PLANNING BOARD MEETING
AUGUST 25 2004

`Meeting called to order at 7 : 35 p .m .
Minutes of the 8/ 12/2004 meeting were reviewed. Approval moved by Rose Hilbert and
seconded by Rod Porter.

The rest of evening was spent in a continuation of the Planning Board ' s review of the
current suggested changes to the Site Plan Review procedure as embodied in the Draft
Ordinance Revision Proposal of 6/ 10/2004 . Where Planning Board members reached
consensus on changes they wished to be passed on the Town Board, Mr. Wertis noted
these changes on a designated "marked copy" of the 6/ 10/2004 Draft .
In addition, relative to Section 15 . 2 . 5 , a supporting document prepared by Mr. Hammond
is hereby entered into the record as follows :
In the Fall of 2003 at joint meetings of the Town and Planning Boards, I proposed
the following addition to the Site Plan Review "Review Criteria" in the proposed
Ordinance. It would be added in section 15 .2 . 5 , I believe, and would extend the sentence
that calls for reviewing "the adequacy of arrangements for the protection of " The
addition provided a simple method for reviewing and affecting proposed layouts with
respect to a few critical considerations in land-use Planning; adding it to Site Plan
Review. These issues, maintaining contiguity of pedestrian and vehicular traffic
accommodations, and contiguity of undeveloped space and wildlife habitats, are
throughout the US . However, these considerations are hard to address effectively in an
Ordinance except during individual Site Plan Reviews, where the impacts of a specific
proposed site plan be addressed as they relate to the circumstances and features of the
specific properties effected. Without some such provision providing oversight of
development as it effects such patterns across property lines, the community has no real
method to ensure that individual projects dovetail positively with the Town-wide goals
articulated by Town residents in the Comprehensive Plan. As such, this proposed change
in language was met with enthusiasm and approval by both Boards when I presented it,
so I promised to get a copy of it out for inclusion in the final incarnation of the proposed
Ordinance. Here it is .
The Board ' s review of a site plan shall include, as appropriate, but shall not be
limited to :
7 . The adequacy of arrangements for the protection of adjacent properties from
any undue disturbance, such as may be caused by excessive or unreasonable noise, glare,
vapors, smoke, fumes, dust, odors, storm water runoff; as well as adequacy of site layout
for beneficial coordination with adjacent properties with respect to pedestrian and
vehicular traffic, recreational, undeveloped or "open" space, and contiguous wildlife
habitats .
Mr. Hammond moved the following Resolution, seconded by Mr. Porter:

Resolution to the Ulysses Town Board from the Ulysses Planning Board
Regarding the Planning Board ' s Review of the 7/20/04 Draft of the Ulysses Zoning Law
Having completed our formal review of the Site Plan Review section ( 15 . 2), of the
Proposed Ulysses Zoning Law dated July 20`h, 2004, which included recent editing by the
Town Board as shown in our designated "official copy" submitted by the Planning Board .
The Planning Board requests that the changes noted be incorporated into the final Zoning
Ordinance d ol,cument listed as follows :
Pages 55 - 56 : In 15 . 2 . 3 clearly divide the "steps" in the Site Plan Review process and
Identify them a "Phase I, Phase II, Phase III, etc . . . "
Page 55 In the first line of the "Sketch Plan Conference" change the original and
Bd. ' s Revision to read " . . . applicant, Zoning Officer, and the Planning
Board Chair or the Chair ' s designee . " This also makes the last line in that
Paragraph redundant and it can be deleted.
Page 56 In the first insert "Chair" as follows . . . "Submitted to the Planning Board
Chair until . . . "
Page 56 Second paragraph, third line . . . insert to read, "the information requested
Shall" and the fourth line . . . insert to read "to the Code Enforcement
Officer by the applicant and then forwarded"
Page 56 Use the "Phase Terminology" . . insert "the Phase I application for site plan
Approval shall not be"
Page 56 Between Phase II and Phase III insert the following : "( 1 ) Upon it
determination that the Phase II requirements have been met, the Planning
Board shall schedule a Public Meeting to be held no later than 62 days
from said determination and the Applicant shall be informed of that Public
Hearing date by the Code Enforcement Officer within five business days,
and (2) At the same time the Applicant is notified of the Public Hearing
date they will be requested to obtain signage provided by the Planning
Board by way of the Code Enforcement Office to be posted within ten
business days of the date the determination was made ; said sign must be
posted at the site by the applicant in such a manner as to be readily visible
to the public from the nearest adjacent public road.
Page 56 The Planning Board agrees with the Town Board ' s change of informing
adjacent property owners in ten days instead of seven.
Page 56-57 Change the final paragraph on that page to read. " A final site plan shall be
submitted by the applicant and must incorporate any conditions or
modifications that may have been made by the Planning Board in its
resolution. Compliance with all conditions shall be clearly indicated by
the applicant. " And . . . move the paragraph that precedes this to the
location after # ' s 1 ,2 , 3 so that it concludes Phase IV when there is
"approval" .
Page 57 Under 15 . 2 .4 Insert a new # 1 to read as follows : "Name and Address of
all owners of the property and name and address of all persons with an
interest in the property such as easement and rights of way. "
Page 57 -58 : The above changes the numbering to 2 , 3 and 4 .
Page 58 In the renumbered 3 adds the following. "e. Hours of operation f. Type
and numbers of vehicles entering and exiting the site daily. "
Page 58 in the next-to-the- last paragraph delete the last sentence.

Page 59 In the Review Criteria, change # 3 to read : "6 . Protection of adjacent
neighboring properties from any undue disturbance, such as may be
caused by excessive or unreasonable noise, glare, vapors, dust, odors, or
storm water run-off; as well as the adequacy of the site layout for
beneficial coordination with adjacent properties with respect to pedestrian
and vehicular traffic , recreational , undeveloped or "open" space and
contiguous wildlife habitats . "
Page 61 delete the second sentence that starts "After receipt . . . " put a semicolon
after "permit" and add "if it" and in the "or" sentence add the word
"involves"
Page 61 In the "or" list "( 1 -6)" in number 5 delete "including outdoor lighting. "
