HomeMy WebLinkAboutLL 26 of 2009 Fees-Water Rates Ch 261.docTOWN OF ITHACA LOCAL LAW NO. 26 OF THE YEAR 2009 A LOCAL LAW AMENDING CHAPTER 261, TITLED "WATER RATES", OF THE TOWN OF ITHACA CODE TO PROVIDE FOR THE SETTING OF WATER RATES, RENTS, CHARGES AND FEES BY TOWN BOARD RESOLUTION Be it enacted by the Town Board of the Town of Ithaca as follows: Section 1. Chapter 261 (Water Rates) of the Town of Ithaca Code, Section 261-3, titled "Rates, rents and charges," is amended by deleting subsections A and B and replacing them with the following: "A. The Town Board shall set from time to time by resolution the schedule of water rates, rents or charges for the use of water and for the purposes hereinabove set forth. B. Notwithstanding the provisions of the schedule of water rates, rents or charges set by the Town Board, if there are existing contracts between a bulk user and the Town pursuant to which the Town, for other considerations, agreed to charge a water rate different than that required by the schedule, the Town may continue to honor such contracts at the rates therein prescribed or at such other rates as may be agreed to between the Town of Ithaca and the other contract party. Nothing in this subsection shall preclude the Town, if it deems it advisable, from charging said bulk user the rates that would otherwise be required by the schedule." Section 2. Chapter 261 (Water Rates) of the Town of Ithaca Code, Section 261-4, titled "Payment procedures," is amended by deleting the last sentence of subsection C and replacing it with the following: "In addition to any other charges due to the Commission or Town, there shall also be due to the Town a charge for disconnecting and a charge for reconnecting such water service. Such charges shall be set from time to time by Town Board resolution." Section 3. Chapter 261 (Water Rates) of the Town of Ithaca Code is amended by deleting the Schedule A Water Rate Schedule and the reference to "261 Attachment I" that appears immediately before Schedule A. Section 4. Local Law No. 15 of 2009, titled "A Local Law Amending Chapter 261 of the Town of Ithaca Code to Adopt a New Water Rate Schedule for Water Consumption in the Town" is hereby repealed in its entirety. Section 5. In the event that any portion of this law is declared invalid by a court of competent jurisdiction, the validity of the remaining portions shall not be affected by such declaration of invalidity. Section 6. This local law shall take effect on January 1, 2010. 2
