REGULAR M EETING The Regular Meeting of the Town of Cortlandville Planning Board was called to order at 6:30 p.m. by Chairman Chris Newell. APPROVAL OF MINUTES – 25 OCTOBER 2021 Planning & Zoning Officer Bruce Weber noted that Action #45 of these Minutes needed to be corrected to read “Items 1 thru 5 and 7 of the Cortland County . . .” A motion was made by Member Nasrin Parvizi to approve the Town Planning Board Minutes of 25 October 2021, as corrected. The motion was seconded by Member Ann Hotchkin, with the vote recorded as follows: Ayes: Chairman Newell Nays: None Member Renzi Member Parvizi Member Updyke Member Hotchkin Motion carried. This becomes Action #45 of 2021. OLD BUSINESS - NONE NEW BUSINESS Walter Davis, Applicant/Darrell Carter, Reputed Owner – 3931 West Road (NYS Route 281) – TM #86.13-01-45.210 – Conditional Permit for Proposed Food Trailer Chairman Newell recognized the applicant who explained that he had constructed a food trailer and was seeking a Conditional Permit to operate same in this small plaza. As indicated in the narrative accompanying the application, along with a map, Mr. Davis stated he had two options for the locations, as shown. The landlord has given his permission for him to do so. Member Parvizi asked about the utilities, and Mr. Davis stated his electrical is run off from a generator, and the cooking equipment is powered by propane. He will not be operating at night time, just breakfast and lunch. The food facility would be open a few times a week; during the nicer weather, he will be (T) Cortlandville Planning Board Regular Meeting Minutes via Zoom 30 November 2021 Page 2 of 3 elsewhere (fairs, etc.). PZO Weber added that what is planned is considered a drive-in restaurant and that is a permitted use under the Town Code. Member Nick Renzi asked if the parking of the trailer would impact the visibility of those exiting the parking lot onto Route 281. He also felt that a trailer parked on a median (one of the options), personally, did not look very good. Mr. Davis responded that, after the food trailer is used on a given day, it can be moved so it does not just sit there after service is over. Member Parvizi commented that the median at this plaza is not well developed. At the conclusion of this discussion, a motion was made by Member Hotchkin to approve the Conditional Permit for the food trailer, as requested. The motion was seconded by Member Laird Updyke, with the vote recorded as follows: Ayes: Chairman Newell Nays: Member Renzi Member Parvizi Member Updyke Member Hotchkin Motion carried. This becomes Action #46 of 2021. Cortlandville LLC, Applicant/Reputed Owner – 3156 Byrne Hollow Crossing – TM #105.00-01- 17.000 – Conditional & Aquifer Protection District Special Permits for Proposed Addition Chairman Newell recognized Attorney Jim Grosier and Chief Operating Officer Dan Wood of Byrne Dairy, who explained that they were seeking the above permits to retool the existing facility, including adding 1200 SF of mechanical space, construct a new truck scale and approach, and pave an additional small area. There will not be much of a change to the exterior. They will be converting the plant to manufacture extended shelf life dairy products. The plant will be shut down for a short time, just enough to remove the yogurt equipment and install the new equipment for the new products, about a month. Dan Ward explained the new process to the Board. The product will be sold domestically. A motion was then made by Member Hotchkin to send the applications to the Cortland County Planning Department for their review. The motion was seconded by Member Updyke, with the vote recorded as follows: Ayes: Chairman Newell Nays: None Member Renzi Member Parvizi Member Updyke Member Hotchkin Motion carried. This becomes Action #47 of 2021. OTHER DISCUSSION • Member Renzi reported that he had received the test reports for groundwater sampling that were performed at the Walmart facility. He ha talked with Kathleen McGrath who reviews the results and it has been left up to her whether or not the tests continue. He also reported that Ms. McGrath had contacted Walmart and received the groundwater testing reports which were satisfactory. Walmart will still do the testing two times a year. (T) Cortlandville Planning Board Regular Meeting Minutes via Zoom 30 November 2021 Page 3 of 3 • Sidewalks – Chairman Newell reported Member Hotchkin had set up a Committee meeting with DOT, Tom Williams, and Larry Drach to discuss this. Ann gave a report on their actual drive by to look at the new improvements in the City. Karen Missell, the DOT rep, made suggestions to them to assist with development of the sidewalks/crossings in the Town to make the Town more pedestrian friendly. Items to be taken up by the Committee will be the use of aerial maps to identify these areas. What about Regan Development (former Willcox Tire) and Cayuga Medical? Code Enforcement should be involved. What about sidewalks in our Code? Ann has copy of City Code regarding sidewalks. Nasrin gave items that should be made clear in a sidewalk regulation. Applicants need to be advised what they should do in this regard. Chris remarked this should be for new construction. Town Attorney John DelVecchio stated that this should all be discussed with Town Board before drafting. Outline to be worked out by Chris and Ann for the record. Ann said she could leave aerial photos at Town office; these could be marked up by Board members. • Solar seminar coming up on 12/21; 1.5 credits, 5:30 to 7 p.m. via Zoom. • Member Hotchkin asked questions regarding solar panels/batteries on cloudy day. Sunshine v. night. A long discussion followed. • Chairman Newell spoke about the former Conditional Permit Log which was generated as a follow-up to those permits granted. Doing this Log is time consuming. Do we have someone to check this out? Does someone need to be hired? How does the Board feel about follow-up? We assume that applicant will abide by conditions set for them. Maybe write up a memo to the Supervisor regarding this; he can bring it up with the Town Board who could hire a part-time individual to do this. Lard questions property access in some occasions. This could be a condition in the permit? CEO makes sure that applicant adheres to what’s conditioned. CEO has to give “stamp of approval.” PZO Weber then explained what the CEO looks at. Chairman Newell does not think someone should be hired to do this. • Next meeting – Zoom meeting on 28 December; will continue with Zoom for now. • Comprehensive Plan – Has been submitted to Town Board. Will be addressed at next meeting. Attorney DelVecchio said he would loan Member Hotchkin a copy of the Plan for her to read, as she requested. ADJOURNMENT At 8 p.m., a motion to adjourn the meeting was made by Member Updyke, seconded by Member Hotchkin, with all members present voting in the affirmative. Joan E.
