®. ZONING BOARD OF APPEALS
August 11 , 1971
A public hearing was held by the Town of Ithaca Zoning
Board of Appeals on August 11 , 1971 at 7 : 30 - p . mo in the Town
of Ithaca Offices , 108 E . Green Street , Ithaca , New York .
PRESENT : ( add list of names on bottom of page 2 )
Mr . Ronald J . Meiczinger appeared to appeal the decision
of the Zoning Officer denying permission for use of property
at 1395 Mecklenburg Rd . ( former Flowerfield ) for a Retail Outlet
and Auction House . Permit was denied by the Zoning Officer
under Art . V . , Sects . 18 and 19 of the Zoning Ordinance .
David Cowan , Zoning Officer , read to the Board the request
for a variance on the business property at 1395 Mecklenberg Rd .
stating the following reasons : The house and business propety
were purchased as a unit . Taxes and insurance on the business
® property make it necessary to rent it in order to avoid a financial )
hardship .
The front portion of the house is to be used as a retail
used furniture outlet and the rear portion for an auction house .
Parking space is available off the highway , and only the signs
already on the property will be used ; that is , an illuminated sign
attached to the building and used by the previous owner , and a
signpost now located near the road , displaying a sign of allowable
size .
The variance is requested only for a period of one year .
Mr . Meiczinger reported that auctions will be held on a regular
once a week basis during the summer , sping , and fall . It is expected
that during the winter months , auctions will be possible twice a
month , and will be flexible due to weather conditions . Articles of
clothing will not be sold , nor auk+ such items as large farm
machinery such as tractors , plows , drags , etc . The retail portion
® of the store will range from medium quality inexpensive items to
the much more expensive and better quality . Rules for the auction
house will be posted inside and announced before the start of each
auction . A parking attendant will be on duty to supervise parking

® and ensure that there is no parking on the roadway .
A question was raised as to the time auctions will be held ,
It was reported that auctions will last from 6 : 00 p . m . to about
10 : 00 p . m . and cars should be cleared. out of the area within a
half hour after closing , It was also reported that there was
were 37 acres available for parking . Illumination will be pro -
vided in the parking area when cars are leaving after the auctinn ,
Mr . Carpenter , a resident of the area , stated his opposition
to such a development since this is not in accordance with the
present zoning laws .
A question was raised concerning the placing of articles
outside the building for storage , Mr . Meiczinger reported they
would comply with all rules regarding storage , snow removal , and
lawn mowing .
The Board recessed at 7 : 50 P . M . to continue discussion of
this subject .
® Subsequently , Loran Marion made a motion thatthis meeting
be adjourned for two weeks in order to allow the Board of Appeals
time to obtain legal advice .
The motion was seconded by Jack Hewett , and unanimously passed .

Wednesday , August 25 , at 7 : 30 P . M .
