The owner is selling the improvement and the buyer would like to increase the size of the lot in order to do some drainage improvements. In looking at the lot, it was discovered that the garage had been added to without a permit sometime in the past 30 years. That addition, a lean-to or car port, is used to store firewood and straddles the lot line. The goal is to allow for the drainage work and meeting lot dimensions for the zone. SEQR Determination The Board had no questions on the SEQR form. Minor changes were made. The Planning Board on December 17, 2019, has reviewed and accepted as adequate a subdivision map entitled "Survey Map, Lot Line Adjustment Map For No. 1069 Ellis Hollow Road, Town of Ithaca, Tompkins County, New York", prepared by T. G. Miller P.C., dated 5/13/2019, and other application materials; and 4. Town planning staff has recommended a negative determination of environmental significance with respect to the proposed Subdivision Approval; NOW THEREFORE BE IT RESOLVED: That the Town of Ithaca Planning Board hereby makes a negative determination of environmental significance in accordance with Article 8 of the Environmental Conservation Law and 6 NYCRR Part 617 New York State Environmental Quality Review for the above referenced action as proposed, based on the information in the EAF Part 1 and for the reasons set forth in the EAF Parts 2 and 3, and, therefore, an Environmental Impact Statement will not be required. Discussion of proposal The Board discussed the issues around the garage and addition to it. PB 2019-12-17 (approved 1-21-2020) Pg. 2 Ms. Gutenberger stated that the new land lease does require that the storage addition be removed if the use is no longer there and could not be added to or changed from its current configuration. She added that no option is off the table at this point, and the addition may simply be removed. Ms. Brock added language to the draft resolution addressing the garage addition. PB RESOLUTION 2019-042: Preliminary and Final Subdivision Approval Ellis Hollow Road Subdivision/Consolidation 1073 Ellis Hollow Road Tax Parcels 62.-2-9, 62.-2-10, and 62.-2-11.2 Town of Ithaca Planning Board, December 17, 2019 WHEREAS: This is consideration of Preliminary and Final Subdivision Approval for the proposed subdivision of 1073 Ellis Hollow Road, Town of Ithaca Tax Parcel No. 62.-2-9, Low Density Residential Zone. The proposal involves subdividing 1.30 +/- acres from 1073 Ellis Hollow Road (Parcel B - Tax Parcel No. 62.-2-9) to consolidate with 1069 Ellis Hollow Road (Parcel A - Tax Parcel No. 62.-2-10). The remaining portion of Parcel B will be consolidated with an adjacent parcel (Tax Parcel No. 62.-2-11.2). The project will not create any new lots. The Planning Board on December 17, 2019, has reviewed and accepted as adequate a subdivision map entitled " Survey Map, Lot Line Adjustment Map For No. 1069 Ellis Hollow Road, Town of Ithaca, Tompkins County, New York", prepared by T. G. Miller P.C., dated 5/13/2019, and other application materials; NOW THEREFORE BE IT RESOLVED: 1. That the Town of Ithaca Planning Board hereby waives certain requirements for Preliminary and Final Subdivision Approval, as shown on the Preliminary and Final Subdivision Checklists, having determined from the materials presented that such waiver will result in a significant alteration of neither the purpose of subdivision control nor the policies enunciated or implied by the Town Board; and 2. That the Planning Board hereby grants Preliminary and Final Subdivision Approval for the proposed subdivision and consolidation at 1073 Ellis Hollow Road, as shown on the survey map noted in Whereas 43 above, subject to the following conditions: PB 2019-12-17 (approved 1-21-2020) Pg. 3 a. Submission for signing by the Chairperson of the Planning Board of an original and three dark lined prints of the approved final subdivision plat, prior to filing with the Tompkins County Clerk Office, and submission of a copy of the receipt of filing to the Town of Ithaca Planning Department; b. Within six months of this approval, consolidation of "Parcel B" (1.30+/- acre portion of Tax Parcel No. 62.-2-9, 1073 Ellis Hollow Road) with "Parcel A" (Tax Parcel No. 62.-2- 10, 1069 Ellis Hollow Road), and submission to the Planning Department of a copy of the county consolidation request form; c. Within six months of this approval, consolidation of the remaining lands of Tax Parcel No. 62.-2-9 with Tax Parcel No. 62.-2-11.2, and submission to the Planning Department of a copy of the county consolidation request form; and d. Prior to the signing of the plat by the Planning Board Chair, either: 1. Removal of the portions of the of the "addition" (as labeled on the survey map) that are located on Parcel B, or 2. Filing in the Tompkins County Clerk's Office of an agreement approved by the Attorney for the Town to allow the property owner of 1077 Ellis Hollow Road to continue to access and use the portion of the "addition" that is located on Parcel B, and submission to the Planning Department of proof of such filing within 5 days of the filing. e.
