HomeMy WebLinkAboutLL 21 of 2009 Fees-Noise Ch 184.docTOWN OF ITHACA LOCAL LAW NO. 21 OF THE YEAR 2009 A LOCAL LAW AMENDING FEE PROVISIONS IN CHAPTER 184, TITLED "NOISE", OF THE TOWN OF ITHACA CODE TO PROVIDE FOR THE SETTING OF NOISE PERMIT APPLICATION FEES BY TOWN BOARD RESOLUTION Be it enacted by the Town Board of the Town of Ithaca as follows: Section 1. Chapter 184 (Noise), Article III (Permits) of the Town of Ithaca Code, Section 184-12, titled "Permit procedure; fee," is amended by deleting subsection C and replacing it with the following: "C. At the time of the filing of the permit application or applications, the applicant shall pay the Town a nonrefundable fee as set from time to time by Town Board resolution." Section 2. Chapter 184 (Noise), Article III (Permits) of the Town of Ithaca Code, Section 184-12, titled "Permit procedure; fee," is amended by adding the following new subsection D and relettering the current subsection D as subsection E: "D. Applications may be submitted simultaneously by a single entity, representative or agent thereof for events occurring at a single address within a consecutive six-month period. All applications shall be reviewed, and determinations shall be rendered, on an individual basis." Section 3. In the event that any portion of this law is declared invalid by a court of competent jurisdiction, the validity of the remaining portions shall not be affected by such declaration of invalidity. Section 4. This local law shall take effect on January 1, 2010.
