Minutes :
Mr. Zeserson presented the minutes from the March 6 , 2007 Public Hearing, Mr. Means
made the MOTION to approve, Mr. Zeserson SECONDED the motion . The vote was
unanimous, MINUTES APPROVED .
TSELEKIS/DOOLITTLE SUBDIVISION
Mr. Rachun presented the Tselekis/Doolittle subdivision maps . He stated this has been in
the works for awhile he informed the applicants they needed to get it formalized.
Mr. Tselekis would be selling to the Doolittle ' s . 69 acres which with the combined . 34
acre lot would create a 1 . 03 acre lot . The reasoning is the Doolittle ' s have such a small
lot nothing can be done with it if they have to revise their septic system they would have
serious problems . They have stated there would no additional building on the lots they
are just purchasing to create a bigger lot . If in fact they do want to build at a later date or
with a new owner they would have to obtain a variance due to the size of the lot. He
stated there has been some fill done on the property, they have obtained the necessary
DEC permits to do this . This as well as the Houghton subdivision is under Planning
Board review due to the fact these lots are located on collector roads in the Town of
Ulysses .
Mr. Means asked what the status of the other lot that is selling this property.
Mr. Rachun stated Mr. Tselekis ' property has a house on it, the property borders Route
96 . The remaining parcel would be a 6 acre lot remaining .
Ms . Schneider stated she is concerned with the fill there is a fairly large floodplain .
She would be asking questions about what is happening downstream if there is a fairly
large flood event .
Mr. Rachun stated it is steep and the fill does not go down to the creek, they graded the
top and pushed it out, it is still steep and there is a lot of bric-a-brac . The modulation of
the creek beyond is very shallow, it goes through agricultural fields . They did receive the
permit and are following the regulations . He also informed the Board he did issue a
building permit to tear down an old building it has to be removed by the end of June .
A discussion included a review of the maps with the following motion presented .
Mr. Means made the MOTION, Mr. Zeserson SECONDED the motion.
Whereas the Town of Ulysses Planning Board has reviewed the subdivision Tax Parcel
33-4-2, Owner-Beverly Doolittle and Tax Parcel 33-4-33. 1 , Owner George Tselekis
located on Krums Corners Rd. , Town of Ulysses, New York.
Now Therefore be it resolved, the Town of Ulysses Planning Board offers the following
after reviewing the subdivision presented. The Planning Board requests the Code
Enforcement Officer continue to monitor the site for
1 . Removal of the building per the permit issued,
2 . Compliance with the DEC permit.
The vote on the Tselekis/Doolittle subdivision was unanimous .
HOUGHTON SUBDIVISION

Mr. Rachun stated this is the second parcel that Mr. Houghton has taken from his
property. Under the current zoning law the next lot subdivided would trigger a major
subdivision process . He has informed the applicant as well as the owner of this status .
The would like to remove a 5 acre from his 100 acre lot on the corner of Perry City Road
and Duboise Road .
Mr. Means stated he wanted to make sure the applicant is aware of the setback for the
streams .
Mr. Cole stated it would be on the North part of the lot, he is aware of the 50 feet setback
required from a creek .
Mr. Wertis stated he just wanted to make it clear that this is the second subdivision. He
just wanted clarification as to where the first subdivision occurred and where this parcel
would be located.
Mr. Rachun indicated on the zoning map the initial parcel that was subdivided prior to the
August 31 , 2005 Zoning Law, this parcel cannot be considered . Since the new law there
has been one subdivision, this would be the second lot to be subdivided.
Mr. Wertis asked Mr. Rachun to review the regulation for clarification as to the time
limits etc .
Mr. Rachun and the other members referenced the Zoning Law and noted there is no time
limit as had been listed in the previous zoning law. He reiterated he had informed the
applicant and the owner of the third lot subdivided triggering a major subdivision
category. The reason this was put in the 2005 law was to prevent cookie cutter lots,
houses end to end along the road prevented maintaining the rural character of the town.
Mr. Means it is in Mr. Houghton ' s best interest to know what he plans to do in the future,
making the road cuts etc .
Ms . Schneider asked which road the driveway would be coming off from . With the creek
and ditch on the site they cannot cross it .
Mr. Rachun stated they could do a crossing on this . The setback does not include bridges .
Ms . Schneider asked what precautions would be in place to make sure it happens
correctly.
Mr. Rachun stated Mr. Meeker the Highway Supervisor would be assisting, even though
it is on private property because it does affect the streams downstream .
Ms . Schneider asked if he had developed plans for the driveway.
Mr. Cole stated he had plans for either road, they would like to put a bridge however the
bottom line will be budget costs .
Mr. Zeserson made the MOTION, Mr. Wertis SECONDED the motion.
Whereas the Town of Ulysses Planning Board has reviewed the subdivision Tax Parcel
27-3- 17. 2 located on Perry City Rd. /Duboise Road, Town of Ulysses New York
Now Therefore be it resolved, the Town of Ulysses Planning Board offers no comments
on the Houghton Subdivision.
Vote on the Houghton Subdivision was unanimous.
Mr. Wertis stated he vaguely had the impression the Town Board was addressing
corrections to the zoning ordinance, yet he had not heard of any public meetings .

Mr. Rachun stated they had, he would be compiling an email to Ms . Marino information
regarding signs . Mr. Ellis had drafted revisions from suggestions . They are 100 days
away due to SEQR, Public Notices, 239 1&m and he is concerned with a new Board
possibly coming on line. There are huge areas on Route 96 where junk yards and scrap
yards can go .
Mr. Wertis stated they had reviewed some items , but wondered if this Board would be
looking at the revisions .
Mr. Rachun stated he would have a copy emailed to the members .
Mr. Wertis stated there is a discrepancy on the water buffers . He gave it to Ms . Schneider
tonight. The buffers are in conflict with each other thus need to be addressed.
Ms . Schneider stated she would get to it immediately so they could be addressed with this
revision . She asked Mr. Rachun if he was satisfied with the changes .
Mr. Rachun stated he is he believes the revisions should make the zoning ordinance much
better to comprehend .
Mr. Zeserson asked if there would be any dock ordinances .
Mr. Rachun stated they can only do technical changes, the dock regulations would have
to come through the Comprehensive Plan. The Town of Ithaca and Town of Lansing have
drafted laws to permit these structures . This could come from the Comprehensive Plan to
be integrated with the zoning laws . He gets calls from irate neighbors who put a dock into
their water and there is no law to prevent this .
Ms . Schneider stated another thing that is happening is people are putting whole
structures on the docks .
Mr. Rachun stated a planner from Ithaca had a right of way on the lake, they put a dock
in the water and built a two story structure on the lake . This individual knew the law, had
the right of way and is in compliance .
Mr. Kerness stated the West Shore Development Committee have sent out surveys
requesting input on lake area issues . This information will be pulled into the
Comprehensive Plan for lake area planning, etc .
Krys Cail-Ag. and Farmland Grant
Mr. Zeserson stated he had been contact by Krys Cail regarding an Ag and Farmland
Grant, she had requested time to make a presentation .
Ms . Kail introduced herself explaining a program Tompkins County has for Farmland
Protection that was adopted in 1998 . They did not have much representation for Ulysses
they were funded in the early 90 ' s to plan for agriculture . There are only 3 counties left
that do not have a plan, the others do not have agricultural land . The Agricultural
Department is now working on offering funding to have Townships development their
own Ag. Plan. The Ag. Department is offering a grant for the maximum of $25 , 000. 00
they are first come, first serve and applications will start being accepted in June 2007 .
She stated there is an expected amount the Township needs to contribute; they can use
In-Kind funding. She would be willing to do the grant and could be used as an In-Kind
service at no charge to the Town. She stated she would waive any professional fee for
this service due to her interest in the Town of Ulysses retaining the farmland.
Ms . Carlisle Peck informed Ms . Kail this had been brought to the Comprehensive Plan
Committee at the last meeting. The Board had instructed Mr. Coogan to pursue and
update them to file the application for the farmland portion of the Comprehensive Plan.
A discussion was held regarding Mr. Coogan remaining responsible or asking Ms . Kail to
take on responsibility for the application and obtaining this grant. The following motion
was made :

Mr. Wertis made the MOTION, Ms . Schneider SECONDED the motion
Whereas the Town of Ulysses Planning Board has reviewed the articles and
presentation by Ms. Krys Kail regarding potentially obtaining a grant from the
Department of Agriculture.
Now therefore be it resolved, the Town of Ulysses Planning Board requests
1. Ms. Krys Kail complete the application to obtain the Ag. and Farmland Grant, and
2. The Town Board review for approval Ms. Kail completing and filing for the
grant.
Vote on Ms. Krys Kail filing/obtaining the farmland grant was unanimous.
The meeting was adjourned at 8 : 30pm.
