SPECIAL TOWN BOARD MEETING
September 15, 2004
PRESENT : Supervisor Doug Austic , Town Councilwoman Roxanne Marino ; Town
Councilmen Don Ellis, Robert Weatherby and Lee Scott absent; Town Clerk Marsha
Georgia; Deputy Supervisor Richard Coogan; Attorney Bruce Wilson; George Frantz .
The Board convened at 6 pm to continue the review of the Draft Zoning Law. The
Planning Board had previously reviewed the Site Plan Review in the draft and submitted
their thoughts to the Town Board . This meeting is to review what they submitted and
decide to accept or not.
Note : These minutes reflect the changes to the ordinance ; the tapes are available for any
discussions that took place at the meeting.
The Planning Board suggested that instead of using the titles such as Initial Application
number them Phase I for Initial Application, Phase II Preliminary Review, Phase III
Public Hearing, and Phase IV Post Public Hearing Review . The Town Board had no
problem with this .
Sketch Plan Conference
1st sentence — after Planning Board Chair add or his or her designee.
Delete the last sentence .
Initial Application
Change this title to Phase I
Application.
Delete Site Plan Review
#5 — delete — in narrative or graphic form
Last paragraph — Should read — The application for site plan approval shall not be
submitted to the Planning Board Chair until the Code Enforcement Officer receives all of
the above .
Before the next paragraph insert the title — Phase II
Preliminary Review
Insert by the applicant after Code Enforcement Officer.
Insert of any requested supplementary information before by the chair of the Planning
Board .
Before next paragraph insert — Phase III
Public Hearing
Make this paragraph
A. (and have it read) The Planning Board shall schedule a Public Hearing no later
than 62 days from its determination that the application is complete. The applicant shall
be informed of that Public Hearing date by the Code Enforcement Officer within five (5)
business days of the determination by the Planning Board.
Delete #2
#4 will become #3 — Notice of the public hearing shall be mailed to the owners of
record as of the last filed assessment role within 500 feet of the subject property at least
five (5 ) days prior to the public hearing.

B . At the time the Applicant is notified of the Public Hearing date they will be
required to obtain signage provided by the Planning Board by way of the Code
Enforcement Officer to be posted at the site by the applicant in such a manner as to be
readily visible Ito the public from the nearest adjacent public road at least ten ( 10) days
prior to the Public Hearing.

Post-Public Hearing Review
1st paragraph- add — ` s to Planning Board
5th paragraph — A final site plan shall be submitted by the applicant and must incorporate
any conditions or modifications that may have been made by the Planning Board in its
resolution. Compliance with all conditions shall be clearly indicated by the Applicant
and shall conform to the approved proposal . Compliance with all conditions shall be
clearly indicated by the applicant in the appropriate form .
After #3 add in a new paragraph — The Chair of the Planning Board or his or her designee
shall endorse the Planning Board ' s approval by signature or stamp on an original final
site plan drawing set and related supporting documents .
Site Plan Information Required
Make a new # 1 — Names and addresses of all owners of record.
Under new #3 — add in e . — Estimate type and volume of traffic .
Next to last paragraph — delete last sentence.
Review Criteria
# 1 — insert and between size, design and delete and general site compatibility
#3 — after bicycle delete access, insert facilities —
New #7 — Any applicateable stormwater management requirements
New #8 — The adequacy of the site layout for beneficial coordination with adjacent
properties with respect to pedestrian and vehicular traffic , recreational and undeveloped
or "open space".
Modifications to Approved Site Plans
#4 - delete the proposed shift — start sentence with - a shift that
#5 — delete including outdoor lighting
#6 — delete the proposed modification is not in violation — start sentence with — no
violation
Hearing no further changes the review of the draft zoning law ended . The next meeting is
scheduled for September 22 , 2004 at 6 PM .

Due to the lack of a quorum, the Chairman adjourned the meeting to be reconvened at
7 : 30 pm on September 22nd
