REQUESTING VARIANCE OF THE REQUIREMENTS OF ARTICLE V , SECTION 20 , OF THE TOWN OF ITHACA ZONING ORDINANCE , TO PERMIT', THE PLACEMENT OF A SATELLITE DISH ANTENNA IN THE FRONT YARD AT 132 ENFIELD FALLS ROAD , TOWN OF ITHACA TAX PARCEL NO . 6 - 33 - 1 - 9 . 1 , RESIDENCE DISTRICT R- 30 . ARTICLE XIII , SECTION 59A , PARAGRAPH a . , OF SAID ORDINANCE , CONSIDERS A DISH ANTENNA A PERMITTED ACCESSORY BUILDING , WITH SAID ARTICLE V , SECTION 20 , REQUIRING ACCESSORY BUILDINGS TO BE LOCATED IN A REAR YARD ONLY . i At this point , 'Chairman Aron read aloud the Appeal of Mr . Salmi , dated August 16 , 1988 , a copy of which is attached as Exhibit 1 . Chairman Aron asked Mr . Salmi if he 'jhad anything he wanted to add to his appeal , with Mr . Salmi answering ,i no . Chairman Aronnoted that the Board members had a survey map If before them , dated October 17 , 1986 ; a copy of which is attached as Exhibit 2 . The Board members also had before them a copy of the Building Permit Application , dated August 2 , 1988 , which is attached as Exhibit 3 . Chairman Aron o wondered when Mr . i�ISalmiurchased the p dish antenna . Mr . Salmi responded that he had brought it to his present residence from a previous residence in Spencerl , New York , noting that that was August 1 , 1988 . Mr ., Salmi offered that the dish has been installed . Mr . Salmi stated that he . had talked with the Zoning Officer , Mr . Frost , and he informed him to go ahead and install it , noting that it would be at a risk , but Mr . Frost thought it would be a good risk . III Zoning Board of Appeals - 21'; October 12 1988 II • The Public Hearing was opened . Tom Shea of 210 Enfield Falls Road spoke from the floor and stated that he owned the property directly adjacent to Mr . Salmi . Mr . Shea commented that '' he thought it was his trees that prevent the dish being placed in the backyard . Mr . Shea stated that he had no objection to the dish , or where it is placed . 11 Jane French of 222 Enfield Falls Road stated that , in her opinion , the dish in the front yard is an eyesore . Ms . French resides three houses up the ,road from Mr . Salmi , commenting that she drives by Mr . Salmi ' s home every day , and adding that she cannot see it from her house . P Ginger DeKay of 130 Enfield Falls Road stated that she is a neighbor , and does not object to thel,, dish antenna . Il Leslie Morse of 157 Enfield Falls Road stated that both she and her husband do not object to the dish antenna . Jim Walker of 2135 Enfield Fallsl',I, Road stated that he did not think the dish was a distraction , and voiced no objection to the dish antenna . Craig Wilkins of 234 Enfield Falls Road stated that he drives by 11 • Mr . Salmi ' s home every day , and did not object to leaving the dish where it is placed . The Public Hearing was closed . Mr . King wondered if Cable Television was available in the area , with Mr . Salmi responding , yes . Mr . Salmi stated that he had considered hooking up to the cable , b'11 ut he has approximately $ 4 , 000 . 00 invested in the dish . Mr . Salmi noted that he has owned the dish about five years . Mr . King wondered about the possibility of deadending the road at Mr . Salmi ' s property . Mr . Salmi responded that it had been discussed , but was not sure if it would be done . At this time , Ginger DeKay , amember of the public , approached 11 the Board and stated that there are'i plans for the deadend , but the money has not been appropriated yet . Ms . DeKay said that the plans were to run Route 327 into Route 13 . Board Member Eva Hoffmann noted !ithat she had viewed the property and it appeared to her that the land " in back of the property had been cleared quite a bit . Mr . Salmi answered that the previous owner had cut down trees , and that he had also cleared it . Mr . Salmi said that there still are trees that would interfere with the signal of the antenna . Chairman Aron 'inquired of Mr . Frost if the dish comes under • Federal regulations .,, Mr . Frost responded , no , the Town of Ithaca Zoning Ordinance is to be complied with . Zoning Board of Appeals - 3 - October 12 , 1988 It was Moved by Edward King as follows : WHEREAS , this Board finds that the dish is painted black with open - screen architecture , and WHEREAS , the dish is nicely placed by a tree , and is not very obtrusive , therefore it is RESOLVED , this Board grant approval to permit the dish antenna to stay where it is erected for a limited time period of five years . SUBJECT TO THE FOLLOWING CONDITIONS : ( a ) That the dish antenna not be altered , enlarged or in any other way changed , whereby it becomes more obtrusive , and ( b ) The approval will be reviewed after a period of five years . Joan Reuning seconded the Motion . The voting was as follows : Aye - Aron , King , Reuning , Hoffmann . Nay - None . The MOTION was unanimously carried . • The second item on the Agenda was as follow se s • APPEAL OF PAMELA SACKETT , APPELLANT , REQUESTING A VARIANCE UNDER SECTION 9 OF LOCAL LAW NO . 7 - 1988 , " REQUIRING SPRINKLER SYSTEMS TO BE INSTALLED IN BUILDINGS IN THE TOWN OF ITHACA " , FOR A PROPOSED RESIDENTIAL BUILDING TO BE LOCATED AT 181 KENDALL AVENUE , TOWN OF ITHACA TAX PARCEL NOI; , 6 - 54 - 4 - 21 , RESIDENCE DISTRICT R- 9 , Stephen Sackett read aloud the Appeal of Pamela Sackett , a copy of which is attached hereto as Exhibit 4 . At this time , ' Mr . Sackett offered some documentation that was filed with the Appeal . ( Copy of a letter from Kaplan Building Systems , Inc . , dated July 7 , 1988 , attached as Exhibit 5 , and copy of a letter from Kaplan Building Systems , Inc . , dated September 8 , 1988 , attached as Exhibit 6 . ) Mr . Sackett also noted a Purchase Contract , dated June 17 , 1988 , and a map of the proposed house , dated July 1 , 1988 , which are attached as Exhibits 7 and 8 , respectively . Chairman Aron pointed out that the contract was signed on June 17 , 1988 , noting that the Sprinkler Law became effective July 11 , 1988 . At this point , Chairman Aron noted that a letter addressed to Mr . • Desch , from Mr . & Mrs . Stephen Sackett , dated August 24 , 1988 had been received , a copy of which is attached as Exhibit 9 . Chairman Aron stated that Mr . Desch is the Town Supervisor , and as the Town Zoning Board of Appeals - 4 - October 12 , 1988 • Supervisor , has no influence on the Zoning Board of Appeals , because it is an independent Board that has nothing to do with the Town Board or Planning Board . Chairman Aron stated that that letter should have been addressed directly to the Zoning Board of Appeals . Chairman Aron asked Mrs . Sackett if she had received an answer to the letter , with Mrs . Sackett answering , yes , from Mr . Desch . Mrs . Sackett stated that Mr . Desch instructed her to contact the Zoning Board of Appeals . Chairman Aron inquired as to whether the home was being set up to be sold , or was it a private home ' for the Sacketts . Mrs . Sackett answered that , at the moment , if the home does not sell within two months it would be their home . Mrs . Sackett stated that the one - story home is set on a foundation , and it has a full basement . Chairman Aron wondered , when the contract for the home was signed by the Sacketts , if they were aware of anything published in the newspaper regarding , the Sprinkler Law that was to be voted on . Mr . Sackett answered , no , in fact , he heard about it from Mr . Montgomery May who was looking at another home + that was erected in Lansing , New . York , commenting that this was a week after the Sprinkler Law was passed . Mr . Sackett stated that they were considering contracting a heating system from Mr . May , Mr . Sackett remarked that the home in question did not come for yet another week , which was after his discussion with Mr . May , noting • that the subject home was delivered the first of August , 1988 , Mr . Sackett added that there was no way to stop delivery after approximately two to three weeks '' after the delivery is accepted . Board Member King noted that the contract was accepted by the supplier company on June 17 , 1988 . Mr . Sackett stated that if had he not taken delivery it would have been a default on the contract , and stood to lose the deposit of $ 5 , 000 . 00 . Chairman Aron asked Mr . Sackett if , when he heard about the Sprinkler Law , the Kaplan Building ;,Systems , Inc . was notified that a Sprinkler System might be required, . Mr . Sackett responded that he mentioned it to Von Bailey , District Sales Consultant , and Mr . Bailey ' s first response was that it probably would void the warranty . Chairman Aron wondered if Mr . Sackett had read the Ordinance concerning the Sprinkler Law . Mr . Sackett responded that he read it sometime during the first week of August 1988 , The Public Hearing was opened . John Mead of 219 W . Lincoln Street spoke from the floor and stated that he was a small private ' contractor in the area . Mr . Mead commented that Andrew Frost , Building Inspector , was the first person that informed him about the Sprinkler Law . Mr . Mead offered that , in his opinion , the figures for the installation cost of the sprinklers were not high enough . Mr . Mead said that he based his opinion on phone calls , discussions with people in the area , and the State • Department in Albany , New York , Mr . Mead stated that , basically , he was against the Sprinkler Law , but just wanted to share the above information , on behalf of Mr . Sackett , with the Board . Zoning Board of Appeals - 5 - October 12 , 1988 ofThe Public Hearing was closed . Mr . Sackett stated that during this whole affair he had contacted a company called J . & J . Residential Sprinkler , Syracuse , New York , Mr . Sackett noted that he spoke with the two men who run the company . Mr . Sackett stated that he was given an estimated cost of $ 2 , 300 . 00 , noting that that was for their part of the work , and not in consideration of what would have to , be done to .the home to renew the finish of the interior . Mr . Sackett stated that , additionally , the construction of the home in question does not lend itself to the installation of sprinklers , because of the design of the roof trusses . Chairman Aron responded that a truss is nothing but a triangle , with webbing inside . Mr . Sackett said that the standard technique was to drill through the bottom cord of the truss , and put a pipe through which is in excess of an inch in diameter . Mr . Sackett stated that the trusses , in this particular instance , are less than two inches in diameter . Mr . Sackett noted that the center line of the house , since the house is constructed of two separate boxes , has a joint which is composed of four 2X10s . Mr . Sackett stated that the center line of the house is inaccessible for sprinkler heads or for anything that one might want to drill down through the ceiling . Chairman Aron wondered if Mr . Sackett had any more information from the manufacturer of modular homes , as to whether or not drilling through the bottom cord of the trusses would weaken the truss . Mr . Sackett responded that the structure of the home is not something he could influence , adding that when the home is purchased it is as designed . Mr . Sackett commented that Mr . Bailey of Kaplan Building Systems , Inc . indicated that the company would stop marketing in New York State if Sprinkler Systems were required , because they consider that to be something that they cannot build into the homes . ii Attorney Barney asked Mr . Sackett if he , generally , buys houses and resells them , or was this for a personal use . Mr . Sackett responded that the subject home may' be used , personally , by him , but the original intention was to sell it . Mr . Sackett stated that he had purchased other homes from the Kaplan Company , but not under the present arrangement , adding that he, sells homes for Kaplan to people who are doing construction projects . Mr . Sackett stated that homes have been placed in Lansing , New York , Brooktondale , New York , and Groton , New York , Attorney Barney wondered if the above areas required building permits , with Mr . Sackett answering , yes . Mr . Sackett noted that in order to apply for a building permit one has to have blueprints , and the house has to be ordered before the blueprints can be given out . Mr . Sackett stated that he was awaiting the arrival of the blueprints so that he could apply for a building permit . 11 Attorney Barney wondered , leaving sprinklers aside , if the plans come in and do not meet some other code requirement , can one , at that point , cancel the order . Mr . Sackett responded that it depended on the timeframe of the house being scheduled into the factory for construction , commenting that if it has not been scheduled , then it • can be withdrawn . Andrew Frost , Building Inspector , noted that a Building Permit application had been received on August 9 , 1988 , and a permit was issued August 10 , 1988 with the condition that the Zoning Board of Appeals - 6 October 12 1988 • Sprinkler System be installed prior to the issuance of a Certificate of Occupancy . Mr . Sackett stated that the original prints received were stamped with a ' rubber stamp , and noted that it was necessary to reacquire the prints . Eva Hoffmann wondered if it: were possible to secure the blueprints to get a Building Permit without a commitment to purchase a home . Mr . Sackett answered , no , the first $ 1 , 000 . 00 assured the company that there is interest , " adding that the payment is non- refundable . Edward King asked Mr . Sackett if the J . & J . Company had examined the subject house . Mr . Sackett responded that they were scheduled to do that , however , when it was known it was possible to secure a variance , they did , not examine the , house , Mr . King wondered if the applicant had considered an alternative to a sprinkler system . Mr . Sackett responded that he had not been aware that there were alternatives . Chairman Aron noted that there are heat sensors . Mr . King made a Motion as follows : RESOLVED , that this Board adjourn this matter until October 19 , 1988 , at 7 : 00 p . m . , pending the Town Board Meeting on October 17 , 1988 concerning the revamping of the Sprinkler Law , as to single and two - family homes , but in the meantime the applicant should produce , in writing , to Andrew Frost , Building Inspector / Zoning Enforcement Officer , such alternatives to a ` sprinkler system that he would propose . Joan Reuning seconded the Motion . The voting was ' as follows . Aye - Aron , Reuning , Hoffmann , King . Nay - None . The MOTION was unanimously carried . Chairman Aron announced that , , for everyone ' s information , there will be no mailing of individual Notices for the above - noted meeting . The third item on the Agenda was the following : APPEAL OF CATHERINE STEARNS , APPELLANT , JOHN S . MEAD , AGENT , REQUESTING A VARIANCE UNDER SECTION 9 OF LOCAL LAW N0 . 7 - 1988 , " REQUIRING SPRINKLER SYSTEMS TO BE INSTALLED IN BUILDINGS IN THE TOWN OF ITHACA " , FOR A PROPOSED RESIDENTIAL BUILDING TO BE LOCATED AT 102 DREW ROAD , TOWN OF ITHACA TAX PARCEL N0 , 6 - 28 - 1 - 34 . 291 RESIDENCE DISTRICT R- 30 . Mr . Mead addressed the Board and stated that he was the • contractor for the proposal , and noted that the Appellant , Catherine Stearns , was his mother - in - law . Zoning Board of Appeals - 7 -, October 12 , 1988 • Mr . Mead stated that in late April of 1988 , Mrs . Stearns made a decision to sell her home , based on estimates of the selling price , that she now owns . Mr . Mead noted that Mrs . Stearns lived in a log home for 15 years , and wanted to build a smaller log home , adding that the name of the company was Beaver Mountain Log Homes , Inc . , of Hancock , New York . At this time , Mr . Mead referred to the Appeal of Mrs . Catherine Stearns , dated August 30 , 1988 , a copy of which is attached hereto as Exhibit 10 , the Purchase Order , dated June 29 , 1988 , a copy of which is attached hereto as Exhibit 11 , and also a letter of receipt of $ 1 , 000 . 00 for blueprint drawings , dated June 29 , 1988 , a copy of which is attached hereto as Exhibit 12 . Mr . Mead stated that Mrs . Stearns had invested over $ 10 , 000 . 00 , as of July 9 , 1988 , in the new house , commenting that this was before she knew anything about the new Sprinkler Law . Mr . Mead stated that the house has 1 , 020 square feet , adding that the house would be on a private well system . Mr . Mead said that the above was a financial hardship . Mr . Mead remarked that there are only two partition walls downstairs , in the middle of the house , and the rest of the house is all logs , adding that all the pipes would be exposed . Mr . Mead stated that there would also be a problem putting the pipes in a horizontal position , because all the floor joists are 6x8 logs , two - foot on center . Mr . Mead mentioned the visual aspect . Chairman Aron , asked Mr . Mead Iif he , or Mrs . Stearns , had any inclination when the log home was purchased that there was a Sprinkler • Law . Mr . Mead answered , no , he heard it through the grapevine after the log home was purchased . Andrew Frost , Building Inspector , offered that a Building Permit had been issued in August 1988 with the condition that a Sprinkler System be installed . Mr . Mead offered that the house at the present time is , basically , a package of logs , with all the framing material , and is 3 / 4 built on a poured foundation . [ Plot Plan attached hereto as Exhibit 13 . 1 At this time , Mr . Mead referred to a letter from the State of New York , Department of State , addressed to Mrs . Stearns and dated September 20 , 1988 , ' a copy of which is attached hereto as Exhibit 14 , The Public Hearing was opened . ' Ed Cobb of 1005 Danby Road spoke from the floor and stated that he thought it was a good idea to ' adjourn the meeting for further information as to the revamping of the Sprinkler Law , The Public Hearing was closed . Joan Reuning wondered about the recovery capacity of the well . Mr . Mead answered that there was not the capacity for a sprinkler system . Chairman Aron Moved as followssl RESOLVED , that this Board adjourn this matter until October 19 , 1988 , at 7 : 00 p . m . , pending the Town Board Meeting on October 17 , 1988 concerning the revamping of the Sprinkler Law , as to single and Zoning Board of Appeals - 8 - October 12 , 1988 • two - family homes , at which time Mr . Mead will come before the Board with alternatives to a sprinkler system that may be acceptable to the Board . Joan Reuning seconded the Motion . The fourth item on the Agenda was the following : APPEAL OF JANETTE McCORD , APPELLANT , REQUESTING THE SPECIAL APPROVAL OF THE ZONING BOARD OF APPEALS UNDER , ARTICLE III , SECTION 4 , PARAGRAPH 19 , AS AMENDED BY TOWN OF ITHACA , LOCAL LAW NO . 9 - 1988 , FOR THE OPERATION OF A GROUP FAMILY DAY CARE HOME AT 1048 DANBY ROAD , TOWN OF ITHACA TAX PARCEL N0 , 6 - 39 - 1 - 12 . 1 , RESIDENCE DISTRICT R - 9 . Chairman Aron invited Ms . McCord to address the Board . • Ms . McCord referred to the Appeal Form , dated August 15 , 1988 , attached hereto as Exhibit 15 . Ms . McCord stated that there are a total of 17 children in the Day Care Home , adding that there are only 12 on any given day , as some are part - time . Ms . McCord offered that she was licensed by New York State , Ms . McCord stated that she was open from 8 : 00 a . m . to 5 : 30 p . m . , commenting that she employs two people , adding that the employees are on opposite shifts , so they are not on the premises at the same time . Ms . McCord said the 'drop - off schedule for the children is between 8 : 00 a . m . and 11 : 00 a . m . , picking them up between 1 : 00 p . m . and 5 : 30 p . m . Ms . McCord offered that , at the most , there would be three vehicles dropping off children at one time . Ms . McCord said that she had enough parking spaces ' in the front , at 1048 Danby Road , for 11 cars . At this point , Ms . McCord referred to a copy of the property survey , dated October 8 , 1985 , which is attached as Exhibit 16 . Ms . McCord stated that she also owns the house at 1046 Danby Road , which is a rental unit . Chairman Aron asked Ms . McCord "how long her business has existed , with Ms . McCord responding , since July 1986 . Ms . McCord stated that , originally , she had seen the former Building Inspector , Mr . Lewis Cartee , and was not aware , at that time , that she had to have any Special Approval . • At this time , Chairman Aron referred to documents entitled " SEQR SHORT ENVIRONMENTAL ASSESSMENT FORM , PART I and PART II , McCord Group Family Day Care Home , dated August 15 , 1988 , and October 12 , 1988 , Zoning Board of Appeals - 9 -' October 12 , 1988 • respectively , Reviewer : Susan C . Beeners . A copy of these documents is attached hereto as Exhibit 17 . 1 The Public Hearing was opened . Ed Cobb of 1005 Danby Road spoke from the floor and stated that the Day Care Home was up the road from him , approximately 1 / 4 mile . Mr . Cobb stated that he had called the neighbor directly adjacent to the Day Care Home ,', and the neighbor voiced no objection to the facility . Mr . Cobb :,1' stated that he also had no objection to the Day Care Home , The Public Hearing was closed . Mr . King asked ', Ms . McCord how old the children were at the Day Care Home , with Ms . McCord answering , two to four years old . Ms . McCord noted that the parking area at 1048 Danby Road is larger than the one at 1046 Danby Road , therefore , the people visiting in the area park in the larger lot . Eva Hoffmann mentioned that , perhaps , a sign would take care of the problem . Chairman Aron stated that there would be no use conditioning a 42 - foot wide parking lot , if that lot were used by others . Joan Reuning suggested a sign indicating that violators would be towed at their own expense . Mr . King suggested that 'all cars parked in the lot must be registered with the Day Care Home , adding that this would discourage violators . Eva Hoffmann stated that it makes sense to have parking in the i. front yard , as the children play in t 11 he backyard . Chairman Aron asked Ms . McCord 1, f she would amend her application to state that she would expand the parking lot to 42 feet , as part of the Group Family Day Care Home , Msa McCord responded that she would amend her application , and voluntaril'?y be willing to widen the parking lot from 38 feet , not to exceed 42 feet . A Motion was made by Joan Reuninl'g as follows : RESOLVED , that , with respect to 'l' the Bunny Trail Group Family Day Care Home , this Board makes a negative declaration of environmental significance . it Eva Hoffmann seconded the Motion!i . The voting was as follows : Aye _ Aron , King , Reuning , Hoffmann , Nay None . The MOTION was unanimously carried . As to the Special Approval , thefollowing Motion was made by Joan Reuning : 11 Zoning Board of Appeals - 10 - October 12 , 1988 Chairman Aron stated that if the Board grants Special Approval , with conditions , the Board would hold Ms . McCord responsible for the parking and if the conditions cannot be complied with , the Special Approval could be withdrawn for cause . RESOLVED , that [ Special Approval be granted for the Bunny Trail Group Family Day Care Home , as requested , subject to the following conditions . ( a ) That the parking area be expanded to 42 feet in width . ( b ) That the Home complies with all regulations . ( c ) That signs be placed in thi1e parking area to discourage other people from parking , other than those cars designated for the Day Care Home , ' I ( d ) That instructions be givenito the users of the parking area to turn and properly exit theparking area onto the highway . Ad ) That the widening of the lot be done subject to the approval of the Town Engineer , Eva Hoffmann seconded the Motion . The Uniform Fire Prevention and Building Code does not require sprinklers in single- family dwellings . However , the Uniform Code Act , Article 18 of the Executive Law , provides that local governments may enact local laws imposing standards more stringent than those found in ° the Uniform Code . The Codes • Division is aware that the Town of Ithaca has done so with regard to requiring sprinklers in most new construction . Domestic sprinkler systems conforming with National Fire Protection Association Standard 13D can be effectively installed in locations without public water supplies . The water supply is required to provide for no more than two sprinkler heads he 13 gallons per minute each for ten minutes , or a maximum of 260 gallons . This can be accomplished with an elevated tank , a pressure tank or a tank with an automatic pump . It has been estimated that such a system may add up to $81, , 000 to the cost of constructing a typical single- family house . Fire insurance costs are generally reduced by sprinklers .
