Town of Harford
The Town Board. of the Town of Harford met for a regular
meeting on January 8,1979 at 8p.m. in the Town Highway Garage.
Members present were: Barber, Cross, Sager, and VanD Weert.
The minutes of the December 4, and December 18,^1978
meetings were read. Sager made a motion to accept the minutes
as read . Barber seconded.. All were in favor.
The bills listed on Highway abstract 1, claims 1-8, pay-
roll abstract 12, and General abstract 1, claims 1-9 were read.
Sager made a motion to authorize these bills. Barber seconded.
All were in favor.
The Supervisor's Monthly Statements were presented. Barber
made a motion to approve these. Sager seconded. All were in favor.
Sager introduced a resolution to designate the Cortland.
Standard. as the official newspaper of the Town and the First
National Band of Dryden as the official depository.
Further resolved to appoint Lawis G. Sager , Deputy Supervisor;
Joyce VanDeWeert, Registrar; Doris Canfield,& Garret VanDeWeert,
Deputy Town Clerks and Registrar; Leonard Kimmich, Chairman of the
Assessors; Grant VanSant, Town Attorney; Ronald Birdsall, Dog Warden
Constable; and Gordon Leete, Code Enforcement Officer of the Land
Use Ordinance.
Further resolved to set the Town salaries as follows:
The Supervisor's salary of $800 to be paid as follows: $300
on July 1,$500 on or about Dec.15.
The Councilmen's salaries of $600 to be paid as follows:'
$200 each, to be paid on or about Dec.15.
The Town Justice's salaries of $1,350 to be paid as follows:
Sager $300 on July 1 and $550 on or about Dec.15:; Allen $250 on
July 1 and. $250 on or about Dec. 15.
The Superintendent of Highway's salary of $10,500 to be paid
as follows: $437 semi-monthly and the balance on or about Dec.30.
The Town Clerk's salary of $1,200 to be paid as follows: $100
a month and the balance on or about Dec.15.
The Assessor's salaries of $1150 to be paid as follows: Chair-
man to be paid. $600, the other two $200 and $250 on or about Oct15.
The Budget Officer to be paid once a year, $550 on or about
Dec. 15.
The Dog Warden to be paid $250 on or about Dec.15.
The Code Enforcement Officer to be paid $300 on or about Dec.15.
The Harford Mills Water District Superintendent to be paid
$300, $150 on July 1 and. $150 on or about Dec.15.
The election inspectors to be paid as follows: Primary day,
$3.00 an hour, Election day, $3.00 an hour, with pay for two extra
hours on election day.
To pay the Janitor of the Town Hall $350 on or about Dec.15.
Board of Review members to be paid $20,each on or about Oct. 15.
Further resolved to authorize the Highway Supt, to spend up to
$1,000 on small tools and implements.

Town of Harford.
Further resolved to set the Town mileage rate at 17r, a mile.
Further resolved. to set the Town Jury rate at $4.00 a day,
plus mileage.
Further resolved to establish a petty cash fund of $50 for
Tax Collection and $20 for Town Clerk.
Further resolved to hold. regular Town Board meetings on the
first Monday of each month, except when it falls -.n. -on a holiday,
when it would be the next business day. The meetings to be held. •
in the Town Highway Garage at 8p.m..
Cross seconded the resolution. All were in favor.
The Harford Mills Water Superintendent reported that he had
contacted the County Health Dept. concerning the problem with
the water hydrant in the 1'4ills. The County said that they had
notified the State that they were in violation of the health code.
Cross made a motion to authorize the Town Justice's to attend
the annual Associations of Towns meetings Feb. 18-21 and to authorize
one of them to vote for the Town. Barber seconded. All were in favor.

meeting on January 15,1979 at the Town Highway Garage at 8p.m.
Members present were: barber, Cross, Sager, and VanDeWeert.
The books of the Supervisor, Town Clerk, and Town Justices
were audited and found to be corrct .

The Town Board of the Town of Harford met for a regular
meeting on February 5,1979 at 8p.m. in the Town Highway Garage.
Members present were: Barber, Cross, and VanDeWeert.
The minutes of the January 8 and January 15, 1979 meetings
were read. Barber made a motion to accept the minutes as read..
Cross seconded. All were in favor.

authorize the Supervisor to pay these bills. Cross seconded. All
were in favor.
The Supervisor's Monthly Statements were presented. Cross
made a motion to approve these. Barber seconded. All were in favor.
Legislator Bays reported that the schools in the County were
requesting a share of the County Sales tax. He also informed us that
the Legislators were still negotiating with County employees over
wage increases.
A letter from the Commissioner of Agriculture and. Markets
was read declaring a county wide quarantine on dogs effective
January 23 until March 23, 1979.
Barber made a motion to appoint the following dog wardens:
Robert Lacey, Lynn Carpenter, Gary Tennant, Leonard. Kimmich, and
Gordon Leete. Cross seconded. All were in favor.
The Supervisor reported. that he had received a couple of
complaints about the highway employees towing private vehicles
withhighway plows and plowing and cindering private drives.
The highway superintendent replied that they had had to tow
several cars out of the roads.

The minutes of the February 5,1979 meeting were read.
Cross made a motion to accept the minutes as read.. Barber
seconded. All were in favor.

Water District #1 abstract 1, claim: 1. Barber made a motion' -,.to
authorize the Supervisor to pay these bills. Sager seconded. All
were in favor.
The Supervisor's Monthly Statements were presented. Barber

Town of Harford
made a motion to approve these. Cross seconded. All were in favor.
Eugene Lacey and Kenneth Apgar attended. the meeting. Eugene
Lacey inquired. about what road work had been done the past year
and. what equipment had been purchased by the Highway Dept. He
wanted to know why the cinder spreader couldn't be put on the
Brockway or Oshkosh trucks. The Highway Superintendent informed
him that the truck bodies were too short.
The Supervisor asked. the opinion of the Board on updating
property tax assessments in the County. Board members felt
that they would, like to get more information from Legislator
Bays before they made a decision.
Sager made a motion to extend the time of tax collection
for the Town of Harford from April 1 to June 1 ,1979 . Cross
seconded. All were in favor.
The Dog Warden's Report for January and February was:_ read

The Town Board of the Town of Harford met for a regular
meeting on April 2,1979 at 8p.m. in the Town Highway Garage.
Members present were: Barber, Cross, and Va.nDeWeert.
The minutes of the march 5,1979 meeting were read. Cross
made a motion to accept the minutes as read. Barber seconded.
All were in favor.
The bills listed on Highway abstract 4, olai.ms 36-48,
payroll abstract 3, General abstract 4, claims 20-27, and.
Harford Mills Water District #1 abstract 2, claim 2 were read.
Barber made a motion to authorize the Supervisor to pay these
bills. Cross seconded. All were in favor.
The Supervisor's Monthly Statements were presented. Barber
made a motion to approve these. Cross seconded. All were in favor.
Iegtslator Bays reported that the County Legislature was
investigating the cost of a county -wide update of property
assessments. He further informed us that the Legislature
had raised the amount earned by persons 65 or over eligible
for an exemption on their County taxes to $7,200.
A letter of resignation from Charles Huff was read.. Barber
made a motion to accept the resignation. VanDeWeert seconded.
A l l were in favor.
David Stoner was present to express his interest in filling
the Councilman's position.
Nancy Chevalier was also suggested as a possible replacement.
Barber made a motion to appoint David Stoner, Councilman, his
term to be from this date until December 31,1979. VanDeYaeert
seconded. All were in favor.
Cross made a motion to authorize the Supervisor to pay $15

The Highway Superintendent announced thAt Town clean-up
days would be May 14 and. May 15.
The Supervisor informed members that the Harford Cemetery

Federz1_41on. Barber seconded.. All were in favor.
Alletter was read from Jim Lafever inviting any interested,
persons to a fire meeting to discuss fire laws as they pertain
to towns etc..
A.letter was read from Mrs. Gladys Towne informing the Board.
that the members of the Trout Brook Rebekah lodge had. consolidated
with the Rebekah lodge of Homer, and. that they had removed their
furniture and equipment from the Town Hall.
Highway Superintendent Russell expressed his concern over
the highway department obtaining a dump truck suitable for their
needs. He asked the Board's feeling on the matter. A discussion
was held with no action taker..

meeting on May 7,1979 at 8p.m. in the Town Highway Garage.
Members present were: Barber, Cross, VanDeWeert, and Stoner.
The minutes of the April 2,1979 meeting were read. Barber
made a motion to accept the minutes as read. Cross seconded.
All were in favor.
The bills listed on Highway abstract 5, claims 49-63,
payroll abstract 4, and. General abstract 5, claim 28 were
read. Barber made a motion to authorize the Supervisor to pay
these bills. Cross seconded. All were in favor.
The Supervisor's Monthly ,Statements were presented. Barber
made a motion to approve these. Stoner seconded. All were in favor.
Legislator Bays reported that the Legislators were discusssing
the possibility of off-track betting in the County. He said the
final decision would be found by a permissive referendum. He
further reported that the sheriff's contracts had been approved.
by the LegislatiurQ.
(;ordie Leete asked whether or not a permit was needed when
a trailer was taken out and another moved in its place. It was
decided that a permit should be obtained.
Cross made a motion to approve the trailer permit application
submitted by John Marshall. Stoner seconded. All were in favor.
Barber made a motion to appoint William Highfield to the
Board of Review for a five year term. VanDeWeert seconded. All
were in favor.
The Highway Superintendent announced thAt Town clean-up
days would be May 14 and. May 15.
The Supervisor informed members that the Harford Cemetery

Association would like to set up a meeting with the Town Board
to discuss the possibility of the Town taking over the Cemetery.
Dick Russell said that he was still looking for a dump truck.
He informed the Board that he plans to work on Seaman Rd. and
Michigan Hill Rd. this year.
Water Supt. VanDeWeert reported that he had contacted. the
County Health Dept. about the water hydrant on - 14aed��Le. in
Harford Mills. He was told that they would look into it but
didn't know whether anything could be done. VanDeWeert said that
it was possible that the water system could get contaminated from
the problem. The Supervisor said he would contact Dick Bassler
to see if he could help.
VanDeWeert made a motion to authorize the Harford Fire Dept.
to use the Town Field June 21,22,23 for their convention. Barber
seconded. All were in favor.
The Code Enforcement Off'icer's Report was read.

The Town Board of the Town of Harford met for a regular
meeting and to hold. a public hearing on the Town's ambulance
contract with the Dryden Neptune Hose Co. on June 4,1979 at
8p.m. in the Town Highway Garage. Members present were: Barber,
Cross, Sager, Stoner, and VanDeWeert.
The notice for the hearing on the ambulance contract as it
appeared in the Cortland Standard was read.
There were no visitors present. The Supervisor declared
the hearing closed.
The minutes of the May 7,1979 meeting were read. Sager
made a motion to accept the minutes as read. Barber seconded.
All were in favor.
The bills listed on Highway abstract 6, claims 64-75,
payroll abstract 5, General abstract 6, claims 29-33, and
Harford Mills Water Distract#1 abstract 3, claims 3&4. sager
made a motion to authorize the Supervisor to pay these bills.
Stoner seconded. All were in favor.
The Supervisor's Monthly Statements were read. Cross made
a motion to approve these. Sager seconded. All were in favor.
Legislator Bays reported that the County Legislators had
hired. a personal director.
Sager made a motion to approve the trailer permit application
submitted by William Ketter. Stoner seconded. All were in favor.

8th at 1-5p.m. was read.
Stoner expressed his concern about the condition of the Town
field. Dick Russell said that the Highway Dept. would work on it
if -they were told what had to be done. It was mentioned that the
back stop needed to be repaired.
During the discussion, Lloyd Cotterill came in to request
®
also that the condition of the field be improved. It was decided.
that Stoner, Fussell, and Coterill would meet the following night
on the field to look the field over to see what needed to be done.
- It was suggested. that the barn behind the Town Hail be moved
to the Town field to be used as a shelter.
Sager made a motion to authorize the Highway Dept. men to
move the barn behind the Town Hall to the Town field. Stoner seconded.
All were in faovr.
Sager made a motion to appoint Sharon Goldman and Nancy
Hulslander regular democratic election inspectors with Sandy
Liddington and nary Ann hfegus as alternates. Barber seconded..
All were in favor.
A letter was read from Jim Doss stating 'that if ---something
wasn't doge=about.-the•. Brotherton property he would resign form
the mooning Board of Appeals.
A discussion was held about what to do about the property.
The Code Enforcement Officer said hewould contact i\1Ir. Brotherton
and inform him that he is in violation of the Land Use
an' .-hat if he doesn't clean it up after thirty days that the
-
Town will do so and. the cost added on to his taxes.
Sager made a motion to authorize the Harford Firemen to
have Sky Divers at their convention on June 21,22, and 23.
Stoner seconded. All were in favor.
Sager suggested that a portion of the second floor of the
Town Hall be converted sothat it could serve as a Justice court
room. The Supervisor suggested that the Tom Board. members
meet at the Town Hall on July 2, our next meeting night, at 7:30
to look the situation over.
Sager made a motion to approve the ambulance contract with
the Dryden Neptune Hose Co.. Barber seconded. All were in favor.
Sager volunteered to make two copies of the map in the ambualnce
contract showing where the Dryden ambulance coders. It was suggested
that this be put on a poster sith the fire control number that is
to be called for ambulance service.

The Town Board of the Town of Harford met on July 2,1979
at the Town Hall at 7:30p.m. to examinine the possibility of
using a portion of the second floor for a Justice court room.
The regular meeting of the Town Board began at 8p.m. in
the Town Highway Garage. Members present were: Barber, Cross,
Sager, and VanDeWeert.
The minutes of the June 4,1979 meeting were read. Barber •
made a motion toaccept the minutes as read. Cross seconded.
All were in favor.
The bills listed on Highway abstract 7, claims 76-78, payroll
abstract 6, General abstract 7, claims 340 and Harford Mills
Water District #1 abstract 4, claim 5 were read. Barber made a
motion to authorize the Supervisor to pay these bills. Cross
seconded. All were in favor.
The Supervisor's Monthly Statements were presented. Sager
made a motion -to approve these. Barber seconded. All were in favor.
Regislator Bays reported that the County Legislature had
rejected the two bids received for the County wide revaluation.
He also informed us that a car had been obtained f'or the County
Sheriff's Dept. from the Marathon village police.
John Larkin, from the D.W. Road Rquip.`�&: was present to
present and discuss specifications for a ten wheel tandem
dump truck.
The Board discussed whether or not they wanted to advertise
for bids on this type of truck.
VanI)eWeert made a motion to authorize the Town Clerk to ad-
vertise for bids on a 1969 or newer used extra heay duty tandem axle
truck. Barber seconded. Roll Call: Barber;aye, Sager;aye, VanDeWeert;
aye and. Cross;nay. The bids are to be opened on July 16,1979.
Gordon Leete stated that he had contacted Kenneth Brotherton
Sr. and given him thirty days to get his property cleaned up or
the Town would do so at his expense.
Referring to the problem with the water hydrant in Harford
Mills the Supervisor reported that Mr. Bassler said that the State
would put a pipe from the hydrant to the creek.
A discussion was held on where the Town Justice courtroom
should be built. It was decided that it might be more sensible
to build it onto the Highway garage. It was also felt that we
should have storage area for our Town records.

The Town Board of the Town of Harford"for a special
meeting on July 16,1979 at 8p.m. in the Town Highway Garage.
The purpose of the meeting was to open the bids received as
advertised. for the tandem axle diesel dump truck. 14embers present
were Barber, Sager, Stoner, and VanDeWeert.
The notice as it appeared in the Cortland Standard was read.
The following bid. was received and opened: L.Q.W. Clark
® Equipment C. -$15,200.00.
There were three vistors present.
Stoner made a motion to accept the bid from D.W.Clark Road.
Equipment,:Inc.• Sager seconded. All were in favor.
Sager made a motion to adjourn.

The Toon Board of the Town of Iarf ord met for a regular meeting
on August 5,1979 at 8p.m. in the Town Highway Garage. Members
present were: Barber, Cross, Sager, Stoner, and. Vans>eWeert.
The minutes of the .July 2, and. July 16, 1979 meetings were
read. Barber made a motion to accept the minutes as read.. Stoner
seconded. All were in favor.
The bills listed. on Highway abstract 8, claims 79-79-98,
011 abstract 7, and General abstract 8., cla,irns 35-40 were
read. Cross made a motion tr _.,_ithorize the Supervisor_ to pay these
bills. Ba-T`-,(=:rseconded. All were in favor.

made a motion -to approve these. Stoner seconded. All. we:: -e in favor.
Legislator Bays reported that no decision had been reached
on the question of the distribution of county sales tax monies.
The Supervisor informed members that he had contacted our
Town Attorney about the water hydrant problem in Harford Hills.
Mr. VanSant is to write a letter to the State to see what can be
done.
Nancy Chevalier and Carol Cornelius were present in behalf
of the Harford Improvement Committee. They informed us that the
Committee was disbanding and were wondering what to do with the
money remaining in their treasury, the amount being approximately
$350.00. Nancy said it had been suggested that a tree, 'that could
be used as a Christmas tree, and possibly some shrubs be planted
in front of the Town Hall. Stan Cross said that he could get a
blue spruce tree.
Stoner made a motion to grant approval to the Harford Improve-
ment Committee to use their remaining funds to improve the Town
Hall property. Sager seconded. All were in favor.
The next meeting will be September 4 because of Labor Day.

The Town Board of the Town of Harford. met for a
regular meeting on September 4,1979 at 8p.m. at the Town
Highway Garage. Members present were:Cross, Sager, Stoner,
and VanDeWeert.
The minutes of the August 6,1979 meeting were read. Sager
made a motion to accept the minutes as read.. Cross seconded.
All were in favor.

The bills listed on Highway abstract 9, claims 99-103,
payroll abstract-8, and General abstract 9, claims 41-44.''48? ger
made a motion to authorize the Supervisor to pay these bills.
Stoner seconded.. All were in favor.
The Supervisor's Monthly Statements were presented. Sager
made a motion to approve these. Cross seconded.. All were in favor.
Legislator Bays reported that the County and. the City of
Cortland had. reached an agreement on the sales tax monies to be
distributed on a 25% population-75% valuation basis with a hold
harmless clause sothat no town or village will receive less than
in 1978.
Stoner made a motion to authorize the rental of the shed
behind the Town Hall to Garret VanDeWeert for $50.00. Sager
seconded. All were in favor.
Sager made a motion to raise the rent for the Town Hall
to $25.00, with a $50.00 deposit, effective January 1,1980.
Cross seconded. All were in favor.
Sager made a motion to authorize the Town Clerk to publish
a notice for a public hearing on the spending of the Town's
Federal Revenue Sharing Funds. Cross seconded. All were in favor.
Sa ger offered a resolution to authorize the issuance of
a series of Bond anticipation notes, not to exceed $13,000 from

were read. Barber made a motion to authorize the Supervisor to
pay these bills. Cross seconded. All were in favor.
The Supervisor's Monthly Statements were presented. Cross
made a motion to approve these. Stoner seconded. All were in favor.
Legislator Bays reported that the terms for members of the
County Planning board had been changed. from 5 years to 3 years. He
further reported. that the rural health centers in the County were
no longer receiving County fund.s.
Lloyd Cotterill was present to inform the Town Board that
he was resigning as coach of the girl's softball team.
A letter of resignation from Mark Allen was read. He explained
that the reas;onfor the resignation was that he is moving to Cortland.
Sager made a motion to accept the resignation with regret.
Van-DeWeert seconded. All were in favor.
A discussion was held on what the procedure for having one or
'two justices was. The Supervisor is to consult our attorney as to
whether or not we need a public hearing on the issue.
Stoner, -.-.made a motio to set the dog fees for the Town of Harford
at the State's Minimum requirements or as follows: $2.50 for
spayed females or neutered. males and. $7.50 for unspayed. females

A discussion about re:par-pg the step in front of the Town
Hall and. blowing insulation in between the floors of the Hall was
held. It was suggested that the matters be investigated. Stoner
is to consult Al Eisenhardt about the steps and estimated. cost
of repairing them. Barber is to get an estimate on the insulation
cost.
Preliminary budget estimates were -read for the year 1980 and
were adopted as a Preliminary budget for the year by motion of the
following resolution offered by Sager, seconded by Barber and all
being in favor. Resolved that the Town Board does hereby prepare
and approve as Preliminary budget for the fiscal year beginning
January first 1980 as follows: Further resolved that this Board
shall meet at 8p.m. on the 5th day of November 1979 at the Town
Hall for the purpose of holding a public hearing on such budget.
Further resolved that notice of hearing shall be placed in the Cortland
Standard. Roll call: Barber;aye, Cross;aye, Sager;aye, Stoner;aye,
VanDeWeert ; aye .

Legi lator Bays corre-�'.ed the
meeting stating that the Director of the County Planning Board
is to serve a three year term instead of a five year term,
correcting the Clerk's statement that it was the members on the
Board whose terms had been changed.
Legislator Bays informed us that he had received the state
equalization rates for the Towns in the County, He told us that
the rate for Harford was 102.96.
The notice cfthe Preliminary budget hearing as -it appeared in
the Cortland Standard. was read.
The Preliminary budget estimates were read..
All persons desiring to be heard, having been heard, the
Supervisor declared the hearing closed.
Sager offered a. resolution wheras, this Town Board has met
at the time and place specified in the notice of public ',.tearing
on the Preliminary budget and heard all persons desiring to be
heard thereon; now, therefore, be it resolved, that this Town
Board does hereby adopt such preliminary budget as orginally
complied, as the annual budget of this Town for the fiscal year
beginning on the 1st day of January,1980, and that such budget
as so adopted be entered, in detail in the minutes of the proceed-
ings of this Town Board, and be it Further Resolved, that the
Town Clerk of this Town shall prepare and certify, in duplicate,
copies of said annual budget as adopted by this Town Board,
together with the estimates if any, adopted pursuant to Section
202-a subd.2 of the Town Law and deliver two copies thereof to
the Supervisor of this Town to be presented by him to "the Board
of Legislators of' the County. Stoner seconded. Roll call; Barber;
aye, Cross;aye, Sager;aye, Stoner;aye, VanDeWeert;aye®
Alfred Eisenhardt attended the meeting and expressed. his
desire to purchase the building behind the Town Hall from the
Town . He said he would pay $300 for it and would clean up the
property after the building was moved. He said he would like to
move it this fall.
Sager said that he thought that no decision could be made by
the Board because it was subject to a public referundum. The
Supervisor said that he would consult our Town Attorney concerning
the matter.
A discussion was held on whether or not highway employees
should be granted sick time leave with pay.
Stoner made a motion to give the full time highway employees
five days non -accumulating sick leave with pay. Barber seconded.
All were in f"avor.
VanCkeWeert made a motion to appoint Janet Tennant dog enumerator
for 1980. Sager seconded. All were in favor.

Harford met for an executive session at :the Town Hall on
November 14 ,1979 at 7 s 30p . m .. rrrt+Members present were: Barber,
Cross, Stoner, and VanDeWeert.
The meeting was called by the Supervisor to explain and
update the trial procceedings between the Town of Harford and
the Buckeye Pipe Line Co..
The following persons were in attendanceto assess the problems
and to offer comments pertaining to the cases Grant VanSant-Town
Attorney, Kenneth Powers -Supervisor of the Town of Virgil, Robert
Bays -County Legislator, Ronald Anderson -newly elected Legilator,
Johnny Ryan -Virgil Town Attorney, Leonard Kimmich-Chairman of
the Town of Harford assessors, Harry T=runks -County Real Property
Tax Service Director, and William and Dorot.;hy Highfield -William
is a Board of Review member.
The -'Supervisor called the meeting to order and asked Mr.
VanSant to proceed from there to update everyone present. He
said that the local -assessors were using the New York State
Bo ard. of Equalization and Assessment figures for their assessment
on the Buckeye Pipe Line , as the Town assessors are not experts
on these special properties. Leo Dugan from the State Board. has
been called. to testify for the Town on this matter. Mr. VanSant
also informed the Board that his fees would run around. $2,500.0!x.
Therefore it was up to the Town Board. whether or not to have him
proceed with the case or not.

Dear Gary:
I trust you know that the above trial started as
scheduled, on November 27th. Instead of lasting one or
two days, the trial lasted three full days and was
completed at about 4:00 p.m. on Thursday. The purpose
of this letter is to bring you up ,to-date'on what took
place during those three days. If you want a blow -,by -blow
description, I'm sure Leonard Kimmich will be able'to
provide it, as he was concerned enough and patient enough
to sit through almost the entire trial. Harry Dunks was
also there throughout, along with county tax directors
from Tompkins, Cayuga, and Cattaraugus counties. Aside
from those'parties, there was no crowd, publicity, or
fanfare about this case despite its far-reaching significance
to the State'of New York and its taxpaying citizens.
Since'Buckeye was the Petitioner in this case, its
side was presented first. Their first witness was their
comptroller, a certified public accountant who had been
with the company for ten years or so, and who was quite
familiar with making out the various reports required of
pipeline companies by the Interstate Commerce Commission.
That gentlemen was the'one who prepared the appraisal for
Buckeye. He'testified as to the manner in which he made
his appraisal, which consisted primarily of extracting
certain data out of charts promulgated by the ICC, which
is the method 'imposed upon pipeline companies by the ICC
in order to standardize their asset valuation for tariff -
setting purposes. Cross-examination of this witness
brought out the'facts that the charts were national, not
local averages, and that they contained certain other
generalizations. Buckeye's second witness was its real
property taxlspecialist, the'fellow who prepared the
objections on Grievance Day and the fellow with whom I met
in Harry Dunks' office' 'many months ago. He 'testified

concerning certain mathematical mistakes he had made on the
grievance'form. I did not cross-examine that witness, and
the Petitioner rested its case.'
At the outset of the trial, both sides' stipulated that,
the Town had correctly repeated the advisory appraisal
provided by the State'Board of Equalization and Assessment,
that the assessment roll was duly published, and that
Buckeye filed its objections on time. The result of those
stipulations was that Leonard Kimmich did not need to
testify, but,as I mentioned above, he'stayed with us through
thick and thin thereafter. Our first (and only) witness
was Mr. Leo Dugan, the principal utility valuation engineer
from the SBEA, the fellow who prepared the advisory
appriasial for our assessment roll, and the fellow who made
up the appraisal for trial. He'testified concerning the
method used by him, and by the SBEA for such evaluation
methods. Cross-examination of Mr. Dugan was similar to the
cross-examination of Buckeye's appraiser, in that the'
validity of the charts and indices he used in his calculations
was challenged; following that testimony, we'rested our
case.
The third day consisted of Buckeye's calling two more
witnesses in rebuttal, one was a finance officer of Buckeye'
who testified that the figures provided by Buckeye to the
State Board a few years ago, which figures were relied upon
by the SBEA in its appraisals, were simply estimates and
therefore not reliable as a basis for appraisal. The second
witness was the'retired chief of the pipeline valuations
section of the Interstate Commerce Commission, and he
testified concerning the derivation of the depreciation
charts and cost indices used throughout the nation by the
ICC and used in this case by Buckeye. I did my best to
get him to admit that the charts contained some inaccuracies,
but as you can imagine, it was quite 'an uphill -battle 'since
he was defending his entire life's work.
At the conclusion of the trial, the attorney for
Buckeye moved to strikeout of the record some of the'
errors which appear in the State's appraisal (the'J'udge has
not yet ruled on those motions), and I moved to limit the
reduction in assessment to the $.213,000.00 figure used by
Buckeye on Grievance'Day rather than the $177,000.00 figure
used in the'appraisal for trial (that motion was granted).
The predictions contained in my letter to you of
November 6th turned out to be true;' both sides agreed that
cost less depreciation was the'correct'method for appraisal,
and the 'trial dealt with 'the 'ques'tion of whether the SBEA

or the'ICC ha'd'more accurate price indices, depreciation
charts, etc. Buckeye had the'advantage'over us by calling
the former chief of the''pipeline 'valuation unit of the ICC,
and he gave 'aI more 'convincing explanation of ,how those
charts were 'dlerived than our witness could give concerning
the 'SBEA charts,.,
The next!step is the preparation of the typed transcript
of the trial, which will run several hundred pages, which
will beprovi'ded to the Judge and to both lawyers. Then,
with that transcript for reference, each lawyer will prepare
a post -trial summation of the facts and brief concerning
the law pertaining to the case; from those briefs,
augmented by his own research, the Judge will render a written
decision. The Judge can decide in favor of one appraisal
or the other, or he can modify one'or both and reach a
compromise figure. Neither side would be entirely satisfied
with any compromise, because Buckeye wants to establish
the ICC chart's as the''oh'ly correct method of pipeline
valuation, and the SBEA wants a ruling in favor of its
charts. I es'timate'that it will take a month or more for
the stenographer to prepare the transcript of this
lengthy trial, a month or so thereafter for the lawyers
to do their research and submit their briefs to the court
(I intend to get SBEA help on that research), and two
months or so thereafter for the Judge to review this and
reach a decision; in other words you should not expect an
answer in this case until St. Patrick's day.
As I mentioned, Harry Dunks sat through every minute
of the trial, and if his impression can bereliedl upon as
that of a neutral observer, his comment to me after the
trial may provide'a good summary of the situation as it
now stands: he'said he was disappointed in the fact that
the State did not seem to do a very careful job of making
these appraisals and advising the Towns. Still, our side
of the case is based upon the fact that Buckeye had no
appraiser to apply any judgment to the matter of valuation,
as Buckeye simply extracted from ICC -prepared charts; on
the other hand, the SBEA appraiser tried several different
methods of valuation and came'to a reasoned conclusion.
Secondly, the'ICC charts provide'a nationwide average, and
an average whlich intentionally levels off the peaks and
valleys of price fluctuations, whereas the SBEA appraisal
was custom tailored to this section of pipeline .in the
Town of Harford as of May 1, 1977. Finally, the'ICC charts
are 'derived or the purpose 'of .rate -setting, .not tax
valuation, and that differen'ce'in purpose causes ICC charts
to be'intentilonally lower. I am optomistic about the
outcome of thle case, although I dare not make any predictions;

matter of Buckeye Pipe Line Company vs Leonard Kimmich. In their dis-
cussion, board members are of the opinion that this was a matter right-
fully related to the Office of the Real Property Tax Director for Cort-
land County. As a result, we are of the opinion that the resources of
this office and the county should be brought to your assistance.
The Board of Education wishes to advise you that they would be willing
to assist the Town of ltarford in this matter, should the law allow.
Please advise us of actions you plan to take with regard to county in-
volvement and how/if we can be of assistance.

problems that the Town might have that he could help with. He
said he would contact Walt Tennant about removing certain trees
along Creamery Rd..
Stoner made a motion to authorize the Town Clerk to write
a letter to the Sheriff's Dept. requesting that they patrol the
Harford area, especI&lly around 5a.me and about 11p.m..Canfield
seconded. All were in favor.
The Supervisor informed the Board that David Parker was
raising his rates from $1.00 to $1.25 for garage pick-up.
Barber presented an estimate from Robert Bowker for insulating
between the floors and side walls of. the Town Hall. The total
was $3,280.00, for between the floors only would be $1,392.00.
Barber and Stoner said that they each had another person to get
an estimate from.
Barber introduced a resolution to designate the Cortland
Standard as the offical newspaper of the Town and the First National
Bank of Dryden as the Official depository.
