HomeMy WebLinkAbout2007-07-17 - PB 1 TOWN OF ULYSSES • PLANNING BOARD 07/17/07 Approved 08/21/07 Present: Chairperson Ken Zeserson, Planning Board Members : David Kerness, David Means, Darien Simon, John Wertis, Deputy Supervisor Dick Coogan Excused : Rod Porter, Rebecca Schneider Applicants : Charlie Nogle, Rich Hayward, ReMax Agent Mr. Zeserson called the meeting to order. He stated Mr. Coogan had information to present regarding several projects that may be coming in front of the Planning Board . Mr. Coogan stated there are two applicants that have approached the Code Enforcement Officer, they are both a PUD in the Town, our Zoning does not allow for amending a PUD . Spruce Row Campgrounds would like to sell up to 5 campers on their site, they would have to reapply. The other one is Kline ' s on Route 96 , they want to split the PUD and put in a mini golf course and go kart track . They Town Board may or may not ask this Board to review these applications . He will keep the Board informed as these progress . NOGLE SUBDIVISION Mr. Zeserson stated they are meeting to review the Nogle subdivision, he noted it appears to be non-problematic, he asked Mr. Coogan if there is any information he could share regarding this application . Mr. Coogan stated this is in a Hamlet District, it is a legal conforming lot . Mr. Kerness stated it is designated as a residential district . Mr. Hayward stated it is a natural division as the B Parcel is in the business area. Mr. Means asked if there were concerns where the driveway would be. Mr. Wertis stated that is definitely a concern, one of the reasons they are reviewing this application due to the fact it is on Route 96 . Mr. Coogan stated yes, the Town Board wants the Planning Board to be aware of any subdivision on the Town ' s collector roads . The driveway will be determined by which side they go out of Cold Springs or Route 96 . Mr. Wertis stated it may have been his understanding but he thought the Board reviewed this for driveway cuts on 96 . Mr. Hayward stated this plan is not proposing any driveways . Mr. Nogle stated if it was his design he would put the driveway on Cold Springs Road . Mr. Zeserson asked if they would come in front of them at a later date . Mr. Wertis stated they would not as it is a single family home thus not reviewed by the Board. Mr. Coogan stated the Board can only review on the action that is in front of them . Mr. Hayward noted they are not proposing a building or a driveway they are just proposing a subdivision. 2 Mr. Kerness stated he has some concerns noting the Zoning codes regarding downstream conditions etc . Mr. Coogan stated it is Mr. Rachun ' s responsibility to maintain building codes, etc ; the driveway issues would be under Mr. Meeker' s responsibility. Mr. Means made the MOTION, Mr. Zeserson SECONDED the motion. Whereas the Town of Ulysses Planning Board has reviewed the subdivision for Cold Springs Road/Route 96(Lot A) the Route 96 Tax Parcel (Lot B), Applicant Charlie Nogle, Town of Ulysses, New York per the tax map presented. 1 . Now Therefore be it resolved, the Town of Ulysses Planning Board offers the following after reviewing the subdivision presented. The Planning Board recommends the driveway cut be made on the Cold Springs Road of Parcel A . The vote on the Nogle Subdivision was unanimous. Mr. Wertis stated the Town Board put this into effect, yet they gave the Planning Board no power to do anything. Mr. Coogan he had a half hour conversation with Mr. Rachun today, he specifically asked if there was any set of circumstances in which this Board could recommend not approving a subdivision. If a lot was subdivided into a non-conforming lot it could still be subdivided but building could not be done on it, thus there really is no way they could deny a subdivision application. Mr. Wertis stated then his real question is in the Board ' s updated Zoning changes was this issue addressed . Mr. Coogan stated most of the changes did get through, however this issue did not get changed. Mr. Wertis stated he has concerns that they do not have any real sense of what they want this Board to do . A discussion was held regarding the possible changes to the Kline property. The lot is 27 acres and they would like to separate 3 acres from the original PUD . The consensus of the group is that the Planning Board would like to review this application. Mr. Zeserson proposed he draft a letter to review the application to the Kline and Spruce Row PUD to be sent to the Town Board requesting the Planning Board take the initiative for review processes . The other members agreed this would be a logical step and approved Mr. Zeserson composing and sending a letter to the Town Board .
