The regular meeting of the Town of Ithaca Zoning Board of
Appeals was held Tuesday , March 23 , 1971 , in the Town of
Ithaca Offices : , 108 E . _ . Green Street , Ithaca , New York . /
Present : Chairman David Powers Loran' Marion , Mrs . . Laurene ✓
Ripley , David Cowan ( Zoning Officer ) , Truman Powers , and
Lawrence . Beach .
Appointment of d .ack Hewitt : Loran Marion made a motion
that - the Zoning Bo . ard recommend to the Town Board the. appoint -
ment of . Mr . Jack Hewitt to the Zoning Board of Appeals for the
duration of the term created by the death . of Mr : Anselm Soyrin 'g .
The motion was seconded by ,David Powers , and unanimously passed .
Appeal of East Lawn Cemetery Association : A public
hearing was held to appeal the decision of the Zoning Officer
denying permission for Cemetery Extension . at Maple Avenue . ,
Town of Ithaca . The permit was denied by the Zoning Officer ;
under Art . V , : Sect . 1 . , par . 12 of th. e. Zoning Ord. inance . ,
® Mr . Truman Powers presented . the proposed plans for the
extension of East Lawn Cemetery . He reported that ' the .re ar 'e
only a . few remaining lots . in the presently developed . area
which is their reason for desiring expansion . . The land has
beden ` owned by them since 1924 and has been held for "the ; pur
pose , .of further expansion .
Mr . Cowan reported that the reason for . the denial under
Art . V , Sect . par . 12 was building . of a cemetery calls for
s p e c 1 a 1 approval by Board of Zoning Appeals . .
Mr . Loran Marion made a motion that the Zoning Board of
Appeals grant special approval to the East Lawn. Cemetery
Association for the western expansion of said cemetery " as
submitted . by the m ,ap of September 21 , 1970 . The motion . was.
seconded by. Laurene Ripley and unanimously . passed .1.

Voidance of Permit 805 to Lynch Excavating Company Action
r' on the voidance of Permit 805 to the . Lynch Excavating Company
for gravel extraction on Enfield Falls Road was deferred to the
' April meeting of the Board of Zoning Appeals . Mr . Cowan requested
voidance since the company has ceased to ex .i ;st .. However , Mr .
Charles Treman of the Tompkins County Trust Company , which is
acting as . trustee to the Company , maintains that . the company
has not ceased to exist , but rather ceased to operate .
This hearing will be deferred to next - month ; Mr : Cowan
will talk to the Town Attorney to determine if it is legal to.
sell a ` variance . It was also pointed out that Lynch Excavating
Company had not been operating under the conditions which the
permit stated when given . Mr . . Cowan will also talk to Mr .
Treman .
Adjournment : The meeting o .f . the Board of Zoning Appeals
was adjourned at 8 : 20 p . m .
