Applicants/Public : Matthew Ness, Mark Finnegan, JB Lockwood, Greg Lourey
Chairman George Tselekis called the meeting and a duly advertised public hearing to
order at 7 : 30 pm. He stated they were meeting to hear the application of Matthew Ness
for an area variance to build a garage at 5174 Jacksonville Road. He asked if Mr. Ness
was present to explain the project.
Mr. Ness stated they would like to tear down the existing garage which has been on the
property since 1955 . It is currently attached to the garage. It is 16 x 20, they would like to
tear this down and replace it with a garage that is 30 x 34 .
Mr. Tselekis asked if there would be any living space .
Mr. Ness replied there would not be any living space in the structure.
Mr. Tselekis noted the lot meets the setbacks, the problem is the lot is not 2 acres per the
current zoning regulation. His lot is 1 . 03 which was compliant with the old code. The
Town notified all the neighbors . He stated there were people in the audience he asked if
they had any comments, concerns .
Mr. Mark Finnegan stated he lives on Cole Grove Road and he is supportive of this
project.
Mr. Joe Lockwood stated he resides at 6311 Jacksonville Road, a few properties down
and he is supportive of this project.
Mr. Greg Lourey he lives at 5165 Jacksonville Road, basically across the street from the
Ness ' and he is in favor of approving this project.
Mr. Tselekis stated he saw the project himself, and it does not appear the project would
encroach on the neighbors . He asked if the Board had any questions, comments or would
like to make a motion.
Mr. Glasner made the MOTION, seconded by MR. VanOrden
Whereas, there will no undesirable change to the character of the neighborhood,
Whereas, there is no detriment to nearby property resulting from the requested variance
consisting of a new garage,
Whereas, the benefits sought by the applicant cannot be achieved by a feasible
alternative method other than an area variance, and
Whereas, the variation is not substantial in comparison to the previous requirements,
Whereas, the variance requested will not have an adverse impact on the physical and
environmental conditions in the neighborhood as described by the neighbors, and

Whereas, the alleged difficulty was not self-created,
Be it therefore resolved that the Town of Ulysses Zoning Board of Appeals approve an
area variance for Matthew Ness, 5174 Jacksonville Road, Town of Ulysses,
Tax Parcel 25. -4-2 to construct a garage.

Mr. Tselekis asked if there were any minutes to be approved.
Ms. Carlisle Peck stated they had 05/ 16/07, 05/23/07 and 07/ 18/07 Minutes to be
approved.
Mr. Tselekis noted they could approve 05/23/07 and 07/ 18/07 however there were only
two of the members in attendance at the 05/ 16/07 .
Mr. Glasner made the MOTION to accept the minutes, Mr. VanOrden seconded, the
minutes were voted unanimously.
Mr. Glasner made the motion to adjourn, Mr. VanOrden seconded, the meeting was
adjourned at 7 : 35 pm .
