HomeMy WebLinkAboutI - 05 County Resolution 22-01 - David Yaman Aquifer ON THE MOTION OF Amy Bertini RESOLUTION NO. 22-01 Emma Hans GML# 95.00-10-01.1 & 95.00-10-11.2 Town of Cortlandville Subdivision, Conditional Permit & Aquifer Protection Special Permit David Yaman WHEREAS, on December 21, 2021 the Zoning Officer, Town of Cortlandville, pursuant to General Municipal Law 239 M & N submitted an application for subdivision, conditional permit, & aquifer protection special permit because the property is located within 500 feet of NYS Route 13, AND WHEREAS, the Cortland County Planning Department has reviewed this request and submitted a written report dated January 14, 2022, which is on file, AND WHEREAS, the Cortland County Planning Board on January 19, 2022, held a regular meeting with a quorum and did consider this request, AND WHEREAS, the Cortland County Planning Board did thoroughly consider the material submitted by the petitioner, Department comments and all other relevant reports on file, NOW THEREFORE BE IT RESOLVED, that the Board recommends approval of this application for subdivision, conditional permit, & aquifer protection special permit to construct a multi-phased warehouse/manufacturing facility; one 38,000 square foot building, four 30,000 square foot buildings and one 20,000 square foot building, with associated driveways, parking areas, loading docks, utility services, stormwater management facilities and landscaping. The approval of this application is contingent upon the following: 1. that a final subdivision plan be presented to the Town in conformance with section 140-9 of the Code of the Town of Cortlandville. 2. that right of way language be added into the deeds of both parcel 95.00-10- 01.100 and the newly proposed development parcel. 3. that the applicant apply for and obtain a conditional permit, for each phase of the project in order to ensure compliance with Code of the Town of Cortlandville. 4. that a lighting plan be submitted to the Town to ensure adequate lighting is provided for all thoroughfares. 5. that the Town consider if pedestrian and non-motorized access to the site is adequate. 6. that a Storm Water Pollution Prevention Plan (SWPPP) is presented to the Town in compliance with section 178-92 of Code of the Town of Cortlandville. 7. that a Storm Water Pollution Prevention Plan (SWPPP) be submitted to NYS Department of Environmental Conservation (NYSDEC) for review and obtain NYSDEC approval prior to disturbing more than 5 acres. 8. that a Traffic Impact Study for the full build be presented to both the Town and NYSDOT. 9. that the applicant obtain a permit from NYSDOT for any work within the state right of way. 10. that the applicant continue coordination with NYSDEC to ensure development does not interfere with NYSDEC Environmental Site Remediation number 712006. 11. compliance with SEQR requirements., AND BE IT FURTHER RESOLVED, that the Board reminds the Town of Cortlandville the requirements of General Municipal Law Section 239 M & N that a supermajority vote is to be attained by the Town in order to approve this application unless every contingency documented in this resolution is followed, AND BE IT FURTHER RESOLVED, that the Planning Department is hereby authorized to convey this action to the Zoning Officer, Town of Cortlandville. _______________________________ Wendy Miller, Secretary Cortland County Planning Board January 19, 2022 Ayes: 9 Nays: 0
