Applicants : Bridgid Beames, Stanley Beames, Dana Stafford, Steve Holzbaur, Adrienne Stearns, George Breuhaus, Eileen Driscoll , Steven Engelman Minutes : Ms . Carlisle Peck stated the minutes from the 01 / 16/06 were not completed at this time . Mr. Zeserson called the meeting to order at 7 :25 pm, he informed the Board they would be reviewing the application from Bridgid and Stanley Beames for a Montessori Preschool and Daycare, the application has been received and the fees are paid . He asked the applicant to give a description of their project . Ms. Beames stated they would like to take the property at 1608 Trumansburg Road and convert it into a small daycare center, they would have two classrooms- 1 would be for preschoolers (3 -6 years of age) and toddlers ( 18 months to 3 years) for a total of 33 children. They plan on renovating the building to bring it up to Ulysses and New York State Code . Mr. Zeserson stated they had a sketch plan conference with Mr. Beames, Mr. Rachun, and Mr. Coogan this is an allowable use in a B1 area in the Zoning Law. There does not seem to be any major alteration in terrain that would trigger any impacts . The application had been sent to the other agencies and to date have not received any comments back. Ms . Schneider asked since they had gotten the letter from DOH late and it created problems for them in the past had this project been given sufficient time to get the response back from the agencies . Mr. Coogan stated the other project was a coordinated review, this project would not be thus it would not be an issue . Mr. Zeserson noted the signs are within the allowable size of 12 feet. He asked if the additional parking area would create any problems with stormwater. Mr. Coogan replied it would not. Ms . Schneider asked if there should be concerns with the septic system . Mr. Zeserson stated it is out of their purview, this would be the responsibility of the Health Department. Ms . Beames stated they had met with DOH and they will have to upgrade the septic tank, but the lines will all still run along the same line thus no increased soil disturbance should happen. Mr. Zeserson asked what arrangements had been made for the trash. Ms . Beames stated they had contracted with Superior Disposal, they would be doing composting as well as recycling . They would have storage cans in the shed and will try to keep the trash to a minimum . Most of their children are potty trained, they have approximately 5 -6 children that are not, some families use cloth diapers . Superior has a formula they use to calculate the amount of trash per child to calculate the volume they would have. Ms . Schneider noted she had stated a lot of their families use, does she have a current daycare. Planning Board 2 02/06/2007 Ms . Beames stated she does run a group daycare out of her home, she was the Director at the Montessori program in Lansing. When they had their children they noticed there were not a lot of options for daycare on this side of the lake thus they decided to expand. Mr. Means asked if they have plans to expand beyond the 33 children. Ms . Beames stated their goal is to get operational and provide good, quality daycare with this size. They could evaluate at a later date but at this point in time they do not plan to . Mr. Means asked if they had considered the location in relation to growth regarding the state regulations , septic etc . Ms . Beames stated they had but they are content on the number they have currently, they are connecting to the Town water and increasing the septic . Ms . Schneider asked if they would get a letter from the Department of Health that the applicants have contacted them. Mr. Beames stated he had spoken with the Department of Health and forwarded the plan to them. He contacted them and informed them the septic would be insufficient for what their needs would be . He gave Mr. Beames the upgraded information, the next step would be the perk test and they would continue to work with DOH to upgrade and get the system inspected. Mr. Means stated he did not see any fence for a playground area. Ms . Beames stated they are planning on enclosing the playground area off the back of the building. There are actually two — one for the older children and a second for the younger. The playground entrance would be out the back, the children would not have access to the front entrance . The State is very particular regarding requirements for daycare centers . The Syracuse Regional officer will come down and inspect the building for fire and safety codes . Mr. Zeserson stated he noticed there are no real structural changes to the building the footprint is essentially staying the same. They are adding some handicapped parking next to the front door. Mr. Means noted the lights they would be adding are dark sky compliant. Mr. Beames stated Mr. Rachun suggested he bring a picture of the lights they would be using. He brought the actual fixture they would be using, they would be 150 watt mercury vapor. The lights would be attached to the soffet and focused down on the parking lot. Mr. Zeserson asked if the Board had any other questions or comments . Ms . Schneider asked if they want to expand in a year from now. If they choose to double in size is this relevant at this point in time. Ms . Beames stated regarding the size of the school to keep it homelike and cozy they would not go over four classrooms . They also cannot go over so many square feet without installing a sprinkler system under the DSS Regulations. These systems are very costly and not something they would want to undertake at this point in time. Mr. Coogan stated if they are adding structure or changing the outside of the building they would have to come back for Site Plan Review. Mr. Zeserson stated at this point in time the Board has determined it would be an Unlisted Action and if there does not appear to have any negative impact they could complete the Short Form Environmental. Review . Mr. Wertis asked to clarify the steps . Mr. Zeserson stated it is his understanding that if they have the intent to go ahead they can complete the EAF, if they determine to have a public hearing they could determine that tonight as well . He personally does not feel they would need a hearing, during the sketch plan Planning Board 3 02/06/2007 conference the applicants informed them they had spoken to neighbors and did not hear any objections . Ms . Beames stated they had spoken with the neighbors and have over 60 people on their waiting list. The owners of Stick n Stone Farms are on the waiting list to enroll their children as are another one of the neighbors . Ms. Schneider stated the area has the Antique Mall, Ithaca Millwork, as well as other agricultural areas . The complex this building is located had been Babcock Farms. Mr. Porter asked what the zoning for this area is. Mr. Zeserson stated it is zoned as a B1 (Business District) this is an allowable use . They have not heard any outcry prior to this meeting nor at this meeting. Mr. Coogan informed the Board the neighbors were all contacted regarding tonight ' s meeting. Ms . Schneider asked when the notices were mailed . Mr. Coogan stated the notices were sent as soon as the Sketch Plan meeting was held and the fees were paid, which was about three weeks ago . Mr. Zeserson stated if they had a public meeting they would probably have the attendance they have currently. He proposed they do the Short EAF tonight, the completed page should be in each packet the members received . The members agreed they could complete this. The Short EAF was reviewed and completed with Cl through C7 being answered NO . Mr. Wertis stated he could not locate within the Zoning Law the section gives the Planning Board the discretion to hold a public hearing. Mr. Coogan stated he believed the wording stated the word may indicated it is optional. Mr. Wertis referred to Page 11 of the Zoning Law and it states the word shall hold a public hearing. Mr. Coogan agreed the word is shall and the Planning Board is obligated to hold a public hearing. He stated it is discretionary under Subdivision but not under Site Plan review. The Planning Board will have to schedule a public hearing. Mr. Zeserson asked what the shortest amount of time would be to hold the hearing. It seems the Board does not have any objections and it would be advantageous to move this project along. . Mr. Coogan stated there is a 5 day notice required, the earliest they could have it would be February 13 `h . A discussion ensued and reviewing members schedules decided the best day would be February 20th, Mr. Zeserson and Mr. Coogan would be out of town however if the other members can attend quorum would be maintained and the public hearing could be held. The following motion . was made. TOWN OF ULYSSES PLANNING BOARD RESOLUTION NO. 2007-001 Namaste Montessori Site Plan Review Tax Parcel No. 33-5-3 .3 1608 Trumansburg Road Town of Ulysses, New York Planning Board, February 6, 2006 MOTION made by Mr. Wertis, seconded by Ms . Simon , Planning Board 4 02/06/2007 WHEREAS , the Town of Ulysses Planning Board has reviewed the application for Namaste Montessori Daycare to be located at 1608 Trumansburg Road, and WHEREAS , the application has been deemed complete and a legal, conforming use within a B1 district per Town of Ulysses Zoning Law (August 2005 ) , and NOW, THEREFORE BE IT RESOLVED , a Public Hearing shall be scheduled for Tuesday, February 20, 2.007 , 7 : 30 pm, Town of Ulysses Town Hall , 10 Elm Street, Trumansburg, NY to review public input . I The vote on the motion resulted as follows : AYES : Mr. Means , Mr. Porter, Ms . Schneider Ms. Simon, Mr. Wertis, Mr. Zeserson NAYS : NONE ABSENT : NONE ABSTAINED : NONE The vote on the motion WAS CARRIED unanimously. Ms Carlisle Peck asked if one of the members cannot attend please let her know so she can cancel the meeting, the members agreed they would do this . The Beames stated they would forward their email to contact them regarding a possible cancellation. Ms . Schneider asked if they would be making a decision. Mr. Coogan stated they would open the hearing, listen to public comment then they can close the hearing. • Mr. Porter stated if in fact they wanted to make a decision and had quorum could they make a decision . Mr. Coogan replied they could, they have completed the SEQR thus the members could make the decision . He stated Mr. Rachun would be in attendance for the hearing that night. Mr. Zeserson stated the next application they had received was from Regional Access, they would be purchasing the Ithaca Millwork building and moving their warehouse from Cayuga Street to this location . The application and fees have been paid. He asked the applicants to give a brief description of the project. Mr. Breuhaus introduced himself as the architect for Regional Access, they are located in the old Agway building on Cayuga Street Extension, they have purchased the former Ithaca Millwork building on Route 96, it is located in the industrial zone for Ulysses Zoning Regional Access is a food wholesaler, they specialize in organic and natural foods . They have recently become and it is an increasing part of their business ; is they are acting as a freight forwarder for NYS Wines . They take wines from the Finger Lakes area and transport them to NY City/Metropolitan area, they bring back wines from California, and European vendors to distribute upstate. They distribute to Greenstar and other local and state vendors . They bring back large quantities and repackage for distribution to these vendors . They are moving out of a residential area and moving into an industrial zone, they would get a larger building and their business has been growing . They are looking to expand up to 2,000 feet. They have bids out for coolers which would allow them to get into an area they have not able to work with specifically dairy products . They currently have 25 full and part-time employees, when it was Ithaca Millwork they had approximately 10 employees . Obviously, they would have to add parking, the Site Plan indicates a 20 space parking lot to be added off the Northwest corner of the property. They would be adding parking areas in front some would be made to be handicapped accessible and they would add parking for office staff They do not do a lot of retail sales however on occasion they have a restaurant owner who may come to purchase items needed. They would be adding a sidewalk and a ramp to allow handicapped access to the building. They would be adding a gravel area to accommodate the tractor trailers and provide maneuverability for the trucks . There would be seven spaces added, on occasion they have drivers who stay overnight. Currently, there are 3 high pressure sodium lights on the pole they would be replacing them with metal halide lights, they would not be the orange type lights currently onsite. There is a bay that is unenclosed this is Planning Board 5 02/06/2007 the loading dock they would be adding a light onto the peak for lighting parking area for trucks . There is currently on the garage area a pair of spotlights they would be changing to a wall pack that would add lights for the delivery trucks . The lights over the current entrance would be changed to add more light all of these lights would have lenses that have directional cut off They would not be mercury vapor lights these could be focused on specific areas to control light spillage. They would be adding a light on the existing light pole to light the parking lot. The building would not be changing, the sign would change to reflect Regional Access and the lights would be changed to gooseneck lamps . The lights would be put on programmable seven day timer switches . This is a permitted use in the light industry district. Mr. Zeserson stated this is definitely an allowable use, he asked the public in the audience if they would like to have a chance to speak. Ms . Eileen Driscoll introduced herself as being the resident in the house right next to the property. She is very concerned with noise from the building late at night and early in the morning as well as lights in her backyard. They get a lot of noise from the building currently, there are band practices held there that sound like a loud radio in their home. She knows this is not Regional Access but they get a lot of noise from these buildings. Mr. Breuhaus verified that this is the residence to the West of the property. Ms . Schneider asked if there were other residences in the area. Ms . Driscoll stated there is a residence across the street, but they are the closest. Mr. Means asked how many feet their house is from the property line . Mr. Breuhaus stated the property line off the nearest corner is probably 91 -92 feet, the house is probably 100 something. Mr. Means stated driving by he has noticed that the area is zoned industrial, yet there are residences in the area. Mr. Breuhaus noted that the Antique Mall actually has two different zones running through the middle of it. Mr. Means stated there have been complaints regarding the refrigerators running at night, the compressors that keep the refrigeration on the trucks going run all night . Ms . Driscoll stated in the summer they have their windows open the band is loud so she would presume they would hear the trucks . Mr. Means stated he wondered if there is a way this noise could be mitigated. Mr. Breuhaus stated the trucks would be toward the back of the property, they are adding trees to mitigate some of this noise. Ms . Schneider asked what their options would be, could they request a fence to mitigate . Mr. Zeserson stated he was unsure, this is zoned light industrial, the use requested is within the regulation , however they do have residential within the zone . Mr. Engleman introduced himself and stated the reason it was zoned industrial is because of Ithaca Millwork, it had been zoned agricultural . They have seen increased creeping of the industrial area, more traffic , more noise-they have spoken regarding noise from the band, it was admitted it was illegal yet nothing was ever done . It went from agricultural (Babcock' s) to industrial (Ithaca Millwork) yet there is no protection for the residential people in this area. The band practices were going until 1 -2 in the morning, he complained and the Town did nothing, he was advised to work it out with his neighbor. He did try this and was informed it was their building and they would do what they wanted, so that did not work. He is very concerned nobody is trying to protect the homeowners in the area. They could have trucks that idle all night Planning Board 6 02/06/2007 can the Town do something to help protect them . They shop at Regional Access and like them but do not want their residence put at risk. Mr. Zeserson stated everyone agrees they do not want to see this creeping phenomenon; however they have limited capacity regarding the zoning. He is not sure what their options are. Mr. Porter stated they can mitigate to help protect the adjoining properties. It is a potential impact and they can ask the applicants to address this issue . Ms . Schneider agreed she stated it is obviously a concern, and she feels it is their job to minimize the impact this project would have on this site. They have addressed similar issues with stormwater for other projects and feels they should pursue this area. Mr. Coogan stated diesel trucks are not allowed to idle overnight, there is a set time they are allowed to left to idle, this is a very short period of time, anything above this time would be a police matter. Mr. Stafford stated the refrig units Mr. Means is referring to are cycle programs, they start up and shut themselves done automatically. He really believes the best option for them would be to allow them to have a bigger cooler area. They would not have to load the truck at night then keep the truck refrigerated all night, the catch to that is they would start at 4 : 00 am thus they would have that noise impact . Mr. Engelman stated he has to protest, beginning work at 4 : 00 am is not acceptable . To have trucks idling outside your window at 4 : 00 am thus is a big impact the sound carries . Once Ithaca Millwork came it was zoned an industrial district he is really concerned, this had been designated as agricultural and was rezoned with no regards to the residences ' in the area. Ms . Schneider stated they have dealt with issues similar to this, they had another project where noise was a concern and they requested a fence be installed as well as plantings to mitigate the noise. They were very strict about sound after 10 : 00 pm at night. Mr. Porter stated they do not have the ability to regulate the hours of operation. Mr. Coogan stated one difference is the zones changed on the properties involved . This is not the situation here . Mr. Porter stated the zoning change was part of the Zoning Law (August 2005) not just due to Ithaca Millwork . Ms . Schneider stated she also wanted to know about trash removal, they repackage their merchandise and may have to dispose of foods that have gone bad. Mr. Holzbaur stated they had contracted with Superior Disposal . Ms . Schneider asked regarding food items what they do for rat infestation etc . Mr. Holzbaur stated they actually do not have that much garbage, the dumpster they use currently is approximately 4x4x6, they do not throw away a lot of items . The dumpster is similar to one they would find at any building. Ms . Stearns stated they do a lot of recycling as well they have the large recycling bins for paper, glass etc . • Mr. Holzbaur stated the repack business is only about 5 % of their overall business . Ms . Schneider asked if the Department of Health would be involved for rats, etc . Mr. Holzbaur stated they do have a pest management business to take care of these issues . Mr. Zeserson stated at the sketch plan conference the cleaning of the trucks would not be done on premises . Planning Board 7 02/06/2007 Mr. Breuhaus stated the majority of the trucks are rented form DeCarolis in Geneva, NY; the garage would be used as a maintenance garage for the panel trucks . DeCarolis in Geneva is responsible for washing and maintaining the trucks . Ms . Schneider asked if they would be storing gasoline on the site. Mr. Stafford stated it would be cheaper but they do not, they use Bowers Fuel for the gasoline supplies . Mr. Means stated the dimensions show the cooler/freezer show 1200 feet, they had mentioned up to 2000 feet. Mr. Breuhaus stated they have put bids out they are not sure what size they would be getting until the bids come in . Mr. Means asked where the compressors for these would be located. Mr. Stafford stated these coolers would be inside the building, most of the compressors are very quiet, they are not like air conditioners , etc . Mr. Zeserson asked if the members had other issues . Mr. Wertis stated he is unclear how Article 17 Design Standards relates to the Light Industrial, he asked Mr. Coogan to clarify the Design Standards relative to noise, he is referring to Page 81 . Mr. Zeserson stated 17 . 2 . 2 definitely addresses the noise issue; he referred to the time limit of two hours doing the day and 30 minutes at night. Mr. Coogan stated it does indicate the measurement could be done and specifies the hours . Ms . Schneider asked if this would qualify as Ag and Market. Mr. Porter stated it would not qualify for the Ag and Market exemption. Mr. Wertis stated the noise can be annoying from the trucks by stopping & starting; he asked could it be mitigated by expanding the tree space. Mr. Stafford stated this is a predicament they are in, if they did not have to load immediately the noise would be from loading and unloading. If the trucks are loaded at night they have to be kept cold, if they are loaded in the morning they would need an early load time to get on their route. Mr. Zeserson stated offhand he does not know what 90 decibels is, the question he would like to see addressed is if all of these trucks are running does it exceed 90 . Mr. Coogan stated they would have to run more than 30 minutes, if after 25 minutes it shuts off it would be acceptable. Ms . Schneider stated an area she is concerned with is the lack of topographic maps . She realizes this is an industrial district but she does know if there is a stream that is on this property and would appreciate seeing the topography of this area. Mr. Breuhaus stated there is small stream that runs on the property and he has been there during the heavy rain and did not see any run off problem . The water perks down the lot with no problem with runoff. Ms. Schneider stated she appreciates that however she would still like to see a topographic map due to the amount of trucks on the project site, there is increased chance of oil and gas leaking and she would like to have this addressed. Mr. Engelman stated the run off from the stream goes along the back part of his property and heads towards Krums Corners Road, Stick n Stone farms use some of this water to irrigate their property for their organic operations . Planning Board 8 02/06/2007 Ms . Schneider stated if this is true this could be a problem with the organic operation thus it should be addressed. Mr. Zeserson stated Stick n Stone had been informed of this application, he feels they should have a public hearing to give everyone a chance to be heard before a decision is made. Mr. Porter stated if you look at where the existing ditch is compared to where the driveway and parking lot is there is a fair amount of vegetation. Mr. Zeserson stated it seems to be a complex issues, he would like to meet among themselves and review some of the questions raised, past history to try to make the situation work for all concerned . Clearly they will need to hold a public hearing, he asked if the members thought they could schedule this for the 20th Mr. Porter stated the usual method is to ask the applicants to have the additional items requested provided prior to the public hearing . Mr. Zeserson asked who would provide the information regarding the trucks noise levels . Mr. Means stated the applicants should have an engineer that can get this information as well as develop methods to mitigate the problems . Ms . Schneider reiterated she would like to request a topographic map to show the connections between the adjoining lots . This project sounds like something they would like to have in town however they just want to make sure all of the properties in the area are able to function with this plan . Mr. Zeserson read the time and noise limits per the Zoning, Mr. Breuhaus was given a copy of the page from the Zoning. Ms . Schneider stated the Zoning Law is on the Town Website as well . Mr. Porter stated as an example they have added a row of pine trees, they may want to add a second row . Mr. Breuhaus stated they want to be good neighbors but he is not convinced the trees are going to mitigate the sound . If you look at the thruway they put up concrete bathers but it really does not eliminate the noise. He asked if Mr. Rachun has a decibel meter available . Mr. Means agreed with Mr. Breuhaus it may look better but it may not decrease the noise. Mr. Coogan replied Mr. Rachun does have a meter. Mr. Breuhaus stated they could measure one of the refrigeration trucks they could do it on the property line as well as from the house. Unfortunately, the measurement will be different during summer vs . winter and the trucks run more in the summer vs. winter. A mitigating thing would be to not load overnight but then you have the problem of loading at 4 am . Unfortunately, the houses are located in an industrial district not a residential district . Ms . Schneider stated it is their job to try to mitigate all of these issues, the creeping problem is progress but it is their job to mitigate so all of the property owners are satisfied. Mr. Breuhaus stated if they can see the source the noise is louder than if they cannot see it . Ms . Carlisle Peck asked what the hours of operations are. Mr. Stafford said it is variable, depending on what trucks they have going out due to the size of their present location, he will be leaving this meeting to go back to work and will work most of the night . They hope to standardize these hours in the new facility. Mr. Means asked if the trucks would have to be located on the Site Plan where they currently are. Planning Board 9 02/06/2007 Mr. Stafford stated he could see some changes, however they are limited due to a large leech field on the site due to the building being part of Babcock ' s . Mr. Breuhaus stated they had put the tractor trailers in the vicinity they are due to the location of the loading dock. He would like to get the sound check his concern is doing it now vs. in August. Mr. Zeserson stated there are a lot of variables . Mr. Stafford stated if they did it in their current location they could have the tractors running. Ms . Schneider stated she would like to have the light flow measured and reviewed as well . Mr. Porter stated that the way they have the traffic directed the lights would not be directed onto the adjoining properties . He does not really see an issue with this . Mr. Breuhaus also stated they are putting in pine trees to absorb some of this . Ms . Schneider asked what size trees they would be planting, she did not see this in the plan. Mr. Breuhaus stated they plan on planting 6 foot pine trees . Mr. Wertis stated to get the larger cooler space there seemed to be some barrier in the zoning. Mr. Breuhaus stated if they got through tonight, if they have an increase of 10% of the property it would get kicked back to the Planning Board . Mr. Zeserson stated they could not determine the SEQR until the public hearing. The next step would be to determine the next meeting for further discussion, then schedule the public hearing. They could have a discussion after the public hearing if the information requested has been received by February 20th Mr. Coogan stated they would have to have SEQR done by the public hearing or do it at the hearing. The members reviewed their schedules and determined a discussion meeting after the February 20th public hearing then the public hearing for Regional Access could be scheduled . Ms . Stearns clarified that they should attend the meeting on February 20th Mr. Zeserson stated they are welcome, the hearing would commence at 7 : 30, they do not anticipate a lengthy meeting so they can hopefully review the Regional Access data by 8 : 00pm. Mr. Breuhaus asked for the list of additional items . Ms . Carlisle Peck read the items requested as follows 1 . Measured decibel levels of the trucks running, 2 . Topographic maps of property and adjoining properties indicating streams, ponds, etc . 3 . Possible ways to mitigate the sound, either by freezer, fencing etc . Ms . Schneider asked if after the discussion they decide they want additional information is there enough time to get that information. Mr. Coogan stated that they are saying the application is incomplete thus no time frame has started as of this date . Ms . Schneider replied that is all she wants to be sure of, she would like adequate time to review the information and obtain additional information if necessary based on the topographic maps. Ms . Stearns stated they have a copy of an environmental study done by the previous owners . It is large but she offered it to the Board . Planning Board 10 02/06/2007 Mr. Porter stated if she felt there was any information relevant to the project the more information provided is usually better. Mr. Porter asked if they would like to request a diagram of the lights they would be installing. Mr. Zeserson asked Mr. Breuhaus to bring in the information regarding the lights . TOWN OF ULYSSES PLANNING BOARD RESOLUTION NO. 2007-002 Regional Access Site Plan Review Tax Parcel No. 1609 Trumansburg Road Town of Ulysses, New York Planning Board, February 6, 2006 MOTION made by Mr. Porter, seconded by Ms . Schneider, WHEREAS , the Town of Ulysses Planning Board has reviewed the application for Regional Access to be located at 1609 Trumansburg Road, and WHEREAS , the application has been deemed a legal, conforming use within an Industrial district per Town of Ulysses Zoning Law (August 2005), and WHEREAS, the Town of Ulysses Planning Board has requested additional information as follows the application is not deemed complete. 1 . Measured decibel levels of the trucks running, 2 . Topographic maps of property and adjoining properties indicating streams, ponds, etc . 3 . Possible ways to mitigate the sound, either by freezer, fencing etc . 4 . Specification, diagrams regarding the lights to be installed. NOW, THEREFORE BE IT RESOLVED, a Public Hearing shall be scheduled for Tuesday, March 6, 2007, 7 : 30 pm, Town of Ulysses Town Hall, 10 Elm Street, Trumansburg, NY to review public input. The vote on the motion resulted as follows : AYES : Mr. Means, Mr. Porter, Ms . Schneider Ms . Simon, Mr. Wertis, Mr. Zeserson NAYS : NONE ABSENT : NONE ABSTAINED : NONE The vote on the motion WAS CARRIED unanimously. Mr. Zeserson stated Ms . Simon had offered to serve as Vice Chairperson. Ms . Simon stated she would need assistance from Mr. Coogan/Mr. Rachun especially for the February 20`" Public Hearing but she is willing to do this . Mr. Porter made the MOTION for Ms .
