Planning Board Meeting
September 23 , 2004
Present : John Wertis, Chairman ; Planning Board Members Lorren Hammond, David Tyler,
Margot Chiuten, Rose Hilbert, David Means, absent Rod Porter; Codes Enforcement Officer Alex
Rachun; Liaison to Town Board Roxanne Marino .
Chairman Wertis called the meeting to order at 7 : 30 pm.
Discussion :
Re-revised copy of draft Site Plan Review section was distributed .
Ms . Marino clarified that Doug Austic , Bruce Wilson, George Frantz and herself reviewed the
Planning Board ' s incorporated comments at a scheduled Special Town Board meeting . Quorum
was not present that night.
Revised minutes of 8/25/04 were reviewed :
Ms . Hilbert suggested that comments be included in minutes .
Mr. Means made motion that minutes, as amended with edit and explanatory notes of the
Planning Board ' s suggested changes attached be approved .
Ms . Hilbert seconded the motion, all aye except for David T . , who was absent that meeting—
abstained.
The Board proceeded to review the updated draft of the Site Plan Review section . The following
were additional comments (insertions in bold , deletions underlined) :
a . p . 56, Phase III : It was thought that all three tasks should be edited to clarify that
the Town clerk performs all the tasks :
•
i . # 1 . . . . shall be advertised by the Town clerk
ii . #2 : The applicant shall be billed . . . by the Town clerk
iii . #3 : . . . shall be mailed by the Town clerk. Note : All present agreed that
the mailing occur at least five (5 ) days prior to the public hearing.
b . p . 57 , paragraph #4 :
i . . . . final site plan shall be submitted by the applicant to the Codes
Enforcement Officer
c . p . 58 :
i . #2a : ADD to end : and all easements, rights-of-way, covenants and
restrictions of record.
ii . ADD #3f: Hours of operation .
d . p . 60 , #9 : ADD to end : including but not limited to Article XVI—Design
Standards .
e . p . 61 , 15 . 2 . 10, second # 1 : change "interior space" to "gross floor area"
f. p. 62 , ADD the following final condition : and both the Codes Enforcement
Officer and the Planning Board Chair review the proposed modification .
David T . felt that it is a problem to permit modifications without resubmission to and approval by
the Planning Board, hence the addition of the above .
Discussion on lighting in the Site Plan Review :
g. Alex mentioned a recent development where the new lighting was excessively
glaring . It is possible that the lighting standards/requirements in the current
zoning are not sufficient.

h. Roxanne and Alex pointed out that there currently are Design Standards that are
implied in the Site Plan Review requirements .
i . Discussion on whether or not the Planning Board should review the new Design
Standards:
i . Some felt that the Town Board should request the review
ii . Others felt that if the Planning Board is to review Site Plans, they should
have knowledge of and review of the Design Standards.
iii . John will check with Doug; Roxanne will check with the Town Board
and recommend that the Planning Board should do the review .
Minutes of 9/9/04 were reviewed by those present:
Mr. Means moved to approve , seconded by Ms . Chiuten, Rose abstained, Margot, Lorren and
John voted aye .
