HomeMy WebLinkAboutPB Minutes 1993-10-051 .1 FINAL TOWN OF ITHACA PLANNING BOARD OCTOBER 5, 1993 FIILEia IFOWN OF ITHACA Date The Town of Ithaca Planning Board met in regular session on Tuesday, October 5, 1993, in Town Hall, 126 East Seneca Street, Ithaca, New York, at 7:30 p.m. PRESENT: Chairperson Carolyn Grigorov, Robert Kenerson, Virginia Langhans, James Ainslie, Herbert Finch, Candace Cornell, Stephen Smith, Floyd Forman (Town Planner), George Frantz (Ass't. Town Planner), Daniel Walker (Town Engineer), John Barney (Town Attorney). ALSO PRESENT: Peter Grigorov. Chairperson Grigorov declared the meeting duly opened at 7:38 p.m. and accepted for the record the Clerk's Affidavit of Posting and Publication of the Notice of Public Hearings in the Town Hall and the Ithaca Journal on September 27, 1993 and September 30, 1993, respectively, together with the Secretary's Affidavit of Service by Mail of said Notice upon the various neighbors of each of the properties under discussion, as appropriate, upon the Clerk of the Town of Ithaca, upon the Tompkins County Commissioner of Planning, upon the Tompkins County Commissioner of Public Works, and upon the applicants and/or agents, as appropriate, on September 30, 1993. Chairperson Grigorov read the Fire Exit Regulations to those assembled, as required by the New York State Department of State, Office of Fire Prevention and Control. AGENDA ITEM: PERSONS TO BE HEARD. There were no persons present to be heard. Chairperson Grigorov closed this segment of the meeting. PUBLIC HEARING: CONSIDERATION OF FINAL SUBDIVISION APPROVAL FOR THE PROPOSED SUBDIVISION OF TOWN OF ITHACA TAX PARCEL NO. 51-1-3.1, 23.7+/- ACRES TOTAL, INTO TWO PARCELS, 4.4+/- AND 19.3+/- ACRES IN SIZE, SAID SUBDIVISION HAVING RECEIVED PRELIMINARY SUBDIVISION APPROVAL FROM THE PLANNING BOARD ON JUNE 7, 1988 AND IS LOCATED AT 611 CODDINGTON ROAD, RESIDENCE DISTRICT R-30. PETER GRIGOROV, OWNER/APPLICANT. Chairperson Grigorov withdrew from the discussion of this agenda item due to a conflict of interest as she is family to the applicant. Vice Chairman Robert Kenerson declared the Public Hearing in the above -noted matter duly opened at 7:39 p.m. and read aloud from the Notice of Public Hearings as posted and published and as noted above. Peter Grigorov addressed the Board and stated the his reason for coming to the Planning Board was to receive Final Approval of the site and stated that the reason that it had taken them five Planning Board 2 October 5, 1993 years to ask for Final Approval is because they assumed that it had been done in 1988. There being no further discussion Vice Chairman Kenerson closed the Public Hearing and brought it back to the Board for discussion. Board Member Candace Cornell asked Mr. Grigorov if he had intentions of building on this lot in the future. Mr. Grigorov responded that he did not have any plans at this time. Vice chairman Kenerson asked if any variances would be needed for any of the adjacent lots. Assistant Town Planner- George Frantz stated that no variance would be required. There being no further discussion, Vice Chairman asked if anyone were prepared to offer a motion. MOTION by Virginia Langhans, seconded by Herbert Finch: WHEREAS: 1. This action is the Consideration of Final. Subdivision Approval for the proposed subdivision of Town of Ithaca Tax Parcel No. 51-1-3.1, 23.7 +/- acres total, into two parcels, 4.4 +/- and 19.3 +/- acres in size, said subdivision having received Preliminary Subdivision Approval from the Planning Board on June 7, 1988 and is located at 611 Coddington Road, Residence District R-30. Peter and Sarah Grigorov, Owners/ Applicants, and 2. This is an Unlisted Action for which the Town of Ithaca Planning Board, acting as Lead Agency in environmental review, did at a Public Hearing held on June 7, 1988, make a negative determination of significance, and 3. This is an action for which the Planning Board, at a Public Hearing held on June 7, 1988, did grant Preliminary Subdivision Approval. NOW, THEREFORE, BE I:T RESOLVED: 1. That the Town of Ithaca Planning Board hereby waives certain requirements for Final Subdivision Approval, as shown on the Final Subdivision Checklist, having determined from the materials presented that such waiver will result in neither a significant alteration of the purpose of subdivision control nor the policies enunciated or implied by the Town Board. 2. That the Planning Board hereby grants Final Subdivision Approval for the proposed subdivision of Town of Ithaca Tax Planning Board 3 October 5, 1993 Parcel No. 51-1-3.1, 23.7 +/- acres total, into two parcels, 4.4 +/- and 19.3 +/- acres in size, located at 611 Coddington Road, Residence District R-30, as shown on the subdivision plat entitled "Proposed Grandmother Subdivision, Located on Coddington Road., Mil. Lot 97, Town of Ithaca, Tompkins County, New York" prepared by T.G. Miller Associates, P.C., dated April 19, 1988 and amended April 19, 1993, and September 10, 1.993. Aye - Kenerson, Langhans, Ainslie, Finch, Cornell, Smith. Nay - None. Abstain - Grigorov. The MOTION was declared to be carried unanimously. AGENDA ITEM: REPORT OF TOWN PLANNER. Town Planner Floyd Forman stated that GEIS is scheduled for the October 19, 1.993 Planning Board meeting agenda. All neighborhood groups, Natalie Emlen, Lynn Leopold, Phyllis Baker and anyone who has expressed an interest in the DGEIS. Mr. Forman stated that Ithacare will be coming before the Board with a request for rezoning. Mr. Forman stated that Ithacare had discussed the possibilities of an R-9, an R-30, and a SLUD with the Town briefly. However, there has been nothing definite determined at this point, it is still very vague. Chairperson Grigorov asked if it could be zoned as an institution. Board Member Stephen Smith asked why Ithacare wanted to move. Town Planner Floyd Forman stated that it was because of the size, the type of facility, and the convenience of working with Ithaca College as well. Ithacare will be coming to the Planning Board for the recommendation for rezoning, the site plan, subdivision approval and special approval for the use, and Ithacare is on the agenda for November 2, 1993. AGENDA ITEM: OTHER BUSINESS. Town Planner Floyd Forman stated that for the convenience of the planning staff he would like his name to appear at the bottom of the Public Hearing Notice. Mr. Forman then asked the Board to make the decision of whether or not to have the Town Planner's name to appear on the Public Hearing Notice. There being no further discussion, the Chair asked if anyone were prepared to make a motion. MOTION by Stephen Smith, seconded by Herbert Finch: WHEREAS, Town Planner presently develops the Public Hearing Notice and forwards said Notice to the Ithaca Journal, and Planning Board 4 October 5, 1993 WHEREAS, there is no legal impediment to the Town Planner being the person designated by the Planning Board to ensure the publication of the Notice of Public Hearing, THEREFORE, BE IT RESOLVED; that the Town Planner shall be the person designated by the Planning Board to ensure the publication of the Notice of Public Hearing and shall be the person whose name shall appear on the Notice of Public Hearing. There being no further discussion, the Chair called for a vote. Aye - Grigorov, Kenerson, Langhans, Ainslie, Finch, Smith, Cornell. Nay - None. The MOTION was declared to be carried unanimously. There being no further discussion, the Chair closed this portion of the meeting. The next item the Mr. Forman wanted to discuss was a modification to the SEQR Resolution for the Comprehensive Plan. Mr. Forman stated that Item #2 listed in the Resolution that the Planning Board adopted on September 21, 1993 needed to be updated to read more accurately of the process involved with the Comprehensive Plan. There being no further discussion, the Chair asked if anyone were prepared to offer a motion. MOTION by Herbert Finch, seconded by James Ainslie: BE IT RESOLVED; that the Planning Board modifies the adopted SEQR Resolution for the 'Town of Ithaca Comprehensive Plan, which was adopted on September 21, 1993, by changing item #2, as shown below. 2. The ,Town of Ithaca Comprehensive Plan has undergone an extensive review process that has been coordinated with adjacent municipalities, Tompkins County Planning, City of Ithaca, Inter -municipal Sewer and Water Authorities, the New York Department: of Transportation and the residents of the Town of Ithaca, New York. Modified to read as follows: 2. The Town of Ithaca Comprehensive Plan has undergone an extensive review process that included soliciting comments from the Tompkins County Planning Department, the City of Ithaca, and residents of the Town of Ithaca, New York. There being no further discussion, the Chair called for a vote. Aye - Grigorov, Kenerson, Langhans, Ainslie, Finch, Smith, Cornell. Nay - None. Planning Board 5 October 5, 1993 The MOTION was declared to be carried unanimously. There being no further discussion, the Chair closed this portion of the meeting. ADJOURNMENT Upon Motion, Chairperson Grigorov declared the October 5, 1993 meeting of the Town of Ithaca Planning Board duly adjourned.
