SPECIAL TOWN BOARD MEETING
MARCH 24, 2005
PRESENT : Supervisor Doug Austic , Town Councilpeople Robert Weatherby; Roxanne
Marino and Don Ellis ; Councilman Lee Scott absent; Town Clerk Marsha Georgia;
Deputy Supervisor Richard Coogan; Attorney Bruce Wilson.
Others present : Tom Schlee
Supervisor Austic called the meeting to order at 8 : 15 AM .
Deputy Supervisor Coogan said that he met with George Frantz and Attorney Wilson on
Tuesday March 22nd to review the outstanding changes in the draft Zoning Law . Mr.
Coogan has merged Mr. Frantz ' s comments and changes into the master document and
will distribute copies with the new material in red to the Town Board and the Chair of the
Planning Board . The changes in red are those additions by Mr. Frantz and Mr. Coogan.
Mr. Coogan has added a definition, design standard, and applicable references for stream
protection buffer.
Mr . Frantz noted in his markup that the Board should include the wording "erected,
changed or extended . . . " because it was standard zoning terminology. The Board
approved reinserting this phrase . Mr. Coogan asked that the Board review the changes
and then it would be ready to sent out to an editor. Mr. Coogan plans to meet with an
editor either Tuesday or Wednesday.
Mr. Coogan said that Mr. Frantz is going to send a chart or text regarding residential
lighting. Mr. Frantz had said that he was not able to locate and standards for specifying a
maximum in lighting. Ms . Chiuten, Planning Board member, has also looked and cannot
find any maximum standards for lighting.
Mr. Coogan stated that he believes there are still outstanding unreviewed statements are
from Heather Filiberto regarding cell towers . Ms . Filiberto had sent the Town two sets of
comments on this issue . Some of Ms . Filiberto ' s comments were included the night she
spoke at a Board meeting and she said that she would send in written comments . Ms .
Filiberto spoke with a colleague in a neighboring county who is more involved with cell
tower regulations and also forwarded these comments to the Town. than she talked to
someone else in a neighboring county that does more with cell towers
Mr. Austic asked if the Boards review of these types of things would hold up the editing
process ?
Mr. Coogan said that if the Board defines the potential problem areas it would not be a
problem.
Mr. Ellis said that he still has to investigate Condo/multi family. He does have a rough
draft but has not had the time to complete his write-up .
Mr. Austic suggested that Mr . Ellis look in the book, The Latest Illustrated Book of
Development Definitions, to see if those definitions would suffice .
Mr. Frantz had noted the Board should consider making Barangus and Spruce Row
allowable in their respective zones rather than keeping them as PDDs . The Board
discussed the options and decided to leave these parcels as PDDs .
The Board addressed Mr. Tyler' s letter in reference to floating zones for Mobile Home
Parks and multi -residents . After a long discussion the Board determined that the parcels
surrounding the Washington Heights Manufactured Home Park should be added as
additional land suitable for MHP use and made into a MHP district on the map . The

MHP District would have all the same permitted uses as the R2 Residential with the
permitted use of single and doublewide manufactured homes .
Multiple Residence District was not considered to have such a negative public concern
and was defined as allowed in any R2 Moderate Density and H1 Hamlet District . Mr.
Austic and Mr. Frantz suggested the multiple residence district be limited to areas where
the parcel had access to municipal water. Mr. Ellis pointed out that this designation has
strong implications in the future for the Dubois Road area and Waterburg Heights areas if
they get municipal water. Mr. Austic said people would need to understand that in the R2
and 111 districts within water districts multiple residence use is allowed. The requirement
for municipal water was added to the Multiple Residence District section of the zoning
law.
The Board discussed the hiring of editors . The general consensus was that Amy
Christian would be hired to complete the editing on the zoning law and Persephone
Dolinger would be hired to edit the sub-division law .
Mr. Ellis moved, seconded by Mr. Weatherby the following :
BE IT RESOLVED that the Town Board of the Town of Ulysses hire
Persephone Dolinger to edit the Sub-division for a fee not to exceed $ 500 without
additional approval from the Town Board and,
FURTHER RESOLVED that the Town Board of the Town of Ulysses would
hire Amy Christian to continue editing the Zoning law for a fee not to exceed $ 1000
without additional approval from the Town Board .

Adopted .
Hearing no further business Ms . Marino moved, seconded by Mr. Weatherby to adjourn
the meeting. Unanimously approved, meeting adjourned at 9 : 35 AM .
