A Meeting of the Town of Ithaca Zoning Board of Appeals was held
in the Town of Ithaca Town Hall , 126 East Seneca Street , ( second floor ) ,
Ithaca , New York , on Wednesday , March 19 , 1975 , at 7 : 30 p . m .
PRESENT : Chairman Peter Francese , Laurene Ripley , Edward Austen ,
Edward King , Jack Hewett , Lawrence P . Fabbroni ( Building Inspector ) .
ALSO PRESENT : Richard and Frances Ramin , Attorney Robert Williamson ,
James A . Bush , 4 The Byway , Mrs , Gracie Bush , 136 Forest Home Drive ,
The Meeting was called to order by the Chairman at 7 : 39 p . m .
PUBLIC HEARING : APPEAL OF RICHARD AND FRANCES RAMIN FROM DECISION OF
BUILDING INSPECTOR DENYING PERMISSION FOR CONVERTING SECOND FLOOR
OFFICES TO TWO APARTMENTS IN EXISTING NON-CONFORMING BUSINESS -RESIDENTIAL
MIXED USE AT 132 FOREST HOME DRIVE , ITHACA , NEW YORK ( PARCEL NO . 6 - 66 - 1 - 6 ) .
Chairman Francese declared the Public Hearing in the above -noted
matter duly opened at 7 : 40 p . m .
Mr . Fabbroni read the Appeal as it was published in the Ithaca
Journal on March 14 , 1975 , and - the - Secretary verified said . publicat-ion and
date , and< apo §ting =.of - ° same in Town Hall . Mr . Fabbroni then presented to
the Board the Appeal form signed by Frances A . Ramin and dated March
11 , 1975 . Mr . Fabbroni then presented for the record the Secretary ' s
Affidavit of Service by Mail of the Notice of Public Hearing on March
12 , 1975 , to the various neighbors adjacent to and near the Ramin
property .
Mr . Fabbroni stated that he denied the Ramin ' s request to convert
the second floor offices to two apartments in the existing non -conforming
business - residential mixed use because the proposed change would put the
structure in the multi - family use category . Mr . Fabbroni stated that
it was his opinion that Sections 54 and 55 of the Town of Ithaca Zoning
Ordinance applied to this matter and necessitated the denial , and further
that the request from the Ramin ' s was a big enough switch in the use to
make it necessary to bring the matter to the Zoning Board of Appeals .
Mr . Fabbroni noted that the structure in question is the former location
of the Town of Ithaca Offices . It is presently occupied by Massachusetts
Mutual Life Insurance Company and contains two apartments .
Mr . Robert Williamson , attorney for Mr . and Mrs . Ramin , appeared
before the Zoning Board and stated that Mr . Fabbroni has , as noted above ,
turned down the request of Mr . and Mrs . Ramin because he ( Fabbroni )
felt that the Zoning Ordinance did not cover this particular situation .
Mr . Williamson stated that both he and the Ramins felt that they did not
need to appear at all before the Zoning Board according to his interpre -
tation of the two Sections . Mr . Williamson read Section 54 and Section 55
of the Town of Ithaca Zoning Ordinance in their entirety . Mr . Williamson
stated that it is his and the Ramins contention that this building is
already a non- conforming use . The first floor is occupied by Massa-
chusetts Mutual ; the second floor contains offices space for five or six
offices and the third floor contains apartments . The building has been

used under these conditions since 1962 or 1963 . Mr . Williamson stated
that under Section 55 of the Ordinance they would contend that they are
continuing this mixed use with the present request . He stated that they
had applied for a building permit to have the second floor made into
two one-bedroom apartments and were denied such permit .
Mr . Francese noted that the third floor of the structure is
currently apartments . Mr . Williamson said that the third floor contained
two one -bedroom apartments . Mr . Francese asked if the second floor were
vacant . Mr . Williamson said that it is not presently vacant . There is
one person there using one of the offices - namely , Alison Bishop Lurie ,
the authoress of the recent best - seller " The War Between the Tates " .
Mr . Williamson stated that there have been other occupants of the offices
from time to time such as Kay Sprague , a student who had an office there ,
an architect was there also a few years ago by the name of Cohen . Mr .
Williamson stated again that the Ramins are continuing the use as it has
been for that particular building .
Mr . Francese asked if it were their intention to carry the apartment
set -up down into the first floor and have apartments there some day ? Mr .
Ramin stated that that was not their intention . He stated that it is
their intention that the offices now occupied by Massachusetts Mutual will
be there for a long time and with Massachusetts Mutual being the occupant .
Mr . Williamson pointed out that there is parking available for about
15 cars . He. also noted that the taxes on the property are going up just
like everybody elses . He stated that the Ramins feel that if there were
apartments . they could rent the whole second floor and not have any empty
spaces most of the time as they do now .
Mr . Francese asked if the Ramins live in Forest Home ? Mr . Ramin
replied that they do not - they live in Lansing . Mr . Francese asked if
the neighbors were notified of the Public Hearing and Mr . Fabbroni stated
that they were as stated at the beginning of the meeting .
Mr . Fabbroni stated that he was in receipt of a Petition dated March
17 , 1975 , and directed to the Zoning Board of Appeals of the Town of
Ithaca . Mr . Fabbroni read the Petition as follows :
" WE , the undersigned neighbors of the property at 132 Forest Home
Drive , respectfully petition that the order of the Building Inspector ,
denying permission for converting second floor offices to apartments at
the above -named property , be affirmed , and that the appeal of Richard
and Frances Ramin be denied . "
Mr . Fabbroni read the following names as signers of said Petition :

Mr . Williamson commented on the Petition and said that it is their
opinion that the matter should not have been denied in the first place

nor should they be required to appeal to the Board , and further that the
structure can be legally used as requested .
It was noted at this time that both Mr . James Bush and Mrs . Gracie
Bush ( no relation ) were present and opposed to the Ramins ! request .
Mr . King asked if the proposal is to eliminate all the offices on
the second floor ? Mr . Williamson replied that that is correct .
Mr . Francese asked how many rooms altogether were on the second
floor . Mr . Williamson said about 6 .
Mr . Hewett asked if the six offices were ever in- 'Use at one time ?
Mr . Ramin replied that they were when the Town of Ithaca Offices were
there and also when a couple of architect groups were there . Mr . Hewett
asked if there were any parking problems when the offices were full . Mr .
Ramin replied there were some parking problems when the Town of Ithaca
Offices were there .
Mr . King asked when the second floor was last completely occupied ?
Mr . Ramin replied that it was about five or six years ago . Mr . King
asked if any offices have been vacant in the recent past ? Mr . Ramin
replied in the affirmative stating that there are offices vacant now .
Mr . King asked if Mr . Ramin had had any offices vacant for a year ?
Mr . Ramin replied in the affirmative . Mr . King asked if more than one
were vacant for a year ? Mr . Ramin replied that there were two offices
vacant for the past year .
Mrs . Ripley asked about the density in a situation like this . Mr .
Fabbroni stated that the Ramins are essentially asking for a multi -

family use mixed with a commercial use and that there are no restrictions
in multi - family .
Mr . Francese asked Mr . Fabbroni if the Ramins could put one dwelling
unit only in the second floor instead of two . Mr . Fabbroni replied in
the negative stating that that would present the same question of multi -
family again . Mr . 'Fabbroni repeated that he had brought the matter
before the Board of Appeals to determine if multi - family is more
restrictive than commercial .-

Mr . James Bush spoke from the floor and pointed out that the
Massachusetts Mutual Offices are there now and open from 9 : 00 to 4 : 00 .
. He asked how could this proposal be less restrictive when more people
are being added to the building ?
Mrs . Gracie Bush spoke from the floor and read from notes she had
prepared . She outlined the history of the property and many of the
problems inherent with its use . She was particularly unhappy about the
great numbers of parked cars , and the fumes therefrom . Mrs . Bush has
lived in her home for well over thirty years . She stated that she would
like to ask the Ramins if they would like to live in a situation like
hers . She stated that she would like to ask the Zoning Board if there
are any laws to protect people from this kind of situation where so many
people are in one building in a residential neighborhood . She pointed
out that any fire would create a very dangerous situation because of the
narrow`__ streets and the great numbers of cars parked around the building
at all times . She asked if there were any rule that a parking lot can

be that close to a building . She further pointed out that she has
never complained before about the use of the building in question nor
has she fought for herself in the matter , but that this request was
just a little too much to take . She asked where do all the cars come
from? She stated that Mr . Howard Stevenson , the County Commissioner
of Public Works , told her that only the people in that building could
park in that area . She asked if there were not a law as to space
requirements where there cannot be so many people in the building . Mrs .
Bush said that she had no fight with the Ramins , but she does have a
fight with .what they have done to their little corner . She stated that
the Ramins have not kept up the parking lot and the building as it is
now used . She said it was her opinion that the place should be cleaned
up . She wondered how the Ramins could take care of two more apartments .
Mr . King asked Mrs . Bush if she knew where these cars are coming
from? Mrs . Bush said she did not know , as did Mr . James Bush , Mrs .
Bush added that it is full - all day .
Mr . King asked Mr . Ramin if he were renting parking spaces . Mr .
Ramin replied that he was renting two spaces - one to Mrs . Bush and
one to Mrs . Goodman , and , of course , there are the Massachusetts Mutual
employees during the day .
Mr . Francese asked Mr . Ramin how many parking spaces he had said
that he had . Mr . Ramin replied that there are about 12 to 15 spaces .
Mrs . Bush pointed out that the Massachusetts Mutual people park in
the front of the building . Mr . King asked if the parking area were full
at night . Mrs . Bush stated that it was .
Mr . Francese asked Mr . Ramin how many occupants were in each of
the present apartments ? Mr . Ramin stated that there is one person in
each of the third floor apartments , plus the Massachusetts Mutual people
being about 5 or 6 employees .
Mr . Ramin noted that he does have a fairly open arrangement with
the neighbors who do use the parking area from time to time and he
mentioned the names of Lambert , Knapp and Cutting as some of the people
who do use the parking area for guests , etc .
Mr . King asked Mr . Ramin if he had any plans for expansion of the
parking area in this connection ? Mr . Ramin stated that he did not .
Mr . Williamson stated that the Ramins allow the neighbors to park
there as a courtesy . He further stated that no one has ever complained .
Mr . King asked Mr . Bush why the neighbors are opposed to this request ?
Mr . Bush stated that it depends on the type of student that gets in there .
There could be noisy parties and the like . He stated that now the place
is tolerable most of the time but some times it is not .
Mr . Williamson pointed out that the Ramins are planning to have
one or two people in the proposed apartments .
Mr . Ramin stated that he had received only one complaint about the
property about five or six years ago from Mrs . Bush . He said that they
have tried to be very careful about whom they rent to . He stated that he
and his wife try to be respectable people . They ask for references from

their tenants and are very careful in their selection . They have no
no intention of having wild students living there . They do not want to
have unhappy neighbors . Their intention is to have one or at the most
two people there . Maybe a graduate couple or someone who would rent it
on a long term basis . He stated that the apartments would be of high
quality . Mr . Ramin said that he and his wife felt that this would be
more desirable than having offices filled .
Mrs . Bush asked if there are not any guidelines about how close a
parking lot could be to a house next door . Mr . Francese stated that a
parking lot is not a structure and a person could blacktop right up to
the property line .
Mr . James Bush asked about storage . He asked if the septic system
were adequate .
Mr . Fabbroni stated that the Town would have to require Health
Department approval . Mr . Fabbroni also pointed out that the area is
not going to be unsewered for very long as Forest Home is a part of
the five area sewer improvement being undertaken by the Town .
Mr . Francese announced that if there are no final statements the
Public Hearing will be closed at this point . There were none . Chair-
man Francese closed the Public Hearing in the Ramin Appeal at 8 : 23 p . m .
PUBLIC HEARING : APPEAL OF ROBERT H . AND FRANCES H . APGAR FROM DECISION
OF BUILDING INSPECTOR DENYING PERMISSION FOR ERECTING A TWO -CAR GARAGE
CLOSER TO SIDE AND FRONT LOT LINE THAN REQUIRED AT 979 AND 975 TAUGHANNOCK
BLVD . ( PARCELS NO . 6 -21 - 2 -31 AND 6 - 21 - 2 -32 ) .
Mr . Fabbroni announced that the Public Hearing in the Apgar Appeal
had been cancelled .
NEXT MEETING DATE ,
Mr . Fabbroni asked that the Board consider the setting of a date for
an Appeal by Mr . Willis Hilker . It was agreed that the Board would meet
on April 16 , 1975 , at 7 : 30 p . m . in the Town of Ithaca Town Hall to hear
the Hilker Appeal ,
CONTINUATION OF THE RAMIN APPEAL ,
At 8 : 40 p . m . Chairman Francese declared the Public Hearing on the
Appeal of Richard and Frances Ramin duly opened .
MOTION by Mr . Peter Francese , seconded by Mr . Jack Hewett :
The Zoning Board of . Appeals of the Town of Ithaca hereby interprets
the Zoning Ordinance of said Town such that the second floor of the
building located on Town of Ithaca Tax Parcel No . 6 - 66 - 1 - 6 can be con-
verted into two one -bedroom apartments which the Board deems shall be
subject to R- 15 residential requirements thereafter . Said Board of
Appeals further rules that this use is subject to approval by the
Aft Tompkins County Health Department and , additionally , the building must
comply with the New York State Multiple Housing Code ,
The Board urges the applicants to gravel , otherwise improve and

maintain in good order the existing parking lot .
There being no further discussion , the Chair called for a vote .
Aye - Ripley , Austen , King , Hewett , Francese .
Nay - None .
The Motion was declared carried unanimously .
The Public Hearing was closed by the Chairman at 8 : 50 p . m .
