HomeMy WebLinkAbout2005-01-20-STB, ZONING SPECIAL TOWN BOARD MEETING REVIEW OF ZONING / SUB-DIVISION JANUARY 20, 2005 PRESENT : Supervisor Doug Austic , Town Councilpeople Lee Scott, Robert Weatherby; Roxanne Marino and Don Ellis ; Town Clerk Marsha Georgia and George Frantz . Meeting was called to order shortly after 8 AM . Ms . Marino had changes from the Planning Board that the Planning Board would like the Town Board to review and consider including as part of the new zoning law . Mr. Frantz told the Board that he has not completed all the changes that he was asked to research and incorporate into the law for the Board to review . Mr. Ellis stated that he has prepared the statement for Al District . Mr. Ellis also said that he had not had the time to look into issues involving Townhouses and Condos . Al Statement of purpose (4. 1 ) as follows : The purpose of the Al Agricultural District is to protect the agricultural production resources of the Town of Ulysses as seen today in viable agricultural operations, and the agricultural heritage of the Town as seen today in the variety of land uses and the openness of agricultural fields . Tower Discussion Mr. Austic had the amendment to the Town of Ithaca' s Tower Ordinance that he previously distributed to the Board . In referring to this ordinance, Mr. Austic stated that the Town of Ithaca has put in several references to antennas that are added to existing towers where the co-location of an antenna does not increase the height but may increase the need for lights . Ithaca ' s ordinance also contained provisions for a streamlined review process for co-locations on antennas that may be beneficial for Ulysses to incorporate. Mr. Weatherby asked if there was anything in the Town of Ithaca ' s ordinance about the ham radio antennas . Mr. Austic reported that he had not located anything concerning ham radio towers in the Ithaca Ordinance . Mr. Austic stated that he might not agree that ham radio antennas should be exempt from review process . Curt Dunnam , resident of Ulysses, said that he is willing to write up comments for ham radio antennas . As of this meting, the Town has not received Mr. Dunnam ' s comments . Height Town Board requested George Frantz draft language for antennas and incorporate it into Zoning Law that includes : • Total height not to exceed 75 ' total height without review • Commercial / Residential antennas • All towers require a Building Permit • Fall zones for all towers Ms . Marino offered to draft an email response summarizing what the Board has decided and will send to members of the Town Board . If everyone on the Board thinks her response is okay she will then forward it to Mr. Dunnam . Mr. Austic pointed out that in the Town of Ithaca' s ordinance requires vegetation to be planted around the buildings and equipment sheds . Town of Ulysses had required/ tree plantings as a screening for the cell tower on Mekeel Road as viewed from Swamp i Special Town Board Meeting 2 01 /20/2005 College Road . Mr. Austic said that in his opinion the plantings required for that project would never conceal the tower on Mekeel Road. Review Planning Boards Suggestions 16. 5 Standards for outdoor lighting The Town Board reviewed the Planning Board ' s comments on outdoor lighting that included Non-Residential and Residential minimum requirements but did not include any reference to maximum lighting standards . Mr. Frantz felt that in reading the Planning Board ' s comments that the Planning Board had misunderstood the concept of the Design Standards . Ms . Marino stated that if maximum lighting standards were included, the Town Board would need to include a trigger mechanism that would cause a review of a property in question to establish if that property exceeds the standards for maximum outdoor illumination ;while still providing for the safety and well being of the residents . Under the chart add #4 (in Zoning Law)- Any luminaire with a lamp or lamps rated at rate more than 1800 lumens shall be directed or focused such that no direct light from the luminaire shall be directed towards adjacent properties and be directed down . Mr. Frantz agreed to rewrite this and include it fewer than 16 . 5 . Mr. Frantz will also find a place for the Residential Lighting Standards as the Planning Board suggested. He may re-write the residential standards for better clarification and it may become its own section within article for Design Standards . Other Planning Board Suggestions Site Plan Review Phase III 1 . shall be advertised by the Town Clerk . 2 . The applicant shall be billed by the Town Clerk 3 . shall be mailed by the Town Clerk Mr. Rachun and not the Planning Board suggested that the Town Clerk would handle these requirements . The Board felt that it not necessary to spell out who would perform these functions because someone other than the Town Clerk such as a Planning Board Clerk may handle the duties . Page 57, paragraph #4 — final site plan shall be submitted by the applicant to the Code Enforcement Officer. Page 58 , #2 , a — add to end- and all easements, rights-of-way, covenants and restrictions of record. Page 58 , #3 , f — Hours of operation. Page 61 , 15 . 2 . 10, second # 1 — change interior space to gross floor area. Page 62 , add the following final condition : and the proposed modification is reviewed by both the Code Enforcement Officer and the Planning Board Chair. The next special zoning meeting is scheduled for January 25 , 2005 . At this meeting the Town Board will continue reviewing what Mr. Frantz has rewritten or start the review of the Sub-Division .
