NOVEMBER 17 , 1976
A meeting of the Town of Ithaca Zoning Board of Appeals was held
in the Town of Ithaca Town Hall , 126 East Seneca Street ( second floor ) ,
Ithaca , N . Y . , on Wednesday , November 17 , 1976 , at 7 : 30 p . m .
PRESENT : Chairman Peter Francese , Laurene Ripley , Edward W . King ,
Edward N . Austen , Lawrence P . Fabbroni ( Building Inspector ) .
ALSO PRESENT : Frank S . Falcone , Mr . and Mrs . Bruce Turnbull ,

Chairman Francese called the meeting to order at 7 : 38 p . m .
APPEAL OF FRANK S . FALCONE , APPELLANT , FROM THE DECISION OF THE BUILDING
INSPECTOR DENYING BUILDING PERMIT FOR THE CONSTRUCTION OF AN ADDITIONAL
BATHROOM LESS THAN 15 FEET FROM SIDE LOT. LINE AT 121 CHRISTOPHER CIRCLE ,
PARCEL N0 , 6 - 71 - 1 - 17 , ITHACA , N . Y . PERMISSION IS DENIED BY THE BUILDING
INSPECTOR UNDER ARTICLE IV , SECTION 14 OF THE TOWN OF ITHACA ZONING
ORDINANCE . . . . . . . . . . .
Chairman Francese declared the Public Hearing in the above - noted
matter duly opened at 7 : 38 p . m . , and accepted for the record the Town
Clerk ' s Affidavit of Posting and Publication of the Notice of Public
Hearings in Town Hall and the Ithaca Journal on November 10 and November
12 , 1976 , respectively , together with the Secretary ' s Affidavit of Ser -
vice by Mail of said Notice upon the neighbors and the party on Novem-
ber 15 , 1976 . Mr . Francese read aloud the Appeal as published in the
Newspaper and, as noted above . The Appeal Form signed by Frank S .
Falcone , dated November 9 , 1976 , reading as follows , was also entered
into the record together with an attached plot plan of the property in
question , the existing house , and the proposed bathroom addition .
" . . . . Having been denied permission to build an additional bath less
than 15 feet from side line at 121 Christopher Circle , . . . . in violation
of Section 14 of the Town of Ithaca Zoning Ordinance . . . PRACTICAL DIFFI -
CULTIES and / or UNNECESSARY HARDSHIP as follows :
We have a family of four , with two school - age children , and two
working adults . We need a second bath , and the only way to add one
is to build off the eastern side of the house . Any other direction
would ruin the architectural design of the house and make it difficult
to resell , if we ever wanted to move .

Mr . Fabbroni stated that the proposed bathroom addition lies 6 "
} short of the side yard requirement , i . e . , 1416 " from the side lot line .
Mr . King noted that the area is zoned R - 15 .
Mr . Falcone stated that his home is a one - story house and the
addition is to be one - story . Mr . Falcone stated that Mr . Herman

Eckelmann has no problem with this addition . He stated that there is a
garden in between his ( Eckelmann ' s ) house and his ( Falcone ) . Mr .
Falcone pointed out that no Health Department approvals are required in
a case such as this .
Chairman Francese asked if anyone wished to speak for or against
this request from the floor . No one answered . Mr . Francese asked the
Board if there were any questions . There were none .
MOTION by Mr . Edward King , seconded by Mr . Edward Austen :
RESOLVED , that the Zoning Board of Appeals of the Town of Ithaca
grant and hereby does grant a variance to the requirements of the Town
of Ithaca Zoning Ordinance , Section 14 , to allow for the issuance of a
building permit to Mr . Frank S . Falcone for the construction of a bath -
room addition to within 1416 " of the east side lot line of Town of
Ithaca Tax Parcel No . 6 - 71 - 1 - 17 , 121 Christopher Circle , Ithaca , New
York .
There being no further discussion , the Chair called for a vote .

Nay - None .
The MOTION was declared to be carried unanimously by the Chair .
Chairman Francese declared the Public Hearing in the matter of

APPEAL OF BRUCE W . TURNBULL , APPELLANT , FROM THE DECISION OF THE BUILDING
INSPECTOR DENYING CERTIFICATE OF COMPLIANCE FOR PROPERTY LOCATED AT
118 PINE TREE ROAD , PARCEL NO . 6 - 58 - 2 - 21 , ITHACA , N . Y . PERMISSION IS
DENIED BY THE BUILDING INSPECTOR UNDER ARTICLE IV , SECTION 14 AND
ARTICLE XIV , SECTION 76 OF THE TOWN OF ITHACA ZONING ORDINANCE .
Chairman Francese declared the Public Hearing in the above - noted
matter duly opened at 7 : 45 p . m . , and accepted for the record the Town
Clerk ' s Affidavit of Posting and Publication of the Notice of Public
Hearings in Town Hall and the Ithaca Journal on November 10 and November
12 , 1976 , respectively , together with the Secretary ' s Affidavit of Ser -
vice by Mail of said Notice upon the neighbors and the party on Novem-
ber 15 , 1976 . Also entered into the record was the Appeal Form dated
November 9 , 1976 , signed by Mr . Bruce W . Turnbull , reading as follows ,
to which was attached a Tape Check and Map of the property known as
118 Pine Tree Road , as prepared by Leonard Miscall , P . E . & L . S . , and
dated July 27 , 1976 :
" . . . Having been denied permission to receive a Certificate of Compliance
. 118 Pine Tree Road ( Tax Parcel 6 - 58 - 2 - 21 ) . . . in violation of Sections
142 76 of the Town of Ithaca Zoning Ordinance . . . . PRACTICAL DIFFICULTIES
and / or UNNECESSARY HARDSHIP as follows : Having bought the property on
July 30 , 1976 , a tape check revealed at the time of closing that the
® house was situated 9 feet from the side line instead of 15 feet as
a required . I respectfully request that you grant a variance for this
hardship of which I had no prior knowledge . "
Mr . Turnbull stated that he has lived in this home since July 30 ,
1976 .

Zoning Board of Appeals - 3 - November 17 , 1976
Mr . Austen asked how old this house is . Mr . Turnbull replied that
it was built in 1961 ( Permit # 523 , 8 / 30 / 61 ) .
® Mr . Francese noted that to the south there are no houses within
5001 ; to the north Mr . Turnbull ' s home is located 9 ' from the side lot
line ; the area is zoned R - 15 which required a 15 ' side yard .
Mr . King stated that the problem is that if this Board accepts every
" fait accompli " - - where does the Zoning Ordinance stand ? Mr . King
stated that he thought that the Board should refer this matter to the
Town Attorney for investigation and possible prosecution .
Mr . Francese stated that he agreed - - to a certain extent - - however ,
he stated that he thought that the Board has before them a situation
very similar to one which this Board in the very recent past , Schneeweiss ,
granted a variance . ( May 17 , 1976 ) . Mr . Francese stated that it was his
opinion that the granting of a variance to allow the Building Inspector
to issue a Certificate of Compliance to Mr . Turnbull would not jeopardize
the prosecution of the responsible parties .
MOTION by Mr . Edward King , seconded by Mr . Edward Austen :
RESOLVED , that the Zoning Board of Appeals of the Town of Ithaca
table and hereby does table the matter of the Appeal of Bruce W . Turnbull
and that said matter be referred to the Town Attorney for investigation
as to the possibility of bringing prosecution against the builder or
original owner or whoever may be found responsible for not having com-
plied with the application for Building Permit dated 8 / 24 / 61 which
® shows a 15 ' side lot line instead of the 9 ' this Board sees now .
There being no further discussion , the Chair called for a vote .

The MOTION was declared to be a tie vote and therefore not carried .
MOTION by Mr . Peter Francese , seconded by Mrs . Laurene Ripley :
RESOLVED , that the Zoning Board of Appeals of the Town of Ithaca
grant and hereby does grant a variance to the side yard requirements
of R- 15 Residential District , Section ; 14 , to allow for a nine foot
north side yard at Parcel No . 6 - 58 - 2 - 21 ., . 118 Pine Tree Road , Ithaca ,
New York , and , therefore , to permit the Building Inspector of the Town
of Ithaca to issue a Certificate of Compliance to Mr . Bruce W . Turnbull ,
present owner of said Parcel , and , further
BE IT RESOLVED , that a letter be written by Mr . Fabbroni , Building
Inspector , to Mr . James V . Buyoucos , Town Attorney , suggesting that
this case and any other similar case be investigated for possible pro -
secution of the zoning ordinance by the original builders .
There being no further discussion , the Chair called for a vote .

The MOTION was declared by the Chair to be carried , 3 : 1 .
Zoning Board of Appeals - 4 - November 17 , 1976
MOTION by Mr . Edward King , seconded by Mr . Peter Francese :
RESOLVED , that the Zoning Board of Appeals of the Town of Ithaca
recommend and hereby does recommend to the Town Board through the Town
Attorney that the procedure for obtaining building permits shall include
a requirement that the builder present to the Building Inspector a plot
plan made by a licensed surveyor showing the location of the building
foundation immediately after it has been constructed .
There being no further discussion , the Chair called for a vote .

Nay - None .
The MOTION was declared to be carried unanimously by the Chair .

Bruce W . Turnbull Appeal duly closed at 8 : 28 p . m .

PRESENT : Vice -Chairman Laurene Ripley , Roger Sovocool , . Jack Hewett ,
Ed Austen , David Cowan (Assistant to the Zoning Officer ) .
The Zoning . Board of Appeals met to act upon the request
of the Planning Board at a meeting of the Planning Board held on
the 2Gth day of February , 1974 , for _an interpretation of the
present Zoning Ordinance regarding the placing of a . retail store in
a Light Industeial District .
r After discussion , it was MOVED by Mrs . Ripley and . seconded
by 'Mr . Sovocool :
The Town of - Ithaca Zoning Board of Appeals interprets - the
present Zoning Ordinance to allow within Light Industrial Districts
any lawful use allowed in the more restrictive zones , with the
exception of dwellings .
Aye - Rip-ley , Sovocool , Hewett , Austen .
Nay - None .
The Motion was carried . unanimously .
