HomeMy WebLinkAbout2007-07-18 - BZA TOWN OF ULYSSES BOARD OF ZONING APPEALS 07/18/07 Approved 08/15/07 PRESENT : Chairman George Tselekis, BZA Members Barbara Bristow, Andy Glasner, Carl Mann, Gerald VanOrden, Zoning Officer Alex Rachun, Zoning Typist Robin Carlisle Peck Applicants : Deborah Friends Chairman George Tselekis called the meeting and a duly advertised public hearing to order at 7 : 30 pm . He stated they were meeting to hear the application of Deborah Friends, for a variance to construct an addition to an existing dwelling . The variance is needed due to the frontage being 100 feet it is required to have 160 feet, otherwise all the setbacks have been met. He asked the applicant to describe the project. Ms . Friends stated her bedroom is the garage that had existed there. The roof comes off and there is leakage in the bedroom , they would like to tear this roof off and increase this space as well as add the garage. Mr. Rachun stated there is shed roof know they would like to add a gable roof following the line of the house . Mr. Tselekis stated they would be adding living space and adding a garage . Ms . Friends stated that is correct. Mr. Tselekis noted they had not received any correspondence nor are there any members of the public at the hearing. He asked the members if they had any other questions . Mr. Glasner stated he had a question for Mr. Rachun, he asked to explain what is conforming and what is not. Mr. Rachun stated he was told the sideyard setbacks had been met . He reviewed the information with the builder and was informed the setbacks were met. The property is not conforming to the moderate density which is 160 feet . It has enough acreage but it is a long narrow lot, these were developed in the 40 ' s and 50 ' s . The lot is just 1 acre . Mr. Tselekis asked if there were more questions or a motion. Mr. Glasner made the MOTION, seconded by Ms . Bristow . Whereas, there will no undesirable change to the character of the neighborhood, and Whereas, there is no detriment to nearby property resulting from the requested variance of 100 feet vs. 160 feet , and Whereas, the benefits sought by the applicant cannot be achieved by a feasible alternative method other than an area variance , and Whereas, the variation is substantial was preexisting and not caused or exacerbated by the changeā€ž and Whereas, the variance requested will not have an adverse impact on the physical and environmental conditions in the neighborhood, and Whereas, the alle g ed difficulty was not sel f created, Be it therefore resolved that the Town of Ulysses Zoning Board of Appeals approve an area variance for Deborah Friends, 3165 VanDorns Corners Road, Town of Ulysses, Tax Parcel 34. - 1 - 15 to construct an addition to an existing dwelling. . Chairman Tselekis called the vote : Ms . Bristow Aye Mr. Glasner Aye Mr. Mann Aye Mr. Tselekis Aye Mr. Van Orden Aye The motion was carried unanimously, variance is APPROVED. Mr. Rachun stated that in the new Zoning Law that if the lot was conforming to the old law it will be grandfathered in, it has gone through the Public Hearing but has not been approved yet.
