HomeMy WebLinkAboutLL 16 of 2006 Bldg Permits & COs.doc TOWN OF ITHACA LOCAL LAW NO. 16 OF THE YEAR 2006 A LOCAL LAW AMENDING CHAPTER 270 OF THE TOWN OF ITHACA CODE, TITLED “ZONING,” REGARDING BUILDING PERMITS AND CERTIFICATES OF OCCUPANCY Be it enacted by the Town Board of the Town of Ithaca as follows: Section 1. Chapter 270 (Zoning), Section 270-233 of the Town of Ithaca Code, titled “Permit to build,” is amended by deleting paragraphs A through G and replacing them with the following text: “A. No person, firm, corporation, association or other organization shall commence the erection, construction, enlargement, alteration, improvement, repair, removal, or demolition of any building or structure (including signs, except as specified in Chapter 221, Signs, of the Code of the Town of Ithaca), nor install heating equipment, nor undertake any other work which must conform to New York State’s Uniform Fire Prevention and Building Code, without having applied for and obtained a building permit from a Code Enforcement Officer pursuant to Chapter 125 of the Code of the Town of Ithaca. Notwithstanding the foregoing, no building permit shall be required under those circumstances specified in § 125-4(A) of the Code of the Town of Ithaca for which no building permit is required. B. No permit to build shall be issued except pursuant to written order of the Board of Appeals, where the proposed construction, alteration, or use would be in violation of any provision of this chapter.” Section 2. Chapter 270 (Zoning), Section 270-234 of the Town of Ithaca Code, titled “Certificate of occupancy,” is amended by deleting its entire text and replacing it with the following text: “A certificate of occupancy shall be required for all work and other circumstances specified in § 125-7 of the Code of the Town of Ithaca.” Section 3. In the event that any portion of this law is declared invalid by a court of competent jurisdiction, the validity of the remaining portions shall not be affected by such declaration of invalidity. Section 4. This local law shall take effect upon publication of the local law or an abstract of same in the official newspaper of the Town, or upon its filing with the New York Secretary of State, whichever is the last to occur.
