JOHNSON, JR. , County Judge In the Matter of Foreclosure of Tax Liens, pursuant to Article Eleven Title 3 of the Real Property Tax JUDGMENT Law by the County of Tompkins 1969 Proceeding Ypon the list of delinquent taxes duly verified on the 1st day of May, 1969, and duly filed pursuant to Article Eleven Title 3 of the Real Property Tax Law of the State of New York, in the Tompkins County Clerk's office on May 1, 1969, and upon due proof that such notice was duly published after the filing of such list, once a week for six successive weeks in the Ithaca Journal and the Tompkins County Rural News, newspapers duly designated for that purpose by the collecting officer of the tax district and published in the said County of Tompkins; and upon due proof of the due posting of such Notice of Foreclosure, and of the due mailing thereof to the owners of the property affected thereby whose addresses were in the record and to other per- sons interested, and on reading the affidavit of Robert I. Williamson, County Attorney, sworn to on the Z3 4d day of 1k C e ' 1 , 1969, showing that more than twenty days have elapsed since the last date for redemption as set forth in the said Notice of Foreclosure, and that no answer has been filed or served herein; and it duly appearing that none of the parcels bearing Serial Numbers 1, 2, 3 and 4 have been redeemed or withdrawn, Notice of appearance by Peter A. Brevett, Attorney at Law, on behalf of Herman Hodgson, the owner of parcel Serial No. 1; and Robert I. Williamson, County Attorney, appearing for the County of Tompkins, and no one else appearing, except as above stated, and the allegations and proofs of the said County of Tompkins having been duly heard, and the decision of this Court having been duly signed and filed; NOW, upon Motion of Robert I. Williamson, Esq. , County Attorney, it is ROBERT I. WILLIAMSON COUNTY ATTORNEY -1- COURT 1COURT HOUSE ITHACA. N. Y. ORDERED, ADJUDGED AND DECREED, that all of the proceedings in this action were duly and properly taken pursuant to Article Eleven Title 3 of the Real Property Tax Law of the State of New York, and there has been full and due compliance with the provisions of such title; and it is further ORDERED, ADJUDGED AND DECREED, that the tax sale conducted by the County Treasurer of Tompkins County in October of 1963, and all proceedings prior thereto from and including the assessment of lands sold and all notices required by law for the redemption thereof insofar as they affect the lands involved in this proceeding were regular and in accordance with all the pro- visions of the law relating thereto, except that no formal redemption notice to occupants as provided for in and by Section 1022 of the Real Property Tax Law, was served upon the persons occupying the said parcels and no redemption notice as provided for in and by Section 1024 of the Real Property Tax Law was given to the record holders of the mortgages, if any, on any of said parcels; and it is further ORDERED, ADJUDGED AND DECREED, that the County of Tompkins is awarded the possession of every parcel of land described in the list of delinquent taxes not heretofore redeemed, being the parcels of land hereinafter more fully described, and D. A. Stobbs, County Treasurer of the County of Tompkins, New York, is hereby directed to prepare, execute and cause to be recorded a deed or deeds conveying to the said County of Tompkins full and complete title to the said parcels of land; and it is further ORDERED, ADJUDGED AND DECREED, that upon the execution and recording of the deed or deeds hereinbefore described, the County of Tompkins shall be seized of an estate in fee simple absolute in and to all the parcels of land therein described, and all persons, including the State of New York, infants, incompetents, absentees and non-residents, who may have had any right, title, interest, claim, lien, or equity or redemption in or upon such lands shall be barred and forever foreclosed of all such right, title, interest, claim, lien or equity or Aiedemption, and it is further ORDERED, ADJUDGED AND DECREED, that the following are the parcels of land to which the County of Tompkins shall receive possession, a deed and title ROBERT I. JOHNSON, JR. , County Judge In the Matter of Foreclosure of Tax Liens, pursuant to Article Eleven Title 3 of the Real Property Tax DECISION Law by the County of Tompkins 1969 Proceeding The issues in this action having regularly come on for trial, and having been heard and tried before the undersigned County Judge of the County of Tompkins, without a jury, at a special term of said court held on the —�'� day of 2 r_e4 .- , 1969, at the Court House, in the City of Ithaca, New York, and the County of Tompkins appearing by Robert I. Williamson, Esq. , Count Attorney, and no one else having appeared, and the allegations and proofs of th= county having been duly heard and due deliberation having been had, I do decide and find as follows: FINDINGS OF FACT 1. The County of Tompkins, Plaintiff, in this action, as of May 1, 1969, held and owned unpaid tax liens on the parcels of real property herein- after mentioned, which tax liens were, as of such date, unpaid for a period of at least four years or more after the date that the tax assessment or other legal charge represented thereby became a lien. The following is a statement of the serial numbers of the respective parcels of land involved in this action as to which the said County of Tompkins is entitled to judgment herein, a des- cription of each parcel, with the name of the last known owner of such parcel as the same appeared upon the assessment roll of the said county for the year 1968; being the year preceding the calendar year in which such list was made and filed, and a statement of the nature and the amount of each tax lien upon such parcel now held and owned by the County of Tompkins, including those which have become due and unpaid for less than four years, together with the date or ROBERT I. On the 13th day of November, 1939, pursuant to Section 162 of the Tax Law, the Board of Supervisors of Tompkins County duly adopted a resolution providing that from and after November 15, 1939, said county elected to adopt the provisions of Title 3 of Article 7-A of the Tax Law (now Article Eleven Title 3 of the Real Property Tax Law) of the State of New York, for the purpose of enforcing the collection of delinquent taxes in said county; and that a certified copy of said resolution was duly filed in the office of the County Clerk of the County of Tompkins, New York. At all times since November 15, 1939, said title of the Tax Law was and now is duly applicable to said county. 3. On the 1st of May, 1969, in due compliance with Section 1122 of the Real Property Tax Law of the State of New York, there was duly filed in the County Clerk's office of Tompkins County a list in due form and duly verified, of all parcels of property affected by unpaid tax liens held and owned by the County of Tompkins which were then unpaid for a period of at least four years, ROBERT I. Y. thereby became a lien, and the parcels hereinabove mentioned were duly scheduled on such list. A certified copy of such list was also duly filed on the said day in the office of the collecting officer of the said County of Tompkins, to wit: in the office of the County Treasurer, thereof, and also on said day filed in the office of Robert I. Williamson, County Attorney of Tomp- kins County and in the office of the Town Clerk of Ithaca, Edward Riley, City of Ithaca, New York, also in the office of the County Clerk, County of Tompkins, Ithaca, New York. 4. The collecting officer of the County of Tompkins, to wit: the County Treasurer, following the filing of the list of delinquent taxes as aforesaid, duly caused to be published a Notice of Foreclosure in due form once a week for six successive weeks in the Ithaca Journal and in the Tompkins County Rural News, being two newspapers designated by him and for the purpose and published in the tax district. The said Notice of Foreclosure was duly published as prescribed by Section 1124 of the Real Property Tax Law of the State of New York in the said Ithaca Journal and in the said Tompkins County Rural News on May 8, 15, 22, 29 and June 5 and 12, 1969. A copy of the said Notice of Fore- closure so published was duly posted on or before the 1st day of May, 1969, in the office of the Collecting Officer in the County Court House in Tompkins County and in four other conspicuous places within such tax district, to wit: On the bulletin _board in the County Court House in the City of Ithaca, County of Tompkins on May 1, 1969; in the office of the Town Clerk, Lois Baker, Town of Groton, Groton, New York, in said County on May 2nd, 1969; in the office of the Town Clerk, Jane C. Bush, Town of Lansing, South Lansing, New York, in the said County on May 2nd, 1969; and in the office of the Town Clerk of Ithaca, Edward Riley, City of Ithaca, New York, in said County on May 2nd, 1969. 5. A copy of such Notice of Foreclosure was duly mailed on the 1st day of May, 1969, to the last known address of each owner of property affected thereby, as the same appears upon the records of the said collecting officer of said County of Tompkins, and each notice so mailed was accompanied by a statement in due form as provided by the last paragraph of Section 1124 of the Real Property Tax Law of the State of New York. 6. The Tax Sale conducted by the County Treasurer of Tompkins County in October, 1963, and all proceedings prior thereto, from and including the assessment of lands sold and all notices required by law to be given previous to the expiration of the time allowed by law for the redemption thereof ubsifar - as they affected the lands involved in this proceeding, were regular and in accordance with all the provisions of law relating thereto and particularly in accordance with the provisions of Article X of the Real Property Tax Law. 2. All of the proceedings in this action for foreclosure of tax liens of the County of Tompkins were regular and were in compliance with Article Eleven Title 3 of the Real Property Tax Law of the State of New York, and there has been due and full compliance by the tax district with the provisions of such title. 3. The tax district herein, to wit: The County of Tompkins is entitled to final judgment awarding to it the possession of the parcels hereinabove specifically described bearing Serial Numbers 1, 2, 3 and 4 directing its collecting officer, to wit: its County Treasurer to convey to said county by proper deed full and complete title to the said parcels as provided by Section 1136 of the Real Property Tax Law. .. -&2�2r i s qua a County Jud e ROBERT I. Y. • y STATE OF NEW YORK COUNTY COURT • COUNTY OF TOMPKINS In the Matter of Foreclosure of Tax Liens, pursuant to Article Eleven Title 3 of the Real Property Tax Law by AFFIDAVIT OF the County of Tompkins REGULARITY 1969 Proceeding STATE OF NEW YORK ) ) ss. : COUNTY OF TOMPKINS ) ROBERT I. WILLIAMSON, being duly sworn, deposes and says: 1. That he is the Attorney for the County of Tompkins, the tax district which instituted the above entitled action; and that he is familiar with all the steps and proceedings taken and had therein. 2. That this action is an action in rem for the foreclosure of tax liens by the County of Tompkins, pursuant to Article Eleven Title 3 of the Real Property Tax Law. 3. That on the 13th day of November, 1939, pursuant to §162 of the Tax Law, the Board of Supervisors of the County of Tompkins duly adopted the following resolution, to wit: "That from and after November 15, 1939, the County of Tompkins elects to adopt the provisions of Title 3 of Article 7-A of the Tax Law for the purpose of enforcing the collection of delinquent taxes in such county." Note: Article 7-A, Title 3 of the Tax Law, is now Article Eleven Title 3 of the Real Property Tax Law. and a certified copy of said resolution was duly filed in the office of the Clerk of the County of Tompkins. At all times since November 15, 1939, the provisions of said Title 3 of Article 7-A of the Tax Law (now superseded by Article Eleven Title 3 of the Real Property Tax Law) were and they now are applicable to said county. 4. That on the 1st day of May, 1969, D. A. Stobbs, the County Treasurer and collecting officer of Tompkins County Tax District, filed in the office of the Clerk of the County in which the property subject to said tax liens is situated, to wit: the office of the County Clerk of Tompkins ROBERT I. WILLIAMSON County, a list of all parcels of property affected by unpaid tax liens held COUNTY ATTORNEY COURT HOUSE -1- ITHACA. N. Y. s ` • and owned by such tax district which on said date had been unpaid for a period of at least four years or more after the date when the tax assessment or other legal charge represented thereby became a lien. Sucn parcels were numbered serially 1, 2, 3 and 4. That the said D. A. Stobbs filed a certified copy of such list in his own office and in the office of deponent. 5. Upon information and belief that upon filing of such list in the office of the County Clerk, D. A. Stobbs, the collecting officer, forthwith caused a Notice of Foreclosure, in substantially the form set forth in §1124 of the Real Property Tax Law, to be published at least once a week for six suc- cessive weeks in two newspapers designated by him and published for the tax district, to wit: The Ithaca Journal, published at Ithaca, New York, and the Tompkins County Rural News, published at Dryden, New York, as more fully appears by the proofs of publication on file in the Tompkins County Clerk s office. 6. Upon information and belief, and more fully appears by the affidavits on file in the office of the County Clerk, said D. A. Stobbs, the collecting officer, on or before the date of the first publication of the said Notice of Foreclosure caused a copy of such notice to be posted in the office of the collecting officer, in the Tompkins County Court House, and in four other conspicuous places within such tax district, to wit: On a bulletin board in the County Court House in the City of Ithaca, County of Tompkins on May 1, 1969; in the office of the Town Clerk, Lois Baker, Town of Groton, Groton, New York, in said County on May 2nd, 1969; in the office of the Town Clerk, Jane C. Bush, Town of Lansing, South Lansing, New York, in the said County on May 2nd, 1969; and in the office of the Town Clerk of Ithaca, Edward Riley, City of Ithaca, New York, in said County on May 2nd, 1969, and caused a copy of such notice, together with a copy of the statement required by §1124 of the Real Property Tax Law, to be mailed to the last known address of each owner of property affected thereby, as the same appears upon the records in the office of deponent, except the owner of the parcel of property described in the list of delinquent taxes referred to in said notice bearing Serial No. 3 and as to such parcel deponent further says that the name and address of the owner there- ROBERT I. The last day of redemption as stated in said Notice of Fore- closure was on the 30th day of June, 1969, and the parcels described on the said list bearing Serial Numbers 1, 2, 3 and 4 have not been redeemed or with- drawn. Notice of appearance has been served by Peter A. Brevett, Attorney at Law, on behalf of Herman Hodgson, the owner of parcel Serial No. 1. 8. All affidavits of filing, publication, posting, mailing and acts required to be performed by the said Article Eleven, Title 3, of the Real Property Tax Law, in the matter of the prosecution of this proceeding have been heretofore duly filed in the office of the County Clerk of the County of Tomp- kins, that being the County in which the parcels of property subject to the tax- liens sought to be foreclosed are situated. WHEREFORE, deponent requests that pursuant to the statutes in such cases made and provided, a judgment of foreclosure be rendered and entered herein, directing the collecting officer of the County of Tompkins to prepare, execute and cause to be recorded a deed conveying to the County of Tompkins full and complete title to all parcels on the list of delinquent taxes which have not been redeemed or withdrawn and concerning which no answer has been interposed, to wit: Serial Numbers 1, 2, 3 and 4. /2 ,6A-)i/liz-i7VJexl Ro.ert I.
