C of the conn legi ative ody, Ci T r Village Clerk or V officer designated by ocal le islative bod jSea/_+- _ Date: 7h�:T� DOS-0239-f-I (Rev.06112) Page 4 of 4 TOWN OF ITHACA LOCAL LAW NO.9 OF THE YEAR 2019 A LOCAL LAW REMOVING ENGINEERING FUNCTIONS AND RESPONSIBILITIES FROM PUBLIC WORKS DEPARTMENT IN CHAPTER 59 OF THE TOWN OF ITHACA CODE Be it enacted by the Town Board of the Town of Ithaca as follows: Section 1. Chapter 59 (Public Works Department) of the Town of Ithaca Code, Section 59-3, titled"Transfer of Engineering Department Functions," is deleted and replaced by a new Section 59-3 reading as follows: "§ 59-3. Transfer of Engineering Functions. "All engineering functions are hereby transferred out of the Public Works Department." Section 2. Chapter 59 (Public Works Department) of the Town of Ithaca Code, Section 59-4, titled"Responsibilities," is revised by deleting the phrase "engineering and"before the phrase "highway functions" in the first sentence, so that Section 59-4 reads as follows: 159-4. Responsibilities. The Public Works Department's responsibilities shall include the Town's highway functions, along with responsibilities for the construction, improvement, repair, care, and maintenance of the Town's parks, trails, walkways, sidewalks, highways, bridges, sluices, waterways, culverts for drainage, water and sewer facilities, buildings, grounds and other Town facilities, and stormwater management. The Public Works Department shall have such other responsibilities, not inconsistent with law, as may be assigned by the Town Board." Section 3. In the event that any portion of this law is declared invalid by a court of competent jurisdiction, the validity of the remaining portions shall not be affected by such declaration of invalidity. Section 4. This local law shall take effect on January 1, 2020. Adopted 2019-10-21
