HomeMy WebLinkAboutLL 18 of 2009 Fees-Building Construction Ch 125.docTOWN OF ITHACA LOCAL LAW NO. 18 OF THE YEAR 2009 A LOCAL LAW AMENDING FEE PROVISIONS IN CHAPTER 125, TITLED "BUILDING CONSTRUCTION AND FIRE PREVENTION", OF THE TOWN OF ITHACA CODE TO PROVIDE FOR THE SETTING OF FEES BY TOWN BOARD RESOLUTION Be it enacted by the Town Board of the Town of Ithaca as follows: Section 1. Chapter 125 (Building Construction and Fire Prevention) of the Town of Ithaca Code, Section 125-4, titled "Building permits," is amended as follows: A. Subsection C(1)(i) is deleted and replaced with the following: "(i) The building permit fee as set from time to time by Town Board resolution." B. The second sentence in subsection H is deleted and replaced with the following: "H. The permit may, upon written request, be renewed for successive one-year periods provided that the permit has not been revoked or suspended at the time the application for renewal is made; the relevant information in the application is up-to-date; and a renewal fee is paid as set from time to time by Town Board resolution." Section 2. Chapter 125 (Building Construction and Fire Prevention) of the Town of Ithaca Code, Section 125-7, titled "Certificates of occupancy," is amended as follows: A. The first sentence of subsection A(3) is deleted and replaced with the following: "A(3) The fees for certificates of occupancy are set from time to time by Town Board resolution." B. Subsection B(11) is deleted and replaced with the following: "B(11) The fee for the issuance of a temporary certificate of occupancy shall be as set from time to time by Town Board resolution." C. Subsection C is deleted and replaced with the following: "C. A certificate of occupancy may be issued for any building or individual dwelling unit at any other time after inspection thereof 1 by request, determination of compliance and payment of the fees as set from time to time by Town Board resolution." Section 3. In the event that any portion of this law is declared invalid by a court of competent jurisdiction, the validity of the remaining portions shall not be affected by such declaration of invalidity. Section 4. This local law shall take effect on January 1, 2010. 2
