BOARD OF ZONING APPEALS

PRESENT : Chairman George Tselekis, BZA Members Andy Glasner,
Gerald VanOrden, Zoning Typist Robin Carlisle Peck
UNEXCUSED : Barbara Bristow, Carl Maim
Chairman George Tselekis called the meeting and a duly advertised public hearing to
order at 7 : 35pm .
Mr. Tselekis stated this meeting is a continuation of the meeting from August 16`h
hearing the application from Daniel Hotelling to reconfigure two contiguous lots he owns
to match the lot line with a drainage ditch. All of the members had agreed to view the
property which they did and then reconvene . There are currently no people in the
audience nor is the applicant here . They have not seen any changes at the sight nor have
they received any correspondence . He asked if the members of the board had any
comments .
Mr. Glasner stated he had no other comments, to reiterate a statement made last time .
If the proposed changes of the lots met the current criteria and the proposal was to reduce
the lot size to no longer meet the criteria of a similar magnitude he does not think they
would approve it. He is having a hard time approving the application making it farther
from compliance.
Mr. VanOrden stated it is a bizarre situation because it is 5 . 2 acres being taken down to 2
acres which is a significant reduction, the frontage is reduced from 216 feet to about 175
feet which is farther from compliance .
Mr. Tselekis stated he shares being uncomfortable making a non-compliant lot even less
compliant to make the lot line match a drainage ditch. The applicant considers it a natural
boundary vs . convenience but he is not convinced it is a powerful enough reason to grant
a variance . He asked the members if there was motion .
Mr. Glasner asked as a point of order if they needed to make a motion or just not act on
it.
Mr. Tselekis stated since the Board had met twice he felt it was their duty to act on the
application.
Mr. Glasner made the MOTION, seconded by Mr. VanOrden
WHEREAS, the variation is substantial in comparison to the requirement, and

WHEREAS, the application will make the variance more substantial with respect to the
required frontage.
WHEREAS, there is not a strong reason to grant the variance but rather a strong reason
to not grant the variance.
THEREFORE BE IT RESOLVED, the Town of Ulysses Board of Zoning Appeals
does NOT approve the variance to reconfigure two contiguous lots to match lot line with
a drainage ditch to Daniel Hotelling, 4290 Cold Springs Road, Trumansburg, NY 14886.

The motion was carried unanimously, variance is NOT APPROVED.
Mr. Tselekis asked if there was any other business .
Ms Carlisle Peck stated the minutes needed to be approved for July and August meetings .
Mr. Mann was present at the July meeting thus these will be tabled until he is in
attendance .
Mr. Glasner made a MOTION to approve the minutes of 08/ 16/06 , Mr. VanOrden
seconded. All in favor MINUTES Approved.
Mr. VanOrden motioned to adjourn, Mr. Glasner seconded, meeting adjourned at
9 : 45pm.
