As far as we are able to project at this time,, this project should meet the needs of Cortland Asphalt's Emulsion Mi'll (ani onic) and Micro/Slurry Mill (cationic) for the next 5 to 10 years, The following is a summary for each of the two facilities: 1, Emulsion Mill (anionic). Suit-Kote's Major Petroleum Facility License #7-2280 will be amended, as required by the terms of the permit, ante the tanks have been installed. A permit modification application for the Air State Facility Permit associated with this facility has been submitted to the New York State Department of Environmental Conservation, Division of Air Resources, This permit modification application addresses potential odor concerns and mitigation. The current SPDES permit for this facility will not need to be modified. Vehicular traffic will not increase due to this project. Polkville Ten-ninal Facility.. The Conditional Permit application package titled "Suit- Kote Corporation, Polkville Terminal Facility; S Year Plan Modification Request for Build -Out,"' submitted on or about June I5, 2007, is the culmination of the S Year Plan which was originally approved by the Town of Cortlandville Planning Board's resolution #117 of 2003 on December 301, 2003., This resolution approved the construction of asphalt storage tanks containing a maximum of 15,000,000 gallons. During the following three years, the project was modified twice to change the configuration of the tanks and to allow the relocation of the polymer -modified process from the Loring Crossing facility to the Terminal. The total number of gallons of storage was never changed. The cuzTent application seeks only to modify the original plan one more time in order to allow for one large tank (6 million gallons) rather than the remaining two tanks (3 million gallons) which were originally approved. The total number of gallons stored will be 14,999,000 gallons rather than the 15,000,004 gallons which were originally approved. Suft-Kote has no plans for any further expansion at this facility. The current operational area will be built -out ante the proposed tank has been constructed. The only tank that is requested in this application is tank #10, a 6,000,000 gallon asphalt cement storage tank. Environmental impacts are addressed in the State Environmental Quality Review Act SHORT ENVIRONMENTAL ASSESSMENT FORM for unlisted actions which was attached to the original application. The proposed project complies with the existing zoning law. The current land use in the vicinity remains unaffected. Suit-Kote's Major Petroleum Facility License #7-2300 will be amended, as required by the terms of the permit, ante the tanks have been installed. A permit modification application for the Air State Facility Permit associated with this facility isnot required since the proposed tank change was anticipated at the time of the last modification. If we decide to reconfigure the carbon adsorption units (add units or change which units are connected to which tank), we will request a modification to the existing Air State Facility Permit. The current permit addresses potential odor concerns and mitigation. Vehicular traffic will not increase due to this project. Polkville Crushed Stone. Even though Suit,-Kote is not requesting any changes to its Polkville Crushed Stone facility at this time,, I have enclosed a copy of the current Mined Land Reclamation Permit (ID 7-1122-00049/00001) and the Mining Flan map M4 for your reference. Town of Coillandville Planning Board August 17, 2007 Page 3 Suit-Kote has taken many steps over the years, ranging ftom the implementation of best management practices to hardware installation, to reduce the potential impact of odors on our neighbors. We will continue to do this in the future. This will be discussed further in the answer to item, #8. 4. Loring Crossing Facility,, Conditional Permit A"lication Dated December 8,, 2007 (Replace 5 Tanks; Add a 1444 Sq. Ft. Addition to'the Maintenance Shop-, and Add 3 Fuel Tanks with Containment., I have attached a copy of Suit-Kote's Major Petroleum Facility License, #07-2280 as amended to add tanks #046, 047 and 048. Suit-Kote was not required to amend its Air State Facility Permit or SPDES Permit. I have attached letters from NYSDEC to that effect. Polkville Asphalt Verminal, Conditional Permit Aoa�lication Dated February 15, 2007 Modification Request for Five -Year Plan for the Installation of Two Additional Asphalt. Storaj4e Tanks, a Polymer Modified Asphalt Work Area w/Preheat Tanks, a Material. Storage Bufldin2, and an Additional (2"d ) Fuel Tank)_ I have attached a copy of Suit- Kote's Major Petroleum Facility License #07-2300 as amended to add tanks #8C and 8D. I have also attached the portion of Suit-Kote's Air State FactyiliPermit (ID 7-1122- 00049/0003 1) which shows the Emission Unit and Process Description corresponding to the addition of tanks #8C & 8D. A copy of SPDES Discharge Permit #7-1122-00049- 00429 covering the referenced facility modifications is also attached. 5. I have enclosed a copy of the DEVELOPMENT PERMIT FOR FLOOD HAZARD AREAS, (APPLICATION), dated December 8, 2006 as submitted to the 'Town of Cortlandville Planning Board on or about December 12, 2006 and granted by Bruce Weber. 6. Loring Crossing Facility,, The Cortland County Planning Board has unanimously approved this project subject to four conditions, including "4. a negative declaration of environmental impact under SEQR." In reference to Part II of the SHORT ENVIRONMENTAL ASSESSMENT FORM INCLUDED WITH Suit-Kote's application, Suit -Kate submits the following answers: A. No B. Since the first public meeting regarding this pr0ject took place, there has been an increase in the number of odor complains received from people in the community when compared to both the time in 2007 immediately prior to the meeting and previous years. In the past, Suit-Kote has attempted to respond to founded complaints and we will continue to do so in the future. Polkville Terminal Facility. In the past, Suit-Kote has attempted to respond to founded complaints and we will continue to do so in the future. 7., Under the Freedom of Information Law (FOIL), The Cortland County Health Department (CCHD) has provided Suit,-Kote with redacted copies of individual odor complaints in the form of "Complaint Infom-iation" sheets for the past five years. They do not give the name of the complainant and they show the action taken by the CCHD, not that taken by Suit-Kote, Copies of these sheets have been provided in exactly the same form in which they were received. In most cases, these complaints were not transmitted directly to Suit-Kote, but rather to NYSDEC in Syracuse. Even though the FOIL request addressed complaints regarding odors, spills and dust, the complaints received pertained only to odors. Approximately 32% of the complaints received by CCHD resulted in a field visit by CCHD. Approximately 14% of the total number of Town of Cortlandville Planning Board August 17, 2007 Page 7 laints received by CCHD were believed by CCHD to be related to one of Suit- compKote's facilities. Also Suit-Kote constantly makes improvements to processes, equipment, and procedures in order to minimize odors. The following is a de.:qcrinfion of actions taken bv Suit -Dote to eliminate odors from the Loring Crossing and Polkville facilities: Loring Crossing Facility A. Vent pipes from the tanks for the modified asphalt facility were brought to the ground in order to keep releases out of the air stream. B. Carbon adsorbers (2) were installed at the modified asphalt facility in 1997 in order to minimize emissions from asphalt tanks (#54, 51, 52and 53), moded asphalt hanks (#38, 80, 81, 82, 83,84 and 85), mi ifx-tanks, and the loading rack. See enclosed sheet regarding modular vapor phase adsorber. co In 1998, an engineering study was performed to evaluate the sources of potential odors. D. In 1988,, a public outreach program was implemented to receive and respond to odor complaints E. Conservation vents with rupture disks were installed on asphalt storage tanks (#22, 23 and 24) at the emulsion mill in 1997. F. Various changes to emulsion loading procedures have been made over the years including submerged loading and keeping dome covers closed as far as possible during loading. G. Vent pipes from the tanks for the modified asphalt facility were brought to the ground in order to keep releases out of the air stream. B. Carbon adsorbers (2) were installed at the modified asphalt facility in 1997 in order to minimize emissions from asphalt tanks (#54, 51, 52and 53), moded asphalt hanks (#38, 80, 81, 82, 83,84 and 85), mi ifx-tanks, and the loading rack. See enclosed sheet regarding modular vapor phase adsorber. co In 1998, an engineering study was performed to evaluate the sources of potential odors. D. In 1988,, a public outreach program was implemented to receive and respond to odor complaints E. Conservation vents with rupture disks were installed on asphalt storage tanks (#22, 23 and 24) at the emulsion mill in 1997. F. Various changes to emulsion loading procedures have been made over the years including submerged loading and keeping dome covers closed as far as possible during loading. G. B s, Carbon adsorption units have been installed on all asphalt storage tanks and on the loading stations at both loading platforms. C. Procedures have beenput in place to insure that rail cars which are being heated are monitored frequently for temperature and that dome covers are opened only as -far -as necessary in order to minimize tank breathing losses. An additional person has been hired to monitor the unloading of railcars and make sure that the proper procedures are followed. D. Submerged loading is used when loading transport trailers. Vapor collection hoses have been attached to the loading spouts so that they go down into the talc to collect any fugitive vapors during the loading process. Burlap is then draped over the manhole to prevent vapors from escaping but when the loading is almost complete, it can easily be pulled back to allow the driver to see how much asphalt is in the trailer. E. O'Brien & Gere has done a study regarding capture efficiency at the polymer loading rack. F. O'Brien & Gere has also done a vapor capture study for tank #6 and the recommendations of that report have been implemented. 9.
