PRESENT : Chairman Henry Aron , Edward W . King , Jack D . Hewett , Edward N . Austen , Andrew S . Frost ( Town Building Inspector / Zoning Enforcement ' Officer ) , John C . Barney ( Town Attorney ) , ALSO PRESENT : A . Thomas Kirsch , Yohko Tsuji Kirsch , Terry J . Fisk , Rosemary Fisk , Corinee Stern , Robert Stern , 11 Chairman Aron declared the meeting duly opened at 7 : 00 p . m . , and accepted for the record the Clerk ' s Affidavit of Posting and Publication of the Notice of Public Hearings in Town Hall and the Ithaca Journal on July 21 , 1987 , and July 24 , 1987 , respectively , together with the Clerk ' s Affidavit of Service by Mail of said Notice upon the various neighbors of each of the properties under discussion , upon both the Clerk and the Building Commissioner of the City of Ithaca , upon the Tompkins County Commissioner . of Planning , and upon each of the appellants and / or agent , as appropriate , on July 22 , 1987 . 11 • Chairman Aron noted that a quorum was present . APPEAL OF A . THOMAS KIRSCH , APPELLANT , FROM THE DECISION OF THE BUILDING INSPECTOR / ZONING ENFORCEMENT OFFICER DENYING A BUILDING PERMIT FOR THE RENOVATION AND GLASSING - IN OF AN EXISTING PORCH AT 202 WINSTON DRIVE , TOWN OF ITHACA TAX PARCEL NO . 6 - 70 - 3 - 4 , RESIDENCE DISTRICT R- 151 SAID EXISTING PORCH PRESENTLY LOCATED APPROXIMATELY 9 . 5 FEET FROM THE NORTHERLY SIDE YARD LOT LINE . PERMIT IS DENIED UNDER ARTICLE IV , SECTION 14 , 10F THE TOWN OF ITHACA ZONING ORDINANCE , WHICH REQUIRES A SIDE YARD WIDTH OF 15 FEET , Chairman Aron declared the Public Hearing in the above - noted matter duly opened and read aloud from the Notice of Public Hearings as posted and published and as noted above . Mr . and Mrs . Kirsch were present . Chairman Aron invited Mr . Kirsch to appear before the Board . Chairman Aron read ,, aloud from the Appeal Form as signed and submitted by A . Thomas Kirsch under date of June 9 , 1987 , as follows : " . . . Having been denied permission to renovate and glass - in existing rear porch at residence , 11202 Winston Drive . . . it would be a hardship to leave porch as is and an unnecessary expense to take it down . Present porch makes heating home ' in winter expensive and difficult , especially in very cold weather with strong north or northwesterly winds . Ice builds up inside the house on sliding patio door between house and porch . Glassed in porch , would increase heating efficiency and lower • costs of heating significanly by providing a barrier between house and wind at this point . " I Zoning Board of Appeals - 2 - Jul 29 1987 PP y , • Chairman Aron read aloud a letter attached to the Appeal Form from Luke and Greta Colavito , 204 Winston Drive , to Mr . Frost , Zoning Officer , dated June , 1987 , as follows : " Our Neighbors at 202 Winston Drive , Mr . and Mrs . A . Thomas Kirsch , have informed us of their plan to renovate the existing screen porch on their property , to enclose it with glass panels , sliding or patio doors and framing , while retaining the existing roof and same square footage . Our house located at 204 Winston Drive is the one that most closely borders 202 Winston Drive and the planned renovation . The Kirsch ' s have shown us the plans for the glassed in porch and we feel that the renovatin will not only enhance the property at 202 Winston Drive but will also have a beneficial effect on property values in the neighborhood . Under the circumstances we have no objections to the proposed renovation and would be happy to verify that whenever appropriate . " At this point the Board members reviewed Mr . Kirsch ' s application for building permit dated June 3 , 1987 . ( Exhibit # 1 ) Mr . Frost presented two colored photographs of the porch under discussion which he had , taken on July 29th and which showed the view facing west from Winston Drive ( the rear of the house ) . There were also , for the record , three colored photographs of the porch , dated May 30 , 1987 , as submitted by Mr . Kirsch , one showing the view from the west side of the porch , one taken from the west side of the porch toward the fence on the property line with the neighbor at 204 Winston Drive , and one taken from the east side of the porch . • Mr . King asked Mr . Kirsch how long the porch had been in existence , with Mr . Kirsch responding that he purchased the house directly from the previous owner in 1971 and the porch existed at that time and had been in existence since 1969 . Mr . Kirsch stated that when he applied for the building permit he was notified that the existing porch was presently located approximately 9 . 5 feet from the side yard lot line . Chairman Aron noted that this was a Public Hearing and asked if there were anyone present who wished to speak for or against the matter before the Board . No one spoke . Chairman Aron closed the Public Hearing , Mr . King , referring to the sketch plan submitted with the Appeal ( Exhibit # 2 ) , noted that the porch was on the north side of the house , with the front facing Winston Drive to the east . Mr . King also noted that the porch was 14 ' wide and 101 deep . Mr . Hewett inquired as to the type of construction , with Mr . Kirsch answering that the porch is a frame structure on a concrete slab . Mr . Kirsch pointed out that there is a six - foot high fence between the Kirsch property and the neighbor . Mr . Kirsch stated that there will be no change in the dimensions of the porch . MOTION by Mr . Edward King , seconded by Mr . Jack Hewett : • WHEREAS , in the matter of the Appeal of A . Thomas Kirsch for side yard variance , the Town of Ithaca Zoning Board of Appeals finds no Zoning Board of Appealsh July 29 , 1987 • apparent significant impact upon any neighboring property , and WHEREAS , a letter ; , of approval was received from the Kirsches ' immediate neighbors , Luke and Greta Colavito , stating that they have no objections to the proposed renovations , and WHEREAS , no one appeared or submitted statements in opposition to this proposal , and WHEREAS , the subject porch has been in existence since 1969 , and WHEREAS , the present owner purchased the home directly from the former owner in 1971 Wand not through a realtor , therefore being unaware that the porch was too close to the northerly side yard lot line , NOW , THEREFORE , BE IT RESOLVED , that the Town of Ithaca Zoning Board of Appeals grant `and hereby does grant an area variance of 5 . 5 feet from the 15 - foot requirement of Section 14 of the Town of Ithaca Zoning Ordinance , permitting the subject porch to remain in place 9 . 5 feet from the northerly' side lot line , and permitting the renovations as requested . There being no further discussion , the Chair called for a vote . Aye - Aron , King , Hewett , Austen . • Nay - None . The MOTION was declared to be carried unanimously . Chairman Aron declared the matter of the A . Thomas Kirsch Appeal duly closed . APPEAL OF TERRY J . FISK , APPELLANT , FROM THE DECISION OF THE BUILDING INSPECTOR / ZONING ENFORCEMENT OFFICER DENYING PERMISSION TO CONSTRUCT AN APARTMENT ABOVE . AN EXISTING DETACHED . GARAGE LOCATED AT 109 WOOLF LANE , TOWN OF ITHACA TAX PARCEL N0 . 6 - 23 - 1 - 20 . 11 RESIDENCE DISTRICT R- 30 . PERMISSION IS DENIED UNDER ARTICLE V , SECTIONS 18 AND 21 , OF THE TOWN OF ITHACA ZONING ORDINANCE , WHEREBY NO MORE THAN ONE DWELLING UNIT IS PERMITTED ON A LOT AND WHERE A SIDE YARD WIDTH OF 40 FEET AND A REAR YARD DEPTH OF 5, 0 FEET ARE REQUIRED . THE EXISTING DETACHED GARAGE IS LOCATED APPROXIMATELY 20 FEET FROM THE SIDE YARD LOT LINE AND APPROXIMATELY 38 FEET FROM THE REAR LOT LINE , Chairman Aron stated , for the record , that he was withdrawing from any and all participation in any discussions or motions with respect to the Fisk Appeal because , as a neighbor , he felt he might not be able to be totally objective . Vice Chairman Austen took over the Chair . Vice Chairman Austen declared the Public Hearing in the • above - noted matter duly , opened and read aloud from the Notice of Public Hearings as posted and published and as noted above . Mr . and Mrs . Fisk were present . Zoning Board of Appeals', - 4 - July 29 , 1987 • Vice Chairman Austen read aloud from the Appeal Form as signed ned g and submitted by Terry ';i� Fisk under,. date of May 27 , 1987 , as follows : " . . . Having been denied " permission to construct an apartment over back garage , rather than in" my home at 109 Woolf Lane . . . The unnecessary hardships would exist j, if the apartment were built within my home , because of the followi''ng reasons : our in - laws frequently visit and need a place to stay ; I', would like to maintain the privacy of my home ; and it would be cheaper to build the apartment above the garage , rather than renovatingi,the house . " Vice Chairman Austen invited Mr . Fisk to appear before the Board . 11 Mr . Hewett asked i' f the proposed addition above the garage was on the southerly side of ! the building , with Mr . Fisk responding , yes . Mr . Hewett wondered about the size of the proposed structure which appeared to be 24 ' x 241 , depicted on the sketch plan and drawings submitted as abutting ', the 24 ' x 30 ' existing garage . ( Exhibit # 3 ) Mr . Hewett asked Mr . Fisk if this would be a rental unit or a place to stay for his in - laws when they came for a visit . Mr . Fisk responded that the unit would be rented to a single person or , perhaps , two persons . Mr . Fisk stated that his in - laws are retired and they come quite often for a visit' . Mr . Hewett wondered if by renting this unit it would impede Mr . Fisk ' s in - laws visiting , with Mr . Fisk responding that his in- laws could 'i stay at his home . Mr . Fisk stated that the garage is located 70 t6! . 80 feet from the house . a Mr . Frost , noting ;that the subject parcel is located in Residence District R- 30 , stated that if an apartment were allowed in a separate building it would be considered another residence on a lot and a side yard width of 40 feet and a rear yard depth of 50 feet are required . For the record , Mr . Frost had prepared for submission five colored photographs of the subject property showing the view facing north to the back of the house ( from garage addition ) and showing the subject garage ; the view facing 'l, ; south at house to front of detached garage and ° showing the subject garage and a different garage attached to the house , view showing the, front of the house facing south ; view facing east to side of detached garage addition ; view facing south . Mr . King noted that there was a dual problem involved in this matter , being two residences on one lot and yard deficiencies if the detached garage were made into an apartment . Noting that this was a Public Hearing , Vice Chairman Austen asked if anyone present wished to speak for or against the matter of the Fisk Appeal . No one spoke . Vice Chairman Austen closed the Public Hearing , p, MOTION by Mr . Edward King , seconded by Mr . Jack Hewett : WHEREAS , in the matter of the Terry J . Fisk Appeal for variance of the requirements of Sections 18 and 21 of the Town of Ithaca Zoning Ordinance , the Town of Ithaca Zoning Board of Appeals finds no apparent hardship compelling the grant of such variances , and Zoning Board of Appeals' - 5 - July 29 , 1987 • WHEREAS , two residential dwellings are not permitted on one lot without subdivision ofltsuch lot ; NOW , THEREFORE , BE IT RESOLVED , that said Board of Appeals deny 11 and hereby does deny the Appeal of Terry J . Chairman Aron resumed his place as Chairman . 110 APPEAL OF ROBERT STERN, APPELLANT , FROM THE DECISION OF THE BUILDING INSPECTOR / ZONING ENFORCEMENT OFFICER DENYING A BUILDING PERMIT FOR THE CONSTRUCTION OF A WOOD ' DECK APPROXIMATELY 2 FEET FROM A SIDE YARD LOT LINE AT 1542 SLATERVILLE ROAD , TOWN OF ITHACA TAX PARCEL NO , 6 - 56 - 3 - 11 , RESIDENCE DISTRICT R- 15 . PERMIT IS DENIED UNDER ARTICLE IV , SECTION 14 , OF THE TOWN OF ITHACA ZONING ORDINANCE , WHEREBY A STRUCTURE OTHER THAN AN ACCESSORY BUILDING MUST BE 15 FEET FROM THE • SIDE YARD LOT LINE . Chairman _ Aron declared the Public Hearing in the above noted matter duly opened and8 ' read aloud from the Notice of Public Hearings as posted and published and as noted above . Mr . and Mrs . Stern were present . Chairman Aron re Id aloud from the Appeal Form as signed and submitted by Robert Stern under date of July 17 , 1987 , as follows : itHaving been denied ';permission to build an outside pressure treated wood deck , approximately 2 feet from a side property line . . . ' ) Area becomes very muddy because it is shaded and nothing will grow there . Result is mess in the house from mud . 2 ) There is very little side yard room outside the ',door for * family use . This is the entrance we use for all activities' . 3 ) Husband is visually impaired and muddy area is dangerous for hlime " Chairman Aron read aloud from a letter addressed to Mr . Frost signed by Harry A . Hafler and Mary G . Hafler , 1540 Slaterville Road , dated July 27 , 1987 , as follows : " . . . Be advised that , as owners of the adjacent property , we do not object to construction of a wood deck as proposed , qIt is our understanding this deck is for recreational purposes not to beconnected to the house and its use and / or maintenance will not involve any liability to our property . 9[We do request that a copy of this statement together with the written • decision of the Board be sent to us for our records . " Chairman Aron noted that the Board had before it a copy of Mr . Zoning Board of Appeals! - 6 - July 29 , 1987 • Stern ' s application for building permit and a portion of a Carl Crandall Survey dated October 20 , 1941 . ( Exhibit # 4 ) Chairman Aron invited Mr . Stern to appear before the Board . Chairman Aron asked Mr . Stern if the construction of the wood deck would be for recreational purposes , with Mr . Stern responding , yes , adding that it would be used for the family to sit outside for a picnic , etc . Mr . Stern , commenting that the area is quite muddy most of the time , stated that he was visually impaired and the muddy area is dangerous . Chairman Aron wondered if Mr . Stern had been declared legally blind , with Mr . Stern responding , no , adding that he had cataracts but was responding well to laser treatment . Mr . Hewett asked how high the proposed patio would be . Mr . Stern stated that it will be „ four inches off the ground and 3 ' 8 ” high . For the record , Mr . Frost had prepared three colored photographs of the proposed patio area adjacent to the Stern house , one showing the view facing north ( west side of the house ) , and two from different angles showing the property line delineated by large trees ( west side of the house ) . Mr . Hewett commented that because of the nature of the existing adjacent homes , he felt there would not be a problem constructing a 13 - foot by 18 - foot patio . Chairman Aron noted that this was a Public Hearing and asked if there were anyone present who wished to speak for or against the Stern Appeal . No one spoke .„ Chairman Aron closed the Public Hearing . RESOLVED , that in '' the matter of the Appeal of Robert t Stern for a side yard variance of thirteen feet from the 15 - foot side yard requirement of Section , 14 of the Town of Ithaca Zoning Ordinance , the Town of Ithaca Zoning„ Board of Appeals find and hereby does find the following as facts : 1 . The proposed use ` and the location and design of the proposed structure is consistent with the character of the district in which it is located ; 2 . The proposed use will not be detrimental to the general amenity or neighborhood character in amounts sufficient to devaluate neighboring property or seriously inconvenience neighboring inhabitants ; 3 . The proposed access and egress for the proposed structure and use are safely designed ; 4 . No one from the surrounding properties appeared in opposition to the subject Appeal and , indeed , a letter was received from Harry and Mary Hafler , ` the next -door neighbor , in support of the Appeals AND , FURTHER RESOLVED , that said Board of Appeals , based on its • findings , grant and hereby does grant an area variance of 13 feet to permit the construction of a 13 - foot by 18 - foot patio , four inches above - ground , two feet from the west side lot line of Parcel No . Zoning Board of Appeals° - 7 - July 29 , 1987 • 6 - 56 - 3 - 11 , with a copy of the decision of the Board to be sent to Mr . and Mrs . Hafler , 1540 Slaterville Road . The renovation will retain `the roof and ' square footage of the existing porch . -The porch also remainsunheated . None of the planned renovations will involve any significant changes in plumbing , electrical wiring , heating system, sewer or water lines , culverts or other elements . -The- -work involved is estimated to co8t between $4 , 000- $5, 000 . ley wife and I are presently getting estimates from several local building contractors for the proposed renovation , but at this time we do not have a ' firm agreement with any particular builder . We realize there _may - be questions about the existing porch ' s compliance with zoning regulations . According to our measurements , the porch is approxLmately _ni.ne__ana one half feet from the property line with our neighbors, Mr . & Mrs . Colavito , at 201 Winston Drive . The screened porch was added to 202 Winston Drive in 1969 by the then owners , Air . & Mrs . James- Gross ; it existed when I purchased the property in summer 1971 .
