REGULAR TOWN BOARD MEETING
JULY 12, 2005
PRESENT : Supervisor Doug Austic , Town Councilpeople Lee Scott, Robert Weatherby;
and Don Ellis; Roxanne Marino , absent ; Town Clerk Marsha Georgia; Highway
Superintendent James Meeker; Deputy Supervisor Richard Coogan; Attorney Bruce
Wilson.

Supervisor Austic called the meeting to order at 7 : 30 pm, and led those assembled in the
Pledge of Allegiance to the Flag of the United States of America.
APPROVAL OF MINUTES : TABLED 4/26and 5/3 , RTB 6/14, OTHERS IF
AVAILABLE
Mr. Austic said that other minutes that were finished and provided to the Town Board
were the Special Board Meetings of 6/8/05 and 6/28/05 and the minutes of Mr. Coogan ' s
Annual Stormwater Report of 5/ 10/05 .
Mr. Austic made a correction on page 8 , paragraph 4 of the Regular Town Board Meeting
of 6/ 14/05 and changed your to you .
Mr. Ellis asked about the reference to the letter that Ms . Marino was going to write to the
residents of Waterburg Hamlet as to if that had been done and the draft Hamlet
Residential been mailed to the residents .
Mrs . Georgia said that she had just emailed Ms . Marino to ask about that letter and had
not received anything back .
Mr. Coogan said that he had checked his email prior to coming to the meeting and that
Ms. Marino had sent a draft after closing hours .
The Board will discuss at tomorrow nights Zoning Review meeting set for 6 : 30PM .
Mr. Ellis moved, seconded by Mr. Scott for the approval of the following minutes :

APPROVAL OF CLAIMS
Mr. Austic said that before the claims can be approved there needs to be a Budget
adjustment made. In the vouchers is a bill from Stellar Stereo for the equipment for the
Court Room. The money for this is in the Reserve account that was received from a grant
Justice Rector received from Court Administration and the funds need to be released
from the Reserve Account.
Mr. Ellis moved, seconded by Mr. Scott :
BE IT RESOLVED that the Town Board of the Town of Ulysses authorizes
Supervisor Austic to increase A1620 . 2 in the amount of $ 8387 . 00 and decrease the
Capital Reserve account to cover the expense of the Court Room .

numbers 311 through 358 in the amount of $41 , 369 . 85

REPORTS OF REPRESENTATIVES
PETER PENNIMAN - absent
TRUMANSBURG FIRE DEPARTMENT — no representative in attendance .
PLANNING BOARD REPORT, CHAIRMAN - absent
TOWN REPORTS
HIGHWAY SUPERINTENDENT James Meeker reported that the highway crew
scrapped and painted the overhead door, face boards and soffits on the cold storage
building. They have installed a tractor hydraulic kit on the tractor. New driveway pipes
were installed for the Grassroots bus turnaround on Agard Road . Grassroots will be
loading and unloading passengers from the shuttle buses in their lot instead of along the
roadside . The crew also installed driveway pipes for anew house on Cold Springs Road.
The roadsides are being mowed and brush trimmed around roadsides for improved site
visibility. His crew finished painting the overhead doors and insulated two new panels
on the door.
CODE ENFORCEMENT OFFICER Alex Rachun — absent and left no report .
TOWN CLERK Marsha L. Georgia reported $ 1 , 312 . 50 in clerk fees . Of that amount
$ 805 . 56 was turned over to the Supervisor along with the Clerk ' s report. Included in
these fees was $250 . 00 in Water District No . 3 fees for two plumbing permits . Two more
applications for plumbing permits were issued today and one application for a new curb
stop on Cold Springs Road where a new house is being built .
BOARD MEMBER AND COMMITTEES — no reports
SUPERVISOR Douglas Austic reviewed his monthly Supervisors Financial report; no
questions were heard .
DEPUTY SUPERVISOR Richard Coogan reported that maintenance has started on
Water District #3 . The Town has hired Eric Irish to help with the field maintenance for
the water district which includes painting reference numbers on the fire hydrants,
cleaning, greasing, weeding around the hydrants, finding the values and exercising the
values and cleaning and painting the value covers . When the hydrants are finished they
will start working on the gate values and if time permits they will start exercising the curb
stops as well . This maintenance should be done at least once a year according to the
manufacturer to avoid values and hydrants freezing up from rust.
Mr. Coogan has received the results on the lead and copper tests and nine out of ten were
within the limits . Mr. Coogan said that the one was three thousands above the legal limit

and he will call the Health Department to see what action is required for the house that
was above the allowable limit .
Mr. Coogan said that he has been starting to implement the recommendations suggested
by the auditor, which includes having the Deputy Supervisor reconcile the bank
statements .
Audit
Mr. Austic said that the audit is available it was received a couple of days ago and will be
distributed to the Board. The auditor will attend the August Regular Town Board meeting
to give a presentation of the Audit .
OLD BUSINESS
Water District # 3
Mr. Austic stated that the Town still is having problems with Bolton Point providing
enough chlorine in the water tank, so he feels that we are going to require a chlorinator at
the tank. The Town of Ithaca may be responsible for cost of the chlorinator at the tank.
Testing the line after a pumping cycle indicates that Bolton Point is unable to add
sufficient chlorine to the water to keep the tank at the Health Departments ' required level
of 2 . 0 mg/l . This has resulted in residual chlorine levels well below the 0 . 2 mg/1 at the
end points in the waterline . The exact reason for the low chlorine levels is undetermined
but it could be that the chlorine pumps at the pumping station are not sufficient size to
add the required bursts of chlorine .
Court Budget / Expenditures
Mr. Austic wrote a memo to the two Justices, as suggested at the last Town Board
meeting, requesting that both Judges come to the Town Board meeting to discuss the
Court ' s appropriations account in relation to it is overdrawn . Mr. Austic has advised
them also that if they cannot justify to the Town Board the expense for a court security
officer the voucher may not be paid .
Neither Justice Springer nor Justice Rector attended this meeting.
NEW BUSINESS

ZONING REVIEW
Mr. Ellis presented a list of changes to the Zoning ordinance under Design Standards for
Signs :
Definitions - Sign , business directional - change six (6) square feet to nine (9) and
insert — per side
In the following districts : Al , B1 , IL, add 16 . 4 . 5 at the end of -Signs as regulated under
Article XVI, Section 16 .4
In the following districts : R1 , R2 , RM , MHP, add 16 . 4 . 4 at the end of - Signs as regulated
under Article XVI, Section 16 .4
In R1 — add 16 .4 under Business directional signs in 7 . 3
In Hl — add 16 . 4 . 6 at the end - Signs as regulated under Article XVI, Section 16 . 4
Noise — 16 . 2 . 2 — Add to the 1st paragraph — Noise associated with normal property
maintenance and tempory construction is exempt from this provision. Changed first part
of paragraph. Noise from any source shall be muffled so as not to become objectionable

due to sustained intermittence, beat, frequency, tone, pitch or intensity that repeatedly
exceeds two (2) hours during daylight and thirty (30) minutes at night. Change the time
from 7 : 00 PM , to 11 PM . Increase the 65 DBA in the daytime hours to 90 DBA.
Make a new first paragraph — All events issued permits and recognized public
celebrations are excluded from the noise restrictions of this law .

CORRESPONDENCE
Mr. Austic previously distributed a copy of a letter from George Winner, NYS Senator
acknowledging the resolution that the Town Board adopted on the Community
Preservation Act .
ADDITIONAL ITEMS - Mr. Austic reminded the Board that there is a Special Town
Board Meeting tomorrow evening July 13th, 2005 at 6 : 30 pm no additional items
ADJOURNMENT
Hearing no further business Mr. Ellis moved, seconded by Mr. Scott to adjourn the
meeting. Unanimously approved, meeting adjourned at 9 : 00 PM .
