HomeMy WebLinkAbout2007-05-23 - BZA TOWN OF ULYSSES BOARD OF ZONING APPEALS 05/23/07 Approved 08/15/07 PRESENT : Chairman George Tselekis, BZA Members Andy Glasner, Carl Mann, Gerald VanOrden, Zoning Officer Alex Rachun, Zoning Typist Robin Carlisle Peck Excused : Barbara Bristow Applicants : Jose Torrado . Chairman George Tselekis called the meeting and a duly advertised public hearing to order at 7 : 30 pm . He stated they were meeting to hear the application of Jose Torrado to build a garage and breezeway. He needs a variance under Article 8 . 6 to reduce the sideyard setback. He asked the applicant to describe the project . Dr. Torrado stated he would like to make the breezeway 3 feet wider as well as build a garage . It measures 28 V2 feet, however the breezeway would be very narrow . Mr. Tselekis stated plans had been submitted, these were reviewed by the Board members . Mr. Rachun stated the plans are not accurate the setback is 10 feet but the plans indicate 15 feet, there is a fax in the file explaining the change in the plans . Mr. Glasner stated he understands the reason for making the garage larger, what is the reason for increasing the breezeway. Dr. Torrado stated as indicated in the drawings the roof of the house comes off the house 18 inches and 18 inches off the breezeway, there is a space in between that would let snow drop between this would eliminate that as well as enlarge the breezeway. Mr. VanOrden asked if the plans call for a covered breezeway. Dr. Torrado stated it would be covered . Mr. Tselekis asked if there were any structures on the lots immediately next to this parcel . Mr. Rachun stated there are not, the neighbors were notified and no negative or positive comments were received. Mr. Tselekis clarified the setback would be 10 not 15 . Mr. VanOrden asked if Dr. Torrado had contacted his neighbor. Dr. Torrado stated yes he had, the nearest neighbor is the current District Attorney and she stated she had no problems with this project . Mr. Tselekis asked if the members had any questions or a motion. Mr. Van Orden made the MOTION, seconded by Mr. Glasner. Whereas, there will no undesirable change to the character of the neighborhood, and Whereas, there is no detriment to nearby property resulting from the requested variance, and Whereas, the benefits sought by the applicant cannot be achieved by a feasible alternative method, and Whereas, the variation is not substantial in compared to the requirement, and Whereas, the variance requested will not have an adverse impact on the physical and environmental conditions in the neighborhood, and Whereas, the alleged difficulty was not self-created, Be it therefore resolved that the Town of Ulysses Zoning Board of Appeals approve an area variance for Dr. Jose Torrado, 1250 Hinging Post Road, Town of Ulysses, Tax Parcel 33. -3-4. 72 for the purpose of reducing the side variance from 15 to 10 feet to build a garage and breezeway. Chairman Tselekis called the vote : Mr. Glasner Aye Mr. Mann Aye Mr. Tselekis Aye Mr. Van Orden Aye The motion was carried unanimously, variance is APPROVED.
