HomeMy WebLinkAbout2007-10-17 - BZA TOWN OF ULYSSES BOARD OF ZONING APPEALS 10/17/07 APPROVED 07/15/08 PRESENT : Chairman George Tselekis , BZA Members Barbara Bristow, Carl Mann, Gerald VanOrden, Zoning Typist Robin Carlisle Peck Excused : Andy Glasner Applicant : Brent Kotzman, Designer Chairman George Tselekis called the meeting and a duly advertised public hearing to order at 7 : 30 pm. He stated they were meeting to hear an area variance for Ken Zeserson located at 8 3 Maplewood Road to build an addition on an accessory building. This is nonconforming as are many of the lake lots they have seen. He asked if there was representation for Mr. Zeserson. Mr. Brent Kotzman introduced himself as representative for Mr. Zeserson, he is celebrating his 60th Birthday with family and friends . He was approached in the Spring by Ken and Jan to design a project that would convert a portion of their storage area into a writing studio . The project would add 140 square feet of living space with a 60 square feet porch for a total of 200 square feet. The coverage is currently 955 square feet on the lot, this would take the total to 1 , 155 square feet. They would be building the addition onto the current garage. Jan spoke to the neighbor to the North who is closest to them and they do not have an issue with the building. Mr. Tselekis asked if the Board had any comments or questions. Mr. VanOrden asked if the lot was non conforming in 2000 . Mr. Tselekis stated it was, most of the lake lots are all nonconforming. The area are usually well maintained, there have not been any complaints or comments offered after notifications went to the neighbors . He asked if there were any additional comments, questions or motions. Mr. Maim made the MOTION, seconded by Ms . Bristow . Whereas, there will no undesirable change to the character of the neighborhood, Whereas, there is no detriment to nearby property resulting from the requested variance to construct an addition, Whereas, the benefits sought by the applicant cannot be achieved by a feasible alternative method other than an area variance, and Whereas, the variation is not substantial in comparison to the previous requirements, Whereas, the variance requested will not have an adverse impact on the physical and environmental conditions in the neighborhood as described by the neighbors, and Whereas, the alleged difficulty was not self-created, Be it therefore resolved that the Town of Ulysses Zoning Board of Appeals approve an area variance for Ken Zeserson, 83 Maplewood Road, Town of Ulysses, Tax Parcel 29. - 1 -8 to construct an addition. Chairman Tselekis called the vote : Ms . Bristow Aye Mr. Maim Aye Board of Zoning Appeals 2 10/ 17/2007 Mr. Tselekis Aye Mr. Van Orden Aye The variance was approved unanimously. Mr. Kotzman asked if there were differences would he have to come before the Board again. Ms . Carlisle Peck advised him to contact Mr. Rachun regarding the plans and what could be changed without approval . Mr. Tselekis asked if there was another project on the table . Ms Carlisle Peck asked Mr. Holtkamp if he was here for the subdivision review on his property. Mr. Holtkamp confirmed he was . Ms . Carlisle Peck advised him that review went before the Planning Board the night before and the project was approved . Mr. Holtkamp acknowledged with a thank you stating he would contact Mr. Rachun.
