RESOLUTION #161 (2022) – APPROVE MINUTES Supv Leifer offered the following resolution and asked for its adoption: RESOLVED, that this Town Board hereby approves the meeting minutes of September 8 and September 15, 2022. 2nd Cl Sparling Roll Call Vote Cl Sparling Yes Cl Vargas-Mendez Yes Cl Skaley Yes Cl Lamb Yes Supv Leifer Yes 1892 Slaterville Road 1892 Slaterville Road burned down and it is now up to the owner to remedy this problem. The board presented an agreement draft (attached) that was discussed. The owner stated several times that he did not believe he is being given enough time to clean up the debris. The offer is open until December 8th, 2022. He has until then to decide if he wants to sign the agreement. The public hearing was closed at 6:48 PM. Highway Department R Young said they had another air test performed on the building and the results will be presented at a Town Board meeting. The road work has continued. R Young needs to dispose of the old radios. He would like to put all 26 out for a bid. 1993 international dump truck with plow equipment and a 2008 John Deere will be put on Auctions International. The 2008 Ford 450 old sign truck has a blown-up motor so he wants to see what he can get for the body of the TB 10/20/2022 Page 2 of 6 truck. He also has an old concrete fuel storage tank and a plastic calcium storage tank that will be put up on Auctions International. The town will receive a $200,000 insurance payment for the truck that burned up. Eventually he will need more money to replace a truck because they are going for about $260,000 right now. County Water Resources Council is hosting a workshop on stream mechanics diagnostics and corrections for municipal highway staff. R Young will try to send someone. Varna Sewer J Skaley asked when DOT will complete the paving project on 366. R Young does not know, but said they should be done soon. Planning Update R Burger went to the American Planning Association conference combined with the American Landscape Association in Buffalo. R Burger did a presentation on the Comp Plan update addressing climate change and affordable housing. It got a lot of good reception so he is hopeful he will have better luck this winter recruiting a Planning Board member. Attached is a Planning update sent via email. Union Contract The union approved the tentative agreement that was discussed previously. It is the Town Board’s time to adopt it. RESOLUTION #162 (2022) – AUTHORIZE CONTRACT FOR UNION EMPLOYEES Supv Leifer offered the following resolution and asked for its adoption: WHEREAS, the Labor Agreement between Teamsters Local 317 and the Town of Dryden has been approved, and WHEREAS, the Town Board hereby authorizes the Town Supervisor to sign the contract on behalf of the Town. RESOLVED, that the Town Board hereby authorizes the contract for current Union employees, the wage scale in the Labor Agreement begins on January 1, 2023 and ends on 12/31/26. 2nd Cl Vargas-Mendez Roll Call Vote Cl Sparling Yes Cl Vargas-Mendez Yes Cl Skaley Yes Cl Lamb Yes Supv Leifer Yes RESOLUTION #163 (2022) – AUTHORIZE SALE OR TRADE OF EQUIPMENT Supv Leifer offered the following resolution and asked for its adoption: RESOLVED, that the Highway Superintendent is hereby authorized to sell or trade -in the following equipment with the proceeds being returned to the equipment budget line (DA-5130.2): TB 10/20/2022 Page 3 of 6 • 26 Mobile Radios (Kenwoods/Vertek Standard) • 1993 International Dump Truck with Plow (ID #1HTGMPCR6PH496071) • 2008 John Dear UTV 6x4 • 2008 Ford F-450 (Old Sign Truck) (ID #1FDXF46Y58EA35970) • Concrete Fuel Storage Tank • Plastic Calcium Storage Tank 2nd Cl Lamb Roll Call Vote Cl Sparling Yes Cl Vargas-Mendez Yes Cl Skaley Yes Cl Lamb Yes Supv Leifer Yes RESOLUTION #164 (2022) - AUTHORIZATION TO DISBURSE TOWN FUNDS TO THE COMMUNITY HOUSING DEVELOPMENT FUND FOR SECOND WIND COTTAGES, INC., DRYDEN HOUSE PROJECT Supv Leifer offered the following resolution and asked for its adoption: WHEREAS, the Dryden Town Board through Resolutions No. 162 (2019) and No. 47 (2022) authorized funding for the Community Housing Development Fund (CHDF), which provides grant awards to support the construction and rehabilitation of permanently affordable housing units for low- to moderate-income households, and WHEREAS, the CHDF assists with the development costs associated with residential and mixed-use real estate development projects primarily benefiting low- and moderate-income households, and requires that newly constructed or rehabilitated homes supported by the program are not only made available to low- to moderate-income households, but also remain affordable to future generations of renters and buyers, and WHEREAS, the Notice of Funding Availability was made available to interested parties with a deadline of September 23, 2020, for Round 21, and WHEREAS, Second Wind Cottages, Inc., (Second Wind) applied for funding through Round 21 of the CHDF for a four-unit permanent supportive housing apartment building for households experiencing homelessness, located in the Village of Dryden, and WHEREAS, the Program Oversight Committee accepted and recommended that the proposal receive funding as indicated in the table Applicant Project Location Number of Affordable Units Dollar Amount Recommended Sponsors Second Dryden Village of A four-unit apartment building $120,000 Tompkins Wind House Dryden for households experiencing County Cottages, homelessness and affordable ($70,000); Inc. to households with incomes at Town of or below 80% of AMI Dryden ($50,000) RESOLVED, that the Town of Dryden authorizes the expenditure of $50,000 of the General (A) Fund, Fund Balance to support the Second Wind Dryden House project as recommended by the CHDF Program Oversight Committee, RESOLVED, further, that the Town Supervisor is authorized to execute agreements in order to affect this grant program consistent with this resolution. 2nd Cl Vargas-Mendez TB 10/20/2022 Page 4 of 6 Roll Call Vote Cl Sparling Yes Cl Vargas-Mendez Yes Cl Skaley Yes Cl Lamb Yes Supv Leifer Yes Stop Sign at intersection of Sheldon Road and Wood Road Residents who live on or near the corners of Sheldon Road and Wood Road sign ed a petition (attached) for the Town of Dryden to install a stop sign. This sign would be placed on the northbound corner of the intersection. Due to a dip in the road, cars traveling north are not seen until the last minute. This seems to also be a speed problem even though the speed limit is 35mph. Supv Leifer said that it may be possible for the sheriff to put a speed sign up and suggested adding a yield sign instead of a stop sign. R Young was asked if he would need Town Board or County approval to put a stop sign at the intersection of Sheldon Road and Wood Road. He responded that he does not need approval, but he respects the Town Board’s input. He is going to consult with sheriff’s office and get back to the board. Water Main Cleaning Dondi Harner of T.G. Miller was present and discussed the plans moving forward. They are looking at televising the existing pipe to understand the condition and whether or not to line the entire pipe, pressure grout the joints, or potentially replace the whole pipe. There is a manhole inspection with that as well. There’s a county bid that was prepared by Ontario County. Other municipalities have piggy backed off that bid and the bid is good until November 2022. They have extended it for another year with the 2021 pricing . They looked at the 10,000 feet of asbestos pipe that Varna has now and gave up a quote based on the original bid numbers. It is a unit price cost. After the inspection they will have a report and identify what the best technique would be moving forward to tighten up the system. They will provide some recommendations to the town which could then roll into the next phase for the repairs of the sewers. RESOLUTION #165 (2022)- AUTHORIZE TOWN SUPERVISOR TO SIGN AGREEMENT FOR WATER MAIN CLEANING Supv Leifer offered the following resolution and asked for its adoption: RESOLVED, that the Town Board hereby authorizes J Leifer to sign the contract on behalf of the town. 2nd Cl Lamb Roll Call Vote Cl Sparling Yes Cl Vargas-Mendez Yes Cl Skaley Yes Cl Lamb Yes Supv Leifer Yes Planning Department TB 10/20/2022 Page 5 of 6 The Planning Department is requesting funds to purchase a 2012 hybrid vehicle. The Climate Smart Community Task Force designated $9,000 of their Clean Energy Grant to purchase an electric vehicle. By purchasing this vehicle, the Town will gain 300 clean energy community points towards their goal of a $70,000 grant. RESOLUTION #166 (2022)- AUTHORIZING THE PLANNING DEPARTMENT TO PURCHASE AN ELECTRIC VEHICLE Supv Leifer offered the following resolution and asked for its adoption: Whereas the Planning Department included $35,000 in the 2022 budget (B3620.405) for the purpose of replacing the 2012 hybrid vehicle used by Code Enforcement Officers, and Whereas, the Climate Smart Community designated $9000 of two $5000 Clean Energy grants towards the purchase of an electric vehicle (EV) to replace the Code Enforcement vehicle, and Whereas, the purchase of an EV gains 300 Clean Energy Community points towards a $70,000 competitive grant, and Whereas, the supply of all-electric and plug-in hybrid vehicles is so limited that the prices have risen and a suitable vehicle has not been found at the current budgeted amount, and Whereas, the Town has been told that if an appropriate vehicle is found, it will be necessary to act quickly due to the high demand, and Whereas, the Planning Department did not spend budgeted funds for hiring a planner In 2022, so $14,000 of these funds (B3620.107) can be used towards current prices in the EV market, Be it resolved, that the Dryden Town Board authorizes the Planning Department to purchase an all-electric or plug-in hybrid vehicle that meets NYSERDA grant standards and Code Enforcement Officer needs, at a cost not to exceed $49,000. 2nd CL Sparling Roll Call Vote Cl Sparling Yes Cl Vargas-Mendez Yes Cl Skaley Yes Cl Lamb Yes Supv Leifer Yes Advisory Board Updates Ag Committee- Cancelled Planning Board- The Planning Board was asked to provide guidance to R Burger and the ZBA regarding the 1729 Slaterville Road variance for lot subdivision and flag lot. The suggested plan has the blessing of the Planning Board with certain conditions. The Conservation Board did take it up at their meeting and had strong reservations on the subdivision but would agree if the subdivision were sectioned off into a smaller parcel and stormwater retention structures were implemented along the driveway. That resolution passed unanimously. TB 10/20/2022 Page 6 of 6 1285 Dryden Road sketch plan was reviewed for the plantation restaurant rebuild. The Planning Board waived a formal site plan review. The resolution was approved for 1922 Dryden Road site plan review for shed sales. They are accepting the sketch plan as formal site plan with the condition of no onsite retail sales be made. RMS Gravel is closing today due to the owner passing away. Cleanup were part of the SUP. The owner’s wish was the business doesn’t get sold to a large company so the daughter is granting his wish. Conservation Board- OLWMC gave a presentation. ZBA- Granted the variance for 1729 Slaterville Road and 25 Catherine Drive. Climate Smart- They discussed the audit of the DPW office building. Dryden High School Sustainability Club is willing to collaborate with the climate smart committee in terms of certain events and to talk to other high school clubs. The school finally officially got the EV charging station. Rail Trail Task Force- The Rail Trail gave an update on the Game Farm Road crossing. They also discussed how to layout the trail between Kirk Road and Thompson Road near Etna. Broadband Committee- Knickerbocker and another business were spliced in November 1st for the Pilot area. The marketing should have started already. November 1 st is the anticipated start date of the final part of the backbone going through the Village of Dryden through the alternate route. Ken and Nate are talking about how to address the other easements within the village where we have to get a couple property owners to agree in these easements. It looks like in the summer the Village of Dryden will be able to start hooking people up there. Prior to that it is potentially the Village of Freeville and the Etna area will be first. Fire Coordinator Position Supv Leifer finished interviews for the fire coordinator position and that will be talked about at the public hearing for the budget to present to the whole board for a recommendation. That will be approved no later than the agenda meeting in November. At 7:46 PM the Town Board moved into executive session to discuss the employment history of particular individuals. No action was taken, and the meeting was adjourned at 10:00 PM. I grant, freely and without coercion, the right of access and entry to said property to the Town of Dryden, and each of its officials, employees, volunteers, agencies, agents, contractors, and subcontractors, for the purpose of inspecting my compliance with the plan listed below at any time, and for securing and demolishing the building or structure on the above-described property, in the event that the Town of Dryden determines that I have not complied with the plan of demolition and remediation agreed to between me and the Town of Dryden, as presented in attachment “A” and more specifically set forth herein. I understand that in such event, the Town of Dryden will charge back to me the costs associated with such actions, and the same shall become a lien against the above-described property. Remediation Plan – Violation Notice 2021-018 • The fire debris will be sorted for reusable, commonly recyclable material, and all other material. Upon completion of sorting, reusable material shall be neatly stored, and both commonly recyclable material and all other material shall be removed from the property, no later than the dates listed below. o 25% completion by December 31, 2022. o 50% completion date by June 30, 2023. o 100% completion date by October 1, 2023. • Within five (5) business days of completion of the foregoing, I will notify the Town of Dryden Code Enforcement Office, who shall review the building or structure’s remaining walls and foundation, and determine further remedial steps to remedy any remaining unsafe conditions, including, but not limited to, filling-in or securing remaining doors, openings, and pits, if the Town of Dryden has not already identified such steps. • Such additional remedial steps, if any, shall be completed on or before May 1, 2024. I have received notice of, and participated in, the public hearing held by the Town of Dryden pursuant to Chapter 118 of the Town Code. I do not contest any finding that the structure(s) on the above-referenced property are dangerous or unsafe, as defined by Section 118-15 of the Town Code. I understand that this is not an obligation upon the Town of Dryden to secure and repair the structure. I hereby release the Town of Dryden, its officials, employees, volunteers, agencies, agents, contractors, and subcontractors from any and all liability in connection with this action, including any reasonably necessary steps it or they take to secure and/or demolish the building or structure on the above-described property. To the maximum extent permitted by law, I agree to indemnify, defend, and hold harmless the Town of Dryden, its officials, employees, volunteers, agencies, agents, contractors, and subcontractors, from and against damages, claims, expenses and causes of action of any type whatsoever, related to the above-described property, or arising out of or from the its or their actions taken in connection herewith. I release, discharge, and waive any action, either legal or equitable, that might arise by reason of any action of the above entities. Public Hearing for Unsafe Structure at 1892 Slaterville Road: The town board will continue the public hearing on October 20 for 1892 Slaterville Road. At that time they will consider the remediation plan to be executed by the parcel owner to remove the debris associated with a residence that burned down in 2020. Community Housing Development Fund supports another Dryden Project: Second Wind Cottages is building a four-unit apartment building in the Village of Dryden with support from the Community Housing Development Fund (CHDF). This fund is a cooperative effort by the City of Ithaca, Tompkins County, Cornell University and the Town of Dryden to support permanently affordable housing projects in Tompkins County. Three Area Variance Requests to be heard by the Zoning Board of Appeals in October: An applicant at 25 Catharine Drive is requesting relief to place an accessory structure in the front yard and within 20 feet of the road. The other two cases involve requests for relief from the 150 foot frontage required for lots in the Neighborhood Residential district. These two proposed minor subdivisions are located on Slaterville Road and Whitted Road.
