HomeMy WebLinkAbout2008-03-19 - BZA TOWN OF ULYSSES BOARD OF ZONING APPEALS 03/19/08 APPROVED 10/15/08 PRESENT : Chairman George Tselekis, BZA Members Barbara Bristow, Andy Glasner, Carl Mann, Gerald VanOrden Applicants : Lucille Poley Public : Elizabeth Burns, 24 Clinton Ave. , Cortland, NY-attorney for the Matson ' s, 1646 Trumansburg Road . Chairman George Tselekis called to order the meeting of the Town of Ulysses BZA. It is Wednesday, March 19, 2008 , 7 : 40pm . They are here to consider an application for an area variance from Ronald and Lucille Poley for an addition to their house to improve the bathroom and add a laundry room . The house is currently 5 ' 6" from the North property line and will be 4 ' 11 " from the line once the addition is built. Mrs . Poley said their architect designed the addition to square the house off and add on an upstairs laundry room so she would not have to go downstairs to do chores. It would also improve the bathroom . Mr. Tselekis asked if it would add any living spaces or bedrooms . Mrs . Poley stated it would not. Mrs. Elizabeth Burns stated she was here to speak for the Matson ' s who are neighbors of the Poley' s to the North. She said a farmer uses that part of their lot for access to is field and didn ' t want his access compromised. Also, she said the Matson ' s were feeling squeezed in by building on both sides, that they did not see why the addition couldn' t be done behind the house so as not to reduce the side setback, and that they opposed the project. Mrs . Poley stated that part of their property was just vacant brushland. Mr. Tselekis stated the addition makes architectural sense by squaring off the house, the encroachment on the property line would be minor, and access on the neighboring property would not be affected, and the Matson ' s house is far away from the property line in question. Mr. VanOrden asked if the house was previously in compliance . Mrs. Poley replied that it was built in 1940 before zoning . Mr. Mann made the MOTION, seconded by Mr. Glasner. Whereas, there will no undesirable change to the character of the neighborhood, Whereas, there is no detriment to nearby property confirmed by non receipt of correspondence received for requested variance, Whereas, the benefits sought by the applicant cannot be achieved by a feasible alternative method other than an area variance, and Whereas, the variation is not substantial in comparison to the previous requirements, Whereas, the variance requested will not have an adverse impact on the physical and environmental conditions in the neighborhood and the proposed change of 7 " is so small and insignificant that the variance should be approved. Whereas, the alleged difficulty was not self-created, Zoning Board of Appeals 2 03/ 19/2008 Be it therefore resolved that the Town of Ulysses Zoning Board of Appeals approve an area variance for Ronald and Lucille Poley, 1634 Trumansburg Road, Trumansburg, NY, Town of Ulysses, Tax Parcel 34-3- 14 to construct an addition to existing structure to improve bathroom and add laundry room. Reference to Zoning Law Guide 267-b, 3 (b) Chairman Tselekis called the vote : Ms. Bristow Aye Mr. Mann Aye Mr. Glasner Aye Mr. Tselekis Aye Mr. VanOrden Aye The variance was approved unanimously.
