Note : These minutes reflect the changes made to the law. The discussions by the Town Board are available by listening to the tapes on file. Changes were made to the electronic document during the meeting by Mr. Coogan . SECTION 210 — (change title) INITIATION OF MINOR OR MAJOR SUBDIVISION REVIEW : SUBMISSION OF A SKETCH PLAT *Note — change all reference to Zoning Enforcement Officer to Code Enforcement Officer. 210. 1 # 1 — change play to plot #3 — change of to or 210. 2 After fire protection add in - any applicable stormwater management *Note add : 112. 8 Date of Submission : the date of submission or required materials shall be considered to be the date on which the materials for plot approval complete as determined by the Planning Board . Note* Revision of 112 .3 — Major Subdivision — after resulting in 4 or more lots insert — or the creation of a fourth lot from the same original lot not withstanding the provisions in 202 . 1 of the 1986 Law . (Check legal issue) Create 112 . 0 — Failure to notify the Code Enforcement Officer of any conveyance by subdivision can be a violation of this law and will be enforced by both civil action and financial penalties inclusive of injunctive relief to the effect of terminating prior conveyances. SECTION 212 Indent # 1 through #8 SECTION 220 : SIMPLE SUBDIVISION REVIEW PROCEDURE * Note : Review Procedures — 220 may go before sketch plat — Dick will review and rearrange. Insert after determination — by the Code Enforcement Officer — change all Zoning Enforcement to Code Enforcement SECTION 230 Remove reference to Section 211 because there is done . Special Town Board Meeting 2 02/01 /2005 SECTION 231 Change reference to Zoning Enforcement to Code Enforcement 1st paragraph take out and/or and replace with or *Note : fee schedule has to be determined by Resolution of Town Board. Last paragraph should read as follows : The Date of! Submission of the Subdivision Plat shall be considered to be the date on which the application for plat approval , complete as determined by the Planning Board and accompanied by the required fee and all data required by Section 232 of these regulations . SECTION 232 #2 — last sentence should read — The corner of each tract shall also be located on the ground and marked with an approved pin, pipe or monument, and shall be referred to and shown on the Plat . #6 — should 'read — The Subdivision Plat shall be a clear legible reproduction that meets the standards for filing with the County Clerk as prescribed by law . SECTION 234 Should read as follows : If required by the Planning Board, a public hearing shall be held within 45 days from the Date of Submission . The hearing shall be advertised, in the official newspaper of the Town at least 5 days before such hearing. If no public hearing is required, the Planning Board shall have 45 days from the Date of Submission to make its decision. SECTION 35 235. 1 - delete and/or Zoning Enforcement Officer at beginning and at the end 235.2 - delete and/or Zoning Enforcement Officer 235.4 - delete and/or Zoning Enforcement Officer all places SECTION 241 2nd paragraph - should read as follows : At least nine (9) copies of the Preliminary Plat shall be presented to the Code Enforcement Officer along with the fee established by the Town Board. Delete 3rd paragraph 4th paragraph (now 3rd) should read as follows : The Date of 'Submission of the Preliminary Plat shall be considered to be the date on which the P ileliminary Plat is accepted as complete by the Planning Board and all data required by Section 242 . The Planning Board Chair shall note the date on the Preliminary Plat . SECTION 242 242 .02 - should be names of the owners 242 . 07 - change intervals of 5 feet to 10 feet Special Town Board Meeting 3 02/01 /2005 242 .08 — change to Ulysses Comprehensive Plan Hearing no further discussion the next scheduled meeting is February 10th, 2005 at 8 : 00 AM .
