HomeMy WebLinkAbout2005-01-18-PB TOWN OF ULYSSES PLANNING BOARD 01 /18/05 Approved August 18, 2005 Present : John Wertis, Chairman, Planning Board Members- David Means, Rose Hilbert Rod Porter, Robin Carlisle Peck, Secretary Excused : David Tyler, Lorren Hammond and Margot Chiuten Chairman Wertis called the meeting to order at 7 : 30 pm . A quorum is present at the meeting. Town Board Mr. Wertis announced that the Town Board has scheduled a serious of meetings to review the revised Zoning Ordinance . Mr. Wertis left Ms . Marino copies of the "Zoning Ordinance Con- tributions" made by the Planning Board, he will also meet with her January 19th to review the items at the Town Board meeting January 20th - 8 am . Outdoor Lighting Mr. Wertis stated in retrospect he did not understand the lighting specifications in the ordinance; however the Residential component was reviewed during the November 16th meeting and was sent to the Town Board . Unfortunately, this proposal was fragmented and he will ask the Town Board to disregard this . Subsequently, the Planning Board has once again reviewed and Mr. Wertis prepared the revision to 16 . 5 Standards for Outdoor Lighting for the Zoning regulations completed at the December 21St meeting . Mr. Wertis stated he tried to incorporate what was drafted at both meetings into one recommendation . Mr. Wertis offered he is unsure if it is complete but would like to initiate conversation by asking "What do we want the Design Standard to do? " Mr. Wertis stated the ordinance states it is for the purpose of establishing safety standards and maximum standards, does the Board agree? Mr. Means stated that the Board felt something was needed, and being unfamiliar with the actual numbers drafted the proposal due to something being better than nothing. Mr. Wertis agreed and stated that another question that had been addressed to him by Mr. Coogan was when this would be used . Mr. Wertis informed Mr. Coogan it would come in to play during Site Plan Review , Building Permits and problematic areas that Mr. Rachun would have to evaluate . Mr. Wertis requested members review the document — he noted that Mr. Frantz was being very specific in the wording for the Non-Residential component as compared to the Residential . Ms . Hilbert stated that she found the numbers Mr. Frantz used interesting, Mr. Porter stated he found it unfortunate the Non-Residential chart the minimum has footcandles/lux not lumens . Mr. Porter also stated the wording directly under the chart should be changed to : Illumination that exceeds the minimums cited above must be submitted to the Planning Board for Site Plan Review. Ms . Hilbert referred to the A & B sections of the Non-Residential having maximums at 1800 lumens versus the Residential 2500 lumens . Mr. Means stated perhaps the residential should be lowered . Mr. Porter stated that the Residential restricts at 900 ; Mr. Frantz addressed the specific lumens as flood lights or spot lights, in addition the shielding restriction addressed the glare/trespass issues . Planning Board 2 01 / 18/2005 Mr. Wertis stated that Mr. Frantz will be attending the Town Board meeting and could provide clarification or revision to the ordinance at that meeting. Mr. Wertis offered Mr. Frantz could review the numbers as being unrealistic however the message that the Planning Board reviewed and suggested maximums the board suggested are still being presented . Mr. Porter stated the reality of the situation is this would come into effect in only two situations - individuals that apply for a Building Permit or a complaint to the Zoning Officer. Ms. Hilbert stated the definition of glare and light trespass should be incorporated into the Glossary. Mr. Wertis stated the International Dark Sky Association or the National Electrical Manufacturers Association have definitions that could be referenced . Mr. Wertis asked if the document as amended be given to Ms . Marino . Mr. Porter moved, Mr. Means seconded . Ms . Hilbert Aye Mr. Means Aye Mr. Porter Aye Mr. Wertis Aye Cooperative Extension Mr. Wertis distributed mailings from the Cooperative Extension to members that had been addressed to the Town Hall . Mr. Wertis stated Mr. Coogan is going to distribute home addresses so the mailings will go to members at their homes. Subdivision Mr. Wertis stated that the March 10, 2004 is the current Subdivision regulation; this was visited once in September. Ms .Hilbert stated that questions had been sent to the Town Board, but the Town Board was working in other areas thus questions have not been resolved . Mr. Porter stated they had not discussed Subdivision in prior Planning Board meetings ; the only item that was addressed was the 30/70. Ms Hilbert stated that the laws surrounding subdivision needed to be revised because everybody wanted subdivisions, yet they did not want them scattered here and there. Ms Hilbert offered that the idea of a Subdivision ordinance is to have planning be involved ; so a community is planned out for safety, open spaces, for communities have community events . Mr. Means offered to have organization before the lots are divided off and buildings go up . Ms . Hilbert stated this would eliminate different types of sprawl when plans are received one lot at a time. Mr. Wertis stated the focus is to get away from road edge development of relatively small subdivisions . Mr. Porter stated that he disagreed —a simple subdivision is basically making one lot into two . Planning Board 3 01 / 18/2005 Ms . Hilbert stated that in joint meetings the farmers wanted subdivision reviewed because it was too restrictive for them to use it ; every solution to allow for the development was subdivisions however the farmers and others said it was too expensive due to roadways, etc needing to be built . Ms Hilbert felt it was something the community, Town Board and Planning Board all agreed Subdivision needed to be revised ; so it could occur more easily to prevent what many people did not like about unplanned development . Mr. Porter asked how the new Subdivision regulation is different from the old regulations . Ms . Hilbert stated she was not sure . Mr. Means stated that is the proposed regulation we need to review . Mr. Porter asked how the cost of the subdivisions would be addressed in the revised regulations . Mr. Wertis stated that the word subdivision needed to be used carefully because subdivision can be as simple as paper dividing 20 acres into 5 4`" ; the other is clearly development planning on buildings, roadways and extending utilities which is a major subdivision. Ms . Hilbert reviewed a copy of the March 10, 2004 regulation and stated she did not have a copy of this revision. Mr. Wertis stated that the problem is linking clustering, conservation and agricultural use; and that is hard to do . Mr. Porter stated that all the discussions in prior months it comes down to money. Ms . Hilbert stated that without it we are also losing money for the community. Mr. Means offered somehow a percentage of X acres should concentrate on open land . Mr. Wertis offered that after pondering the revision he proposed that maybe not everybody is up to date on the 30/70 Plan . Mr. Porter stated the 30/70 is part of the Zoning Ordinance . Ms . Hilbert stated that a committee would be put together with some of the Town Board and Planning Board to address the subdivision . Mr. Wertis stated that other then the questions addressed from the September 23rd meeting; there are no additional comments to be addressed at this time . Ms Hilbert made a motion to adjourn .
