Georgia; Deputy Supervisor Richard Coogan ; Town Highway Superintendent James Meeker; and Town Attorney Mariette Geldenhuys Others Present : TC Representative Jim Dennis, Edward Snyder, and Geoffrey Hart. Supervisor Austic called the meeting to order at 7 : 30 PM and led those assembled in the pledge of Allegiance to the Flag of the United States of America. APPROVAL OF MINUTES Mr. Austic asked the Board if they all had received Ms . Marino ' s corrections and changes on the May 8th, 2007 Regular Town Board minutes . All the Board responded that they had . Mr. Ferrentino moved, seconded by Mr. Ellis the following : BE IT RESOLVED that the Town Board of the Town of Ulysses approve the minutes of the May 8`h, 2007 Regular Town Board minutes as amended by Ms . Tyler moved, seconded by Mr. Ellis the following : BE IT RESOLVED that the Town Board of the Town of Ulysses approve the previous examined vouchers 203 through 244 in the amount of $24, 549 . 34 . REPORTS OF REPRESENTATIVES Tompkins County Representative Jim Dennis reported about the Public Hearing that was held in Seneca Falls to talk about the truck traffic specifically the garbage haulers to Seneca Meadows . Several surrounding counties attended and different townships . Basically it was suggested to the Commissioner of DEC and the Administrative Law Judge that anything that they could do to help remove the garbage trucks from Route 79, 96 and 89 . Several attending Counties and Towns had brought resolutions and letters of intent expressing their concerns that were presented at the Public Hearing. Mr. Dennis said that since the PH other state legislatures are getting involved and what they are trying to do is suggest that the Thru-way lessen the tolls for trucks because right now what they can do is pay the state highway tax for trucks and it is cheaper then running the Thru-way. Regular Town 1Board Meeting 2 June 12 , 2007 Mr. Ferrentino, said that on Rt. 13 there is a sign that states 90 decimals which is an indication to truckers not to hit the Jake break. What Mr. Ferrentino is asking Mr. Dennis is if there is any information from Cayuga Heights or the Town or City of Ithaca showing if there has been an impact from that sign? Mr. Dennis said he could not answer that. Mr. Austic said that after the last meeting when Mr. Clarke brought this up he has contacted DOT and sent a request in to investigate a possibility of doing that or some other thing in the Halseyville Hill area on Rt. 96 . The State DOT said he would get back to the Town. Mr. Dennis said the noise is one issue but the second issue is the shear number of garbage vehicles that are using these roads . Mr. Dennis said that Tompkins County puts out five a day from their ' facility so anything else that is coming is rolling through the county heading for those two places . Mr. Dennis said that what ever the DOT can do would certainly help . , Mr. Dennis said that he thinks the State will have to do something more then the Thru-way or some of those kinds of things before anyone will change their way of getting to Seneca Meadows . The Board and Mr. Dennis discussed the garbage haulers and the problems . Mr. Dennis also reported that the County had set a budget goal and that 8 people voted for a 2% increase in the tax levy which means one half of a percent increase of the tax rate and that is a goal that is being asked to the County Administrator when he deals with the departments to look at that goal . This means a 1 . 7 million dollar decrease in spending. Mr. Dennis said that 7 of them were supporting a 3 . 6 increase in the levy and a 2 % tax increase but that did not pass and so the County Administrator and departments in a box and Mr. Dennis said he is guessing that some of the same things that happened last year will happen again with the cuts such as the library and a lot of other human service things . Mr. Dennis ended on the note that Steve Witcher County Administrator is going to retire in the Spring and Tim Joseph selected himself as the chair of the selection committee to find a new County Administrator by next March or April . Trumansburg Fire Department - no one in attendance tonight from the Fire Department. Planning Board Report - no one attending from the Planning Board. Councilperson Tyler reported on a report from EMC on forest management that there is a beetle which is coming from Ohio that can affect all Ash trees and so they are suggesting that those who do forest management on their own property remove as much Ash but leave the strongest trees . PUBLIC PRIMILEDGE OF THE FLOOR Mr. Ed Snyder commented on the statements made about the trucks earlier and it seems to him that everyone is missing the point and that is those places are a State facility and are making money and you want to penalize the people and the issues are with the State of New York. Mr. Dennis said that the resolution that was passed by Tompkins County was to deal with New York State, to deal with the traffic because we all recognize that it has a tremendous impact. If the iState can encourage the truckers to go a different way by lessoning their costs it would be helpful . TOWN REP o RTS Highway Superintendent James Meeker read the following report into record : Regular Town Board Meeting 3 June 12, 2007 • Pulled salt box out of ten wheeler • Washed down all boxes • Changed oil & filters and greased equipment • Patched all roads • Replaced driveway pipe on Glenwood Heights Road • Took down a large cherry tree in Jacksonville cemetery and all cemeteries were mowed for Memorial Day • Took down trees on Iradell Road • Helped the Village of Trumansburg hot mix patch over old water break • Hand patched Colegrove, Krums Corners, and Willow Creek Roads and preparation for seal coat • Helped Town of Ithaca haul hot mix to paving project on Stone Quarry Road Ms . Marino asked Mr. Meeker if he had any idea when the bridge work on Halseyville Road would be finished. Mr. Meeker said it may be three weeks more . Code Enforcement Officer Alex Rachun - absent and Mr. Coogan reported that no new building permits had been issued . Town Clerk Marsha Georgia reported that a total of $ 10,386 . 75 was collected for the month of May. Mrs . Georgia turned over $ 9,942 . 71 to the Supervisor with her monthly report of that total $ 9,454 . 75 was franchise fees received. The quarterly water bills were mailed out. Board Members and Committees Ms. Tyler reported that there will be an informational presentation for Tompkins County municipal officials on climate change .solutions . It ' s titled Beyond an Inconvenient Truth Global Warming and Local Policies . Neil Shapiro , the president of Tatum Engineering of Ithaca will be talking on June 28th, 2007 at the Tompkins County Library Borg Warner Room at 6 : 30 — 7 : 30 pm . Ms. Marino presented the draft agreement that the Recreation Partnership Board finished on Thursday and they would like all the municipalities to look it over and make comments . Ms . Marino said they can be sent to them or anyone can give them to her and she will get the comments back to the Board. Ms . Marino would like to bring the Recreation Partnership up at the next regular board meeting in July. Ms. Marino presented a slide show on the Recreation Partnership consisting of the following areas : • Budget Information • Program Provider information • Formula for smaller municipally RP cost • 2006 RP registrations — Town of Ulysses • Approximate cost to Ulysses to be part of the RP (2006) budget, according to small municipalities formula • Additional benefits to Ulysses residents from RP membership (2006 data) • Town of Ulysses and Village of Trumansburg Youth spending for Recreation Programs (2006 budget Info) Ms . Marino ' s summary & thoughts for consideration : • Costs to the Ulysses taxpayer per participant in the Rec Partnership and major local Rec programming are roughly equal ($25 - $40) • All local recreation programs are completely TCSD and T-Burg based • All current RP programs are completely Ithaca based • The RP represents 25 % of the total Ulysses spending on recreation programs Regular Town Board Meeting 4 June 12, 2007 • The extra cost of allowing outside Tomkins County youth in the TCSD to ; participate as part of the Ulysses RP membership is fairly small (6% of total) • All of the programs funded by local Ulysses Youth programming (recreation and enrichment) are available to ALL students in the TCSD ; ; there is no tracking of where individuals live . This is nice as it doesn' t ; discriminate or make kids feel different from their peers because of where they live . • The combination of Ulysses youth recreation programming and RP membership allows for a great breadth of variety and options of quality, cost-effective programs for our youth to participate in, both for TCSD kids and ICSD kids . Mr. Austic said that there is a sample resolution and he can put that on the agenda for the regular board meeting in July and give all the Board members time to review . Ms . Tyler moved to make an amendment to the agenda tonight under old business by adding the "Code of Ethics", Mr. Ellis seconded the motion. Unanimously approved . Supervisor Austic asked if everyone had a copy of the financial report for May and they had not received it. Deputy Supervisor went to make copies . Mr. Austic asked if everyone got the copy of the letter from Tompkins County Emergency Response in regards to a meeting that he will attend. Mr. Austic reported that several years ago the Trumansburg Fire Co . applied for a grant from Barbara Lifton ' s office for house numbering in the Town of Ulysses . Ms . Lifton ' s office called Mr: Austic and said no one had used it and they were about to close it out. The grant was not enough to do all the numbering so Mr. Austic asked for additional funds which they approved a grant for $20,000 . Mr. Austic said that would cover the cost of buying identification signs for every parcel with a house number in the Town. They would be installed once and then pass a resolution that it would be the homeowners responsibility too maintain after that. Mr. Austic and Chief Fulton have discussed installing the house number signs with the help of volunteer fire personal . Deputy Supervisor Richard Coogan apologized to the Board for any problem that may have arisen ford the garbage hauler ' s letter because of the meeting that may not have been according to th'e open meeting law. Ms . Marino said that the board members had met when the Supervisor was out of Town to discuss writing a letter about the truck traffic of garbage haulers and because an official meeting could not be due to there was not notification to the Supervisor the board did not call an official meeting. OLD BUSINESS Code of Ethics Ms . Tyler introduced and moved the following resolution : WHEREAS the 1970 Ulysses Town Code of Ethics is out of date and unenforceable. BE IT RESOLVED that the following text be added to the code to bring it into accordance with the Model Code of Ethics from the Association of Towns . The text of the inserted paragraphs is as follows : G. Appearance of Impropriety Regular Town Board Meeting 5 June 12 , 2007 An officer or employee must avoid circumstances that compromise his ability to make decisions solely in the public interest or create an appearance of impropriety. H. Recusal An officer or employee must recuse himself when faced with the above conflicts . Recusal defined-Recusal means that the official may not deliberate, vote, or participate in any way in such matter. The official should disclose his or her conflict and remove him or herself from the board . I. Town Property No employee shall use town property or assets for personal purposes or profit or to benefit a private party. Use of town property or assets is restricted to the conduct of official business and for the benefit of all residents . J. Nepotism Spouses and other family members may not serve in positions creating a conflict of interests, the appearance of a conflict or consolidation of power in one board. This would cause current paragraphs G and H of Section 3 of our current of ethics policy to be relabeled K and L. I further suggest that paragraphs la-Subordinates and 12-Incompatible Positions of the Association of Towns Model Code of Ethics be relabeled as paragraphs M and N of Section 3 . The text of the inserted paragraphs is as follows : M. Subordinates No official shall solicit political contributions from subordinates . N. Incompatible Positions An official is prohibited from (a) Holding positions when one is subordinate to the other (b) Holding positions when the duties of the positions conflict . A proper addition to Section 5 of our code to make it consistent with the model code would be to add provision for training as suggested. At the end of section 5 , I suggest adding the following wording : The attorney for the town shall give annual training to Ulysses municipal officials concerning the requirements of the town code of ethics . For clarity, Section 6 should be replaced by a Section 6 entitled Board of Ethics . Any town of Ulysses employee or officer may submit in writing an ethical issue or concern to the Tompkins County Ethics Board for review. Ms . Marino expressed her concern to have a list of the other costs . Mr. Ellis said that we need the other costs listed somewhere that would be available to applicants possibly on the web page . Mr. Austic aye Ms . Marino aye Mr. Ellis aye Ms . Tyler aye Mr. Ferrentino aye Adopted. Supervisor' s Review of the Financial Statement Mr. Austic reviewed the statement with the Board . Mr. Austic said that there is one thing he would like to mention. He has been talking with Mr. Meeker and found out that the Village of Trumansburg are replacing one of their pick-up trucks which is only four years old with only 24,000 miles and the auctioneer has told them at auction it probably would go for around $7000 . Mr. Austic said that he has talked to Mr. Meeker and the highway department could use it and also the water department. It is hard for the water department to haul things such as the hose to fill pools with in the jeep or some repairs. The truck from the Village would be a good buy and would last the Town several years . Mr. Meeker is going to find out what the Village may want for it and it could be a third of the price or less of a new one. Mr. Ellis asked where the funds would come from . Mr. Austic said from the Water Fund . Ms . Tyler asked why the Village is getting rid of it . Mr. Austic said that the Village has a five year plan to replace equipment no matter how many miles a truck has on it. Mr. Meeker said that it is a nice truck and well worth the price for a 2002 and less then 25 ,000 miles . Mr. Meeker said now if the water department needs a hydrant or something large at this time he sends one of his crew with the small dump truck and it takes his manpower. Mr. Meeker said also with the drug and alcohol testing his men now go to Convenient Care on the other side of the lake which amounts to one or two people usually per month, and if he is using the pick-up the men have to drive one of the small dump trucks there where the truck would be more fuel efficient. Mr. Ellis asked if it would be garaged at the Town Barns . Mr. Meeker said it would be used more from the Town Hall with water or zoning. Mr. Austic said that would be another use with the combination of the jeep and the pick- up truck would be to have the Code Enforcement Officer use one or the other and stop charging for miles, which at this time Mr. Rachun is submitting a voucher for $ 110 to $200 a month for using his car. Also when Stormwater inspections start there may be more need. Regular Town Board Meeting 8 June 12, 2007 Mr. Ellis asked what was happening with the Stormwater. Mr. Coogan said that it is possible that building codes may be changing and the Stormwater maybe part of that. Annexation D iscussion Mr. Austic asked if the Village had notified the Town of any dates for another Public Hearing. The Clerk has not heard from them on this . Mr. Austic said that the Village did have a meeting last night but he is not sure if they discussed it of not. Mr. Austic suggested that the Town decide their procedure and how they will discuss the annexation. Mr. Austic stated that his opinion is that seeing that the Village requested that Mr. Auble apply for the annexation it would not be unreasonable for them to handle the SEQR process . Mr. Ferrentino said that he talked with the mayor at the time and he said that the Village did approach Mr. Auble to apply for annexation so he agrees "let the Village do SEQR". Mr. Austic said when you look at SEQR you are only looking at changing the land from Town to Village you are not talking about development . Mr. Austic moved, seconded by Mr. Ellis the following : BE IT RESOLVED that the Town Board of the Town of Ulysses send notification to the Village of Trumansburg that the Town of Ulysses has no objection that the Village of Trumansburg are the lead agent for the SEQR on the application of Mr. Aubleion annexation. Mr. Austic aye Mr. Ferrentino aye Ms . Tyler aye Mr. Ellis aye Ms . Marino aye Adopted. Mr. Austic said that he feels a schedule of meetings should be set by the Town Board to discuss the annexation application and publish such meetings as much as possible so the public will bej informed of such meetings. The Board thciught that their next scheduled meeting on June 25th could be the first meeting by the Town Board to discuss annexation. Ms. Marino and Mr. Austic will work on different figures such as taxes, water charges etc . that may be advantages or disadvantages . Ms . Geldenhuys reminded the Board that it is the overall public interest of all three components -' the revenue for the territory, the Village and the Town. Ms . Geldenhuys said that Mr. Austic pointed out that the Town may have less information about the Village but it should be included in the determination. Mr. Austic said that there are some obvious things that the Town could come up with. Ms . Geldenhuys said she has come up with some preliminary criteria having been considered by other cases that have gone to the courts . Ms . Geldenhuys said that there are certain things that occur and she can summarize those in writing if that would be helpful for the Board. She said that the kind of language that she sees over and over in Regular Town Board Meeting 9 June 12 , 2007 the cases is that they talk about the overall public interest and they say that the benefit and detriment are customarily defined as in terms of municipal services such as police, fire protection, health regulations, sewer and water services, public utilities and public education. It is the natural and level of service to both municipalities . Ms . Geldenhuys said that another thing that seems to crop up in cases is tax increases or lose of revenues and the other criterion that all the cases site is whether the annexing government (which would be the Village in this case) and the territory have the requisite of unity purpose and facilities to constitute the community. Ms . Geldenhuys said that sometimes that defined in terms of what is the nature of the surrounding area that is going to be annexed into , occasionally as annexation goes it is for specific development but that is not the case here . Ms . Geldenhuys said that there is one case she would like to look into further that talks about court disfavoring irregular shaped boundaries and there is a question about the parcels that will be in effect landlocked and no longer contiguous to the Town, which are four properties right along the road . Ms . Geldenhuys said that none of these factors on its own seen to be conclusive but they are all factors that the courts say should be weighted. Ms . Geldenhuys will summarize these in writing for the Boards and research the case further where they talk about the shape of the municipalities . The Board discussed further annexation pros and cons . Ms . Georgia said she had sent the annexation to Tompkins County Planning for 239 l&m review three years ago and she also sent it this time and had received a response each time which she will copy to the Board. Ms . Geldenhuys reminded the Board that the annexation petition has to be considered as presented. Mr. Austic and Ms . Marino will work on getting information together in reference to annexation. Zoning Public Hearing Mr. Austic asked what the Board wanted to do on having a public hearing on the amended zoning law. Mr. Coogan said that substance wise very little has changed. Ms . Geldenhuys, Mr. Rachun and Mr. Coogan have had several conversations . Mr. Rachun is thinking about adding the wording about grandfather clause in several other places in the law and Mr. Coogan is waiting for the wording from Mr. Rachun . The Board decided that there is not enough time to get it advertised for the June 25th meeting and also the document is not ready for the public review. Mr. Austic again brought the thought up about allowing apartment complexes in a business zone. Mr. Austic also said that the Board needs to be thinking about if they loose a 40 acre business zone and the trailer park where do they plan on rezoning more business or a trailer park. The Board reset the Public Hearing for July 10th to be held at the Town Hall prior to the Regular Town Board meeting and Ms . Georgia will hold off advertising until she has received a final copy in hand for the public to review if they so request. Lighting District Mr. Austic reported on the request for a lighting district in 2005 for the two roads that were built for the apartment buildings (TRA) on the prior Auble property. Mr. Austic said that Attorney Bruce Wilson had done a lot of work on this and the file will be turned over to Ms . Geldenhuys for her review . The file includes a signed agreement from the apartment complex owner and William Auble to pay for all of the expenses, a map, plan and report done by Mr. Aubles attorney and a deed with the metes and bounds . Regular Town Board Meeting 10 June 12, 2007 Mr. Ellis said from where he sits he sees no sidewalks and he feels that no utilities pools should be placed until the sidewalks are determined. Mr. Austic said that the utility pools are already there and all the work has been done. Ms . Geldenhuys will look all this over. Ms . Marino does not see that it is appropriate to spend time and money because if the land was annexed it would be a Village concern. Mr. Ellis said he would not have the attorney even spend an hour working on this for the very same reason that Ms . Marino stated. Mr. Austic said that the lighting district has been asked for several times and all that would be done is four lights installed at their expense and he feels that the Town has an obligation to address their application. The Board agreed that the attorney could spend one hour on this application for a lighting district. Ulysses Youth Commission Ms . Marino said that at the Ulysses Youth Commission meeting it was discussed that the Youth Commission has never been asked by the Board to make a recommendation on the Recreation Partnership . Mr. Ellis thanked Ms . Marion for all her hard work. Ms . Marino moved, seconded by Ms . Tyler the following : BE IT RESOLVED that the Town Board of the Town of Ulysses request that the Ulysses Youth Commission make a recommendation on the value of continuing in the Recreation Partnership .
