HomeMy WebLinkAbout2004-09-14 - TB TOWN OF ULYSSES REGULAR TOWN BOARD MEETING September 14, 2004 PRESENT : Supervisor Doug Austic , Town Councilpeople Lee Scott, Robert Weatherby; Roxanne Marino and Don Ellis ; Town Clerk Marsha Georgia; Highway Superintendent James Meeker; Attorney Bruce Wilson . Deputy Supervisor Richard Coogan absent. Supervisor Austic called the meeting to order at 7 : 30 pm, and led those assembled in the Pledge of Allegiance to the Flag of the United States of America. APPROVAL OF MINUTES - RTB 08/17/2004 AND SBM 08/24/2004 Ms . Marino previously submitted minor corrections and/or changes to the Town Clerk and Board members for the August 17, 2004 Regular Town Board meeting and Special Town Board meeting of August 24, 2004 that were accepted by the Board. Mr. Ellis moved, seconded by Mr. Scott to approve the minutes of the August 17, 2004 Regular Town Board meeting and the Special Town Board meeting of August 24, 2004 with the changes and/or corrections submitted. APPROVAL OF MONTHLY CLAIMS Mr. Weatherby moved, seconded by Mr. Scott to approve the previously examined vouchers #418 through 459 in the amount of $ 61 ,461 .49 . Mr. Austic aye Mr. Scott aye Mr. Weatherby aye Ms . Marino aye Mr. Ellis aye Adopted. REPORTS OF REPRESENTATIVES Tompkins County Board of Representative Peter Penniman absent. Trumansburg Fire Department no one in attendance. Planning Board Chair John Wertis absent. Other -none heard. TOWN REPORTS Highway Superintendent James Meeker reported the highway crew stoned and oiled Rabbit Run Road and Penn. Ave. ; installed a culvert pipe for a new field driveway on Wilkins Road; helped Newfield do some stone and oiling; stoned and oiled Reynolds Road; double surfaced treated Mekeel Road; sealed Cold Springs and sealed the paving on Cayuga View Road. They are back in Enfield to help them pave. The Tow still has Pine Ridge Road to pave but is waiting on the asphalt company, which is behind because of the rain. Mr. Meeker inspected the TRA Development road . The paving and Regular Town; Board Meeting 2 09/ 14/2004 shoulders are done and Mr. Meeker requested them to reshape and grade ditches and seed more until he will accept it. Attorney Wilson stated he has not received any papers in relationship to the road or the lighting district and he has spoke with them a couple of time . Mr. Meeker reported he had been in contact with the Trumansburg School and they will not drive up the new road until the Town takes ownership, therefore the children have to walk down and be picked up on Route 96 . Mr. Meeker was asked what his opinion was of the road. Mr. Meeker stated they have done a decentijob on the road but he did have a problem with them on the base material on part of it. Before they paved it he had them strip the entire base out and dig down further and replace sub-base and re-roll all of that and than bring in some bigger courser material and than the top course went back on. Mr. Ellis asked if there was a sidewalk. Mr. Meeker stated there is no sidewalk and the Town does not require sidewalks on Town roads . Mr. Austic stated he had a discussion the other day with the developer as Code Enforcement Officer for the Village and told them he could not give them a CO until the developer decides what they are doing with the sidewalk. Originally in the plans the sidewalks were to go along the road but the developer told Mr. Austic the Village had exchanged the agreement to pay for the water pump system of $ 70,000 with not doing sidewalks . The developer and the Village of Trumansburg are going to have a meeting to resolve this . Mr. Austic stated the original plan had sidewalks but than in April on the final plans the Village Planning Board took them out. The question is what happened in between and Mr. Austic was not involved. Mr. Wilson than stated it than becomes an issued of who will maintain the sidewalks . Mr. Ellis asked about the CO for the buildings . Mr. Austic stated the first building was issued a CO and the other building is due to be finished in September. Mr. Meeker stated the developer has spent more money on the road because he requested additional work. Mr. Austic said in the question of the sidewalks he does not know what the agreement is between the Village and the developer. The Town does not require sidewalks on the Town road and nor do we know what the liability or do we want the liability. w lks but it does raise a question of Mr. Wilson stated they did agree originally to do side a q Y g liability and maintenance . Mr. Austic stated he could make the developer post a performance bond to complete sidewalks before he issues a CO. It was discussed it would make more sense to have the sidewalk come down their easement they have for their utilities . It is a shorter and more direct route from the buildings . Code Enforcement Officer Alex Rachun reported the total number of building permits issued for the month of August is five, two for single- family homes and three for additions . There also was one area variance for the sub-division of a lot before the Zoning Board of Appeals that was denied until more detailed plans can be presented. Mr. Rachun will be attending schooling for fire inspection certification at the Fire Academy along with the Deputy Zoning Officer and Supervisor Austic . Mr. Rachun reported the Regular Town Board Meeting 3 09/ 14/2004 Cayuga Addiction Center is getting close to a final inspection and will soon receive their CO . Mr. Ellis asked Mr. Rachun if he could tell him how many houses had been built this year. - Mr. Rachun did not have information with him but he would provide it for the Board. Town Clerk Marsha L. Georgia reported for the month of August she collected $6 , 148 total and turned $ 1008 . 01 for clerk fees and $ 390 for plumbing permits over to the Supervisor along with her monthly report. A total of $4,408 . 69 was collected for sporting licenses . The Clerk' s office has been busy with the training with Williamson Law for the water billing and also had the training with Neptune for the meter-reading program will interface with the billing program . Mrs . Georgia hopes to have water bills out by the middle of September. The Board discussed amending the Local Water Law to have it mandatory that any new homes built in the district would have to hook up to the water and also providing some incentive to present residents to hook up . The Town sometimes gets low chlorine readings because of the lack of users . Board Members and Committees Mr. Ellis had a question for Mr. Wilson about providing some information to him that was attached to the correspondence about the e-mails . It was opinion #3752 and Mr. Ellis needs another copy of this to read because part of it was missing. Mr. Wilson will provide. Mr. Wilson stated the Opens Meeting Law also provides for minutes to be posted as a draft within two weeks of the meeting. This question came up with the Planning Board. Mr. Ellis stated what he was reading sounds like it is not clear that boards have to have minutes . Mr. Wilson stated boards have to have minutes but the boards minutes do have to be a transcription or stenographic record (verbatim) , minutes require attendance, resolutions, who moved and seconded, who approved and the actual text of the motion. They do not require discussions or a dialogue. It could say a discussion took place for fifteen minutes but does not have to take that discussion down. The Board can require the format of what they want in minutes even to the point of they can require they be verbatim but the State Law does not require this . It requires the clerk take down attendance, motions, resolutions and the votes on them, any business conducted. It does not necessarily mean it is a live CNN congressional record of the meeting. You can as a board, require anything you want to be put into the record. But what Mr. Wilson is saying what ever the minutes are weather they are minimum of maximum as the board decides to make them they do have to be posted within the two weeks of the meeting at least as a draft . Mr. Ellis asked Mr. Austic if he might be able to find some time for budget training? Ms . Marino had previously talked to Mr. Austic about a morning for this. It was set up to meet Friday morning at 8 am with Ms . Marino and Mr. Ellis Supervisor Doug Austic reviewed his monthly financial report. Mr. Austic state there would be some budget adjustments will have to be made in the near future. One of them being the account for attorney has never been adjusted since the contract to pay Mr. Wilson on a yearly basis . Regular Town, Board Meeting 4 09/ 14/2004 Mr. Austic has request the department heads submit their requests for the 2005 budget . These have to be returned to him by the 20th of September so he can prepare the budget . The tentative budget will be presented to the clerk by the 30th of September and than the clerk will distribute the tentative budget to the Town Board . Mr. Austic will also make available to the Board any other requests that come from organizations such as the library. The Board than can schedule as many Budget Workshops to review the budget and make it preliminary and ready for a public hearing. Mr. Ellis asked about any work sheets Mr. Austic might have for the water. Mr. Austic will provide any information he has . Mr. Austic stated the water department might have to hire a person and buy some other supplies to dol the inspections . OLD BUSINESS Report On Office of Real Property Litigation The Town received a bill for over $700 that was for the litigation of a property dispute and/or assessment with NYSEG. Mr. Austic has the report that was sent to the Town for anyone to review . Other No other old business . NEW BUSINESS Budget Process Supervisor Austic stated he felt the budget process was previously covered and asked if anyone had any further questions . Ms . Marino has the budget schedule and was wondering if it would not be a good time to schedule some meetings for the review. Ms . Marino stated in her schedule it states that the clerk will present the budget to the Board at a meeting to be held on or before October 5th. Mr. Austic stated the board will have the budget after September 30th and the Regular Town Board meeting is October 12th. The Board will have the two weeks to review the budget and at the meeting they can set some budget work sessions and/or discuss it at the Regular Board Meeting. Mr. Ellis stated he did not have his calendar with him tonight and therefore would be difficult to schedule any meetings . TCMOA Meeting . Supervisor Austic announced the meeting of the Tompkins County Municipal Officers Association to be held on September 20th, 2004 at Icabod ' s . Stormwater Process Deputy Supervisor Coogan was absent tonight and he knows more about where they are in the process . Mr. Austic does know they have held several meetings and making progress . His understanding is they have broken it down into what we can do and what we cannot do and where we should do it and where we should not do it. They are talking about 15 % or greater slopes, which is basically in the MS4 area. Ms . Marino stated her understanding is they are looking at 7% to 14% also . { Regular Town Board Meeting 5 09/ 14/2004 Mr. Austic commented DEC does not a real clue as to what they are going to require and they are changing their process . Until DEC makes some kind of decision the Town will not know what will to required. The DEC may require the Town be responsible for stormwater inspections- a lot of unanswered questions . Town Hall Maintenance - Painting - Furnace -Floors Mr. Austic stated back in 1996 when the building was renovated and added on to the Town use the existing furnace although we were told it was undersized. We have Hubbard Plumbing and Heating maintain the furnace and he is saying it should be replaced . Hubbard' s gave us an estimate to replace the furnace//air conditioner, which is around $ 10,000 but the ductwork is adequate . The other two maintenance items is the exterior painting of the trim on the building and stripping and re-waxing the floors . Mr. Austic does have an estimate for painting from Denmark ' s . Mrs . Georgia has gotten an estimate from one company for the floors and will get a couple of others . The one she has is for $ 1 , 194 . Mr. Austic feels we need to ask for other estimates on these three things and bring them back to the Board . Mr. Ellis moved, seconded by Mr. Weatherby to authorize Mr. Austic to ask for estimates for the furnace, exterior painting, and the floor stripping. Mr. Austic aye Mr. Scott aye Mr. Weatherby aye Ms . Marino aye Mr. Ellis aye Adopted. Mr. Ellis commented there still is a question about the courtroom bench. Mrs. Georgia stated no one has given her a date to meet with Ithaca Millwork again. When she has that she can arrange a time to talk to them . Town Barn Roof The roof at the Town Barns needs to be replaced and Mr. Austic Asked Mr. Meeker if we should advertise to see if me could get estimates . Mr. Meeker feels that it to late this year. Mr. Meeker stated we need better weather, years back there was a fire so there is a lot of charred material . The roof needs to come off and all the charred material needs to be replaced. Some of the rafters will need to be replaced so you will need several days to complete without rain. Mr. Scott stated the Town of Enfield put a new building and they received government- matching funds . We may want to see if anything is available . Mr. Meeker stated there used to be, under some of these plans, you could put up these buildings but he thinks they have done away with because they do not feel the grant money for a lot of this stuff should go for buildings or equipment .
