SPECIAL TOWN BOARD MEETING
JULY 13 , 2005
PRESENT : Supervisor Doug Austic , Town Councilpeople, Robert Weatherby and Don
Ellis ; Lee Scott and Roxanne Marino absent ; Town Clerk Marsha Georgia; Deputy
Supervisor Richard Coogan; Attorney Bruce Wilson

Recreation Partnership
Mr. Vonderweidt furnished the Town Board with a short report of what is happening with
the Recreation Partnership .
Mr. Austic summarized by saying that the cost of programs are increasing and the cost of
administration is going up . The Town is paying about $ 6100 per year for 112 children
using the program . Mr. Austic pointed out that 60 of the children are attending programs
that are available without the Town belonging to the Partnership . Under the rules of the
Partnership , the Town must provide notice of termination in the Partnership 18 months
before leaving .
Mr. Vonderweidt suggested that the Town Board consider giving notice now to the
Partnership that it will be leaving at the end of 2006 .
The Town does not have to leave but if the Town gave notice now it would give the
Town time to see if the present summer camp that we have which would give the Town
the benefit to keep all the youth jobs locate and have a better camp to serve the general
population .
Mr. Austic said we would have to meet with different groups and discuss local options .
Mr. Ellis would like to hear more about the local programs and better methods of serving
the youth of Ulysses .
Mr. Austic said that he will arrange to have Tom Majors and Nancy Irish come in and
discuss the possibilities of expanding the local camp .
Hamlet Residential
The Hamlet Residential was previously updated and the Board is now in receipt of a draft
letter to the residents from Roxanne Marino . Mr. Austic said that the Board could review
Ms . Marino ' s letter and than send copies out to the residents .
Mr. Ellis asked to have it clarified as to which residents would receive copies of the
proposed Water Hamlet District in the mail .
Mrs . Georgia said that she has a list of everyone that lives in the proposed Waterburg
Hamlet District and asked if anyone else should receive a copy of the newly proposed
District . The Board agreed that all the adjoining property owners should also receive the
information on the new District . The Board also decided that the letter should also advise
the residents that they should read the section on the Hamlet Residential District from
2002 .
The Board reviewed Ms . Marino ' s draft of the letter for the Waterburg residents .
Mr. Ellis pointed out that in Ms . Marino ' s draft letter it states that the Town Board is
considering the Hamlet Residential District and he believes it would be better if the Town
Board acted on the proposed Hamlet Residential District . If the Board gives a vague
impression as to the status of the district then the issue will be unresolved . Mr. Ellis said

that he feels that having the Board adopt this Hamlet Residential District would be the
best way to go , Mr. Weatherby concurred with Mr. Ellis .
Mr. Ellis would like to have the Waterburg Hamlet District formally called H2 Hamlet
Residential District instead of Hamlet Residential . The Board agreed .
Mr. Weatherby moved, seconded by Mr. Ellis the following:
BE IT RESOLVED that the Town Board of the Town of Ulysses adopt the Residential
Hamlet as revised and it be titled in the Zoning Law as H2 -Hamlet Residential .

Mr. Austic will rewrite a letter and mail that along with the revised H2- Hamlet
Residential District write up . Mr. Austic said that he would email Ms . Marino of the
Board ' s decision.
Ms. Marino ' s Emailed Statement
Mr. Austic said that the Board has received Ms . Marino ' s emailed statement and he
enters that into the record of this meeting as follows :
I would like the Board to discuss the issues I raised with regard to the Al lot
specifications. While I realize that my alternate proposal is might be too big a change to
consider at this point, I suggested it as a compromise to be allow flexibility to owners of
agricultural land while allowing for larger lot sizes associated with active agricultural
land, as a deterrent to building on that frontage over the next 2-3 years while the Town
works further, on this issue, in the context of the Comprehensive Plan, as we have all
agreed makes sense.
I have looked over all my notes from the past 1 . 5 years on this issue, and the public
comments I have notes on or copies of as well as Planning Board comments and meeting
minutes over that period. I feel pretty strongly that the Town Board should return the Al
minimum frontage to 500 ', as was the consensus of the Board in November 2003 as a fair
compromise, and would provide some incentive for building in the RI areas, as is the
purpose of RI. I especially feel we need this, as it is already economically the most
favorable to build on Al frontage, which is already cleared and open. I have consistently
made the same points for at least a year.
I propose that the Al frontage be returned to 500 ' minimum, and that the acreage be
increased to 2. 5 acres, to allow a bit more separation of residential and agricultural land
uses in this zone, and to encourage residential land use in the RI zone over the AI, in line
with the goals of both the RI purpose and true Al zoning.
Lastly, please convey to the Board that if the zoning can be ready for a vote earlier than
the 30th and not require 3 meetings in August, I will do whatever I can to attend both the
public info meeting and then the meeting for the vote. I realize it is summer, and there
have already been way too many meetings.
Mr. Austic stated that he thinks that Ms . Marino wants to make this statement so when
the Board reviews the Zoning later it is already on the record.
Mr. Ellis said that he wholeheartly supports Ms . Marino ' s statement and he would like to
at least see what she is asking for in her statement, but he thinks that it is very important
to pass this Zoning Law expeditiously.
Noise 16. 2 .2

The Board returned to the discussion on the noise ordinance and the decimal level . One
of the suggestions would be to eliminate standards for daytime, but that would still leave
the possibility for bad cases such as a sawmill , grinding operation in a garage, loud off
road vehicles, or people taking advantage of having no noise level restrictions so it may
be wise to set daytime noise limit .
After further discussions the Noise 16.2 .2 is as follows :
All events issued permits and recognized public celebrations are excluded from the noise
restrictions of this law .
Noise from any source shall be muffled so as not to become objectionable due to
sustained intermittence, beat, frequency, tone, pitch or intensity that repeatedly exceeds
two (2) hours during daylight and (30) thirty minutes at night . Noise associated with
normal property maintenance and temporary construction is exempt from this provision.
No land use or other activity that generates a sound level that exceeds the limits set forth
below shall be undertaken. The level of sound shall be measured at the boundary of the
property generating the sound, and shall not exceed 90 dBa between the hours of 7 : 00
A.M . and 11 : 00 P . M . , and 55 dBa between the hours of 11 : 00 P . M . and 7 : 00 A. M .
For the purpose of this law, noise generated during the course of agricultural operations
defined as sound agricultural practices pursuant to Article 25 -AA, Section 308 of the
Agricultural and Markets Law is exempt .
16.4.2 Off-Premises Signs
#5 - add in "within or after located closer than 300 feet"
Tower
The Board discussed the topic of "Power Generation Facilities or Structures that Mr.
Dunnam had brought up . The general consensus was that it did not belong in the Tower
Ordinance but should be included as a new provision under the "General Provisions".
Article XX - General Provisions
Make a new 20 . 13 — Power Generation Facilities or Structures require Special Permit by
the Town Board.
July 26, 2005 Zoning Review Meeting
The Board felt that there would be no need for the scheduled July 26th, 2005 special
zoning meeting.
Proposed Water District Addition
Mr. Austic said that he has to notify other involved agencies for "SEQR" lead agency
status for the petition for inclusion .
Recreation Partnership
The Recreation Partnership was previously discussed .
Mr. Ellis moved, seconded by Mr. Weatherby the following :

BE IT RESOLVED that the Town Board of the Town of Ulysses give notice to
the Recreation, Partner that the Town of Ulysses intends to withdrawal from the program
at the end of the Town ' s contract .

Next Scheduled Meeting
August 9th is the Regular Town Board meeting, August 16 , 2005 at 7 : 00 PM is the
"Public Informational Meeting" at the Town Hall , and August 30th, 2005 at 7 : 00 PM is
the vote on the zoning law .
Hearing no further business Mr. Weatherby moved, seconded by Mr. Ellis to adjourn the
meeting. Unanimously approved . Meeting adjourned at 9 : 05 PM .
