Y . , on Tuesday , July 26 , 1977 , at 7 : 30 p . m . PRESENT : Chairman Peter K . Francese , Vice - Chairman Jack D . Hewett , Edward W . King , Edward N . Austen , Robert Bonnell ( Assistant to the Engineer ) . ALSO PRESENT : The Ignacio Serrano Family , Mrs . Raymond Sheldrake , Mrs , Virginia Lasly , Mr . Millard Brink , Mr . Jim Stefanis , Mr . . Fer. nando Macera . Chairman Francese opened the meeting at 7 : 30 p . m . APPEAL OF IGNACIO SERRANO , APPELLANT , FROM THE DECISION OF THE BUILDING INSPECTOR DENYING PERMIT FOR SIGN EXCEEDING TWO SQUARE FEET AT 1362 MECKLENBURG ROAD , TAX PARCEL NO . 6 - 27 - 1 - 15 , ITHACA , N . Y . PERMIT IS DENIED BY THE BUILDING INSPECTOR UNDER SECTION 6 , PARAGRAPHS 1 ( c ) AND 1 ( d ) OF THE TOWN OF ITHACA SIGN ORDINANCE . Chairman Francese declared the Public Hearing in the above - noted matter duly opened at 7 : 30 p . m . , and accepted for the record the Town Clerk ' s Affidavit of Posting and Publication of the Notice of Public Hearing in Town Hall and the Ithaca Journal on July 15 and July 21 , 1977 , respectively , together with the Secretary ' s Affidavit of Service by Mail of said Notice upon the party on July 19 , 1977 . The application for sign permit dated June 1977 , showing a proposed hanging sign 4 ' x 3 ' and containing the words " La Cabrera " and a picture of a goat , was also entered into the record . Messrs . Macera and Serrano appeared before the Board and stated that the sign is to be located 15 ' to 20 ' back from the road . The sign is inlaid . The sign is not an eyesore . The sign is 4 ' x 3 ' - - 12 sq . ft . They stated that Laura Neus had written an article about the Serrano goat farm in the July 6 , 1977 , edition of the Midweek Observer . MOTION by Mr . Edward Austen , seconded by Mr . Peter Francese : RESOLVED , that the Zoning Board of Appeals of the Town of Ithaca grant and hereby does grant a variance to the requirements of the Town of Ithaca Sign Ordinance to allow for the erection of a 12 sq . ft . sign containing the words " La Cabrera " and a picture of a goat , at 1362 Mecklenburg Road , Town of Ithaca Tax Parcel No . 6 - 27 - 1 - 15 , owned by Ignacio Serrano . There being no further discussion , the Chair called for a vote . Aye - Francese , Hewett , King , Austen . Nay - None . The MOTION was declared to be carried unanimously . RAYMOND SHELDRAKE , APPELLANT , FROM THE DECISION OF THE BUILDING INSPECTOR DENYING PERMIT FOR SIGN EXCEEDING TWO SQUARE FEET AT 806 ELMIRA ROAD , TAX PARCEL NO , 6 - 33 - 1 - 6 , ITHACA , N . Y . PERMIT IS DENIED BY THE BUILDING INSPECTOR UNDER SECTION 6 , PARAGRAPHS 1 ( c ) AND 1 ( d ) OF THE TOWN OF ITHACA SIGN ORDINANCE . Chairman Francese declared the Public Hearing in the above - noted matter duly opened at 7 : 40 p . m . , and accepted for the record the Town Clerk ' s Affidavit of Posting and Publication of the Notice of Public Hearing in Town Hall and the Ithaca Journal on July 15 and July 21 , 1977 , respectively , together with the Secretary ' s Affidavit of Service by Mail of said Notice upon the party on July 19 , 1977 . The application for sign permit dated May 24 , 1977 , showing a proposed sign reading " Early Bird Farm " and a temporary changeable message sign approximately 4 ' x 2 ' , was also entered into the record , Mrs . Sheldrake appeared before the Board and stated that their open house is the first weekend after Thanksgiving . They have a 6 ' x 6 " sign reading " Early Bird Farm " and they also have a temporary sign that is up for one month announcing " Poinsettias " . She stated that the sign does not stay on the premises all the time , The one -month sign measures approximately 4 ' x 2 ' . Mr . Bonnell pointed out that there is another sign which reads " Welcome to Ithaca " . . Mr . Francese asked if the application can be amended to add the " Welcome to Ithaca " sign ? Mr . Bonnell did not know if that was possible , The Board felt that the " Welcome to Ithaca " sign ® offered a nice service to the community , MOTION by Mr . Peter Francese , seconded by Mr . Edward Austen : RESOLVED , that the Zoning Board of Appeals of the Town of Ithaca grant and hereby does grant a variance to the requirements of the Town of Ithaca Sign Ordinance to allow for the issuance of a permit to Mrs . Raymond Sheldrake to continue to maintain the sign located on the tele - phone pole at the northeast corner of the home located on Town of Ithaca Tax Parcel No . 6 - 33 - 1 - 6 , and which reads " Early Bird Farm " and has a changeable message attachment of 4 ' x 4 ' for seasonal sales ; the " Early Bird Farm " sign not exceeding 5 ' x 11 . There being no further discussion , the Chair called for a vote , Aye - Francese , Hewett , King , Austen , Nay - None . The MOTION was declared to be carried unanimously . APPEAL OF MARTHA ' S FLEA MARKET , LOUIS AND MARTHA MOBBS , APPELLANTS , FROM ® THE DECISION OF THE BUILDING INSPECTOR DENYING PERMIT FOR SIGN EXCEEDING TWO SQUARE FEET BETWEEN 619 AND 621 FIVE MILE DRIVE , TAX PARCELS NO . 6 - 31 - 2 - 28 AND 6 - 31 - 2 - 27 , ITHACA , N . Y . PERMIT IS DENIED BY THE BUILDING INSPECTOR UNDER SECTION 6 , PARAGRAPHS 1 ( c ) AND 1 ( d ) OF THE TOWN OF ITHACA SIGN ORDINANCE , Chairman Francese declared the Public Hearing in the above - noted Zoning Board of Appeals - 3 - July 26 , 1977 matter duly opened at 7 : 50 p . m . , and accepted for the record the Town Clerk ' s Affidavit of Posting and Publication of the Notice of Public Hearing in Town Hall and the Ithaca Journal on July 15 and July 21 , 1977 , respectively , together with the Secretary ' s Affidavit of Service by Mail of said Notice upon the parties on July 19 , 1977 . " , and indicating that the sign is on wheels and is to .. be . parked 30 ' from the highway edge , and is in place from 9 : 00 to 5 : 00 on Saturdays and Sundays from June to September , and that to prevent theft is wheeled away from highway 120 ' nights and remaining days , and is stored in the barn October to May , was also entered . Mr . Bonnell noted that the sign is located on Route 13A . MOTION by Mr . Peter Francese , seconded by Mr . Jack Hewett : RESOLVED , that the Zoning Board of Appeals of the Town of Ithaca grant and hereby does grant a variance to the requirements of the Town of Ithaca Sign Ordinance to permit the Appellants , Louis and Martha Mobbs , to have a 2 ' x 6 ' sign which reads " Martha ' s Flea Market Sat . Sun . " , located between 619 and 621 Five Mile Drive , Tax Parcels No . 6 - 31 - 2 - 28 and 6 - 31 - 2 - 27 , said sign being on wheels and may be wheeled to within 30 ' of the highway edge so as to be visible from the highway , as per the sign permit application dated June 8 , 19770 There being no further discussion , the Chair called for a vote . ® Aye - Francese , Hewett , King , Austen . MITCHELL STREET , TAX PARCEL N0 , 6 - 60 - 1 - 7 , ITHACA , N . Y . PERMIT IS DENIED BY THE BUILDING INSPECTOR UNDER SECTION 6 , PARA - GRAPHS 1 ( c ) AND 1 ( d ) OF THE TOWN OF ITHACA SIGN ORDINANCE . Chairman Francese declared the Public Hearing in the above - noted matter duly opened at 8 : 00 p . m . , and accepted for the record the Town Clerk ' s Affidavit of Posting and Publication of the Notice of Public Hearing in Town Hall and the Ithaca Journal on July 15 and July 21 , 1977 , respectively , together with the Secretary ' s Affidavit of Service by Mail of said Notice upon the party on July 19 , 1977 . The application for sign permit dated June 23 , 1977 , with attached pictures of the sign and premises , was also entered into the record . Mr . Millard Brink appeared before the Board as the representative of the New York Holstein - Friesian Association , Inc . and stated that he is a State Director of the Association and is also on the local Tompkins County Association Board . He stated also that - it is a non - profit association . Mr . Brink stated that the sign is located 15 ' from the road . and is on a post and is 3 ' 8 " high and 5 ' 4 " wide for a total of 19 - 1 / 2 sq . ft . MOTION by Mr . Peter Francese , seconded by Mr . Edward Austen : Zoning Board of Appeals - 4 - July 26 , 1977 RESOLVED , that the Zoning Board of Appeals of the Town of Ithaca grant and hereby does grant a variance to the requirements of the Town of Ithaca Sign Ordinance to permit the Appellants , New York Holstein - Friesian Association , Inc . , to continue maintenance of a sign 318 " x 51411 , reading " New York Holstein Ass ' n " and containing a picture of a cow , and which is located approximately 15 ' from the road at 957 Mitchell Street , Town of Ithaca Tax Parcel No . 6 - 60 - 1 - 7 . There being no further discussion , the Chair called for a vote . Aye - Francese , Hewett , King , Austen . Nay - None . The MOTION was declared to be carried unanimously .
