SPECIAL TOWN BOARD MEETING
REVIEW OF ZONING
JANUARY 25, 2005

Note : These minutes reflect the changes made to the law. The discussions by the
Town Board are available by listening to the tapes on file. Changes were made to the
electronic document during the meeting by Mr. Coogan .
SUBDIVISION REGULATIONS
ARTICLE I (will change to Article II)
Section 112
*Note - change throughout the document and reference to Zoning Enforcement Officer
to Code Enforcement Officer.
112 . 1 Simple Subdivision
112 . 1 Simple Subdivision : division of a lot into two lots, realignment of boundary lines
between lots so as to transfer land from one lot to an adjacent lot, or separation of
noncontiguous lots (e . g. , lots bisected by public or quasi public rights-of-way) into
separate lots of record without new boundary alignment. No distinction is made between
subdivision and re-subdivision . Any Simple Subdivision on State Routes, Perry City,
DuBois and Halseyville Roads requires Planning Board review under Minor Subdivision
procedures.
112 . 2 Minor Subdivision
Insert municipal before utility extensions
112 .3 Major Subdivision
Add to end of first sentence — or the creation of a fourth lot from the same original lot.
Add municipal in front of utility extensions .
112 .4 Sketch Plat :
A sketch of a proposed subdivision specified in (check) Section 212 , (move the
following to Section 210 or 212 in procedure?) the first stage submission to the Code
Enforcement Officer sufficient for the proposal to be classified as to type of review
required and referred to the Planning Board for their general recommendations as to any
adjustment needed to satisfy the objectives of these regulations .
112.5 Preliminary Plat
Check on the reference to Section 232 . Delete the second-stage submission to the
Planning Board and its detailed .

112 .6 Final Plat or Subdivision Plat
Delete the final stage and delete and which, if approved, may be duly filed or recorded by
the applicantlin the Office of the County Clerk .
SECTION 113
* Note — change all references of Streets to Roads .
113 . 1 Road
Change to Road — delete term used interchangeably with road — delete among others and
replace with and other public ways .

201 : Declaration of Policy
Change to read :
By the authority of Town Law section 276 of the State of New York, the Planning Board
of the Town lof Ulysses is authorized and empowered :
Change #3 — delete everything after — to conditionally approve preliminary plats .
Next paragraph should read as follows :
It is declared to be the policy of the Town Board to consider land Subdivision Plats as
part of a plan for the orderly, efficient, and economical development of the Town. This
means, among other things, that land to be subdivided shall be of such character that it
can be used safely for building purposes without danger to health, or peril from fire,
flood, or other menace; that proper provision shall be made for drainage, water supply,
sewerage, and other needed improvements ; that all proposed lots shall be so laid out and
of such size in accordance with applicable zoning; that the proposed streets shall
compose a convenient system conforming to the Official Map ; and shall be properly
related to the proposals shown on the Ulysses Comprehensive Plan and shall be of such
width, grade;, and location as to accommodate the prospective traffic , to facilitate fire
protection, and to provide access of fire- fighting equipment to buildings ; and that proper
provision shall be made for open spaces, parks and playgrounds.
* Note : Roxanne would like to work on the wording of the above paragraph because she
feels it is just referring to streets .

Should read as follows :
Before any plat of land in the Town of Ulysses is filed with the County Clerk the plat
must be approved by the Code Enforcement Officer or the Planning Board, as applicable,
in accordance with the procedures with this law and Town Law, Section 276 .

SECTION 203
203 . 1 — Simple Subdivision
Should read as follows :
Requires the review of the Code Enforcement Officer or the Planning Board if it occurs
on a State Road, Perry City Road, Halseyville Road or DuBois Road .
203 . 2 — Minor Subdivision
Should read as follows :
Review includes two required submissions by subdivider and may include a public
hearing if considered desirable by the Planning Board .
203 .3 — Major Subdivision
Should read as follows :
Review includes three required submissions by subdivider and at least one public hearing
by the Planning Board.

Last sentence change charged to borne by applicant
SECTION 206 — (CHANGE OF TITLE) PLAT REVIEW OF UNCOMPLETED
SUBDIVISIONS
Should read as follows :
The Planning Board may, on direction of the Town Board, review , for purposes of
revision, those plats already on file with the County Clerk if 20 percent or more of the
plat is uncompleted after ten ( 10) years for reasons other than terrain , drainage, soil
conditions , or the like . Legislative authority for such review is found in Town Law,
Section 276 . ( Check this section)
Next Meeting
The next meetings are scheduled for February 1st, 2005 at 6 : 30 PM, February 10th, 2005
at 8 : 00 AM and February 15th , 2005 at 7 : 00 PM with the Planning Board to review map .
