Planning Board
July 8, 2004
Board Members Present : John Wertis (Chair), Margot Chiuten, Rodney Porter, Rose
Hilbert, and David Means . (Unexcused Absences : David Tyler and Lon-en Hammond)
The meeting was called to order at 7 : 30 p .m. Board members introduced themselves to
the newest member, David Means . Mr. Means told the Board a little about his interest is
serving on the Planning Board and about his previous work experience and his past
involvement in municipal affairs in another NYS town.
Mr. Wertis led the Board through a discussion of current Board operating procedures,
including : the meeting day (2" Thursday of the month) , meeting time (7 : 30p .m.), the
need for punctuality at meetings, the Town ' s policy on attendance, the Town ' s policy on
training, agenda setting (input to Chairman by Monday p .m. of the meeting week),
accesses to the Town lawyer through the Planning Board Chair, and some discussion of
the procedure for taking, reviewing and approving minutes (needs researching and
clarification) .
The present Board Members then participated in a "quiz" designed by Mr. Wertis to
review the main points of the 1999 Comprehensive Land Use Plan. It was agreed that
this document was the basis for the creation of many sections of the current Proposed
Zoning Ordinance under review by the Town Board.
Mr. Wertis reported on the Town Supervisor' s invitation to the Planning Board to
participate in some manner in the Proposed Zoning Ordinance review. Mr. Wertis
I suggested that the Planning Board focus on the Al Agriculture District and the definition
} of such terms as "Open Space". Mrs . Hilbert and Mr. Porter expressed reluctance to
revisit this controversial section of the Proposed Zoning Ordinance. Extensive discussion
took place and the group arrived at the consensus that Mr. Wertis should commit to paper
a "report and recommendation" to the Town Board on the subject of the Review Process .
Mr. Wertis agreed to do that, based on the notes of the discussion, and a computer
communication review of the "report" made available to all the Planning Board
Members, prior to submission to the Town Board. The "report" is as follows :
At our July 8 , 2004 Planning Board Meeting we reviewed and discussed the 1999
Comprehensive Plan for the Town of Ulysses . We noted that the Plan identified
planning needs in the Town that might be remedied by the revision of the 1978
Zoning Ordinance . We noted that the Proposed Zoning Ordinance (June 10,2004)
in fact does provide remediation of specific identified problems . In regard to the
review process that the Town Board is about to undertake, the consensus of the
Town Planning Board is :
1 . We appreciate the invitation extended to the Planning Board by the Town
Supervisor to participate in the review process .
2 . We will be glad to review and advise on any specific sections that the Town
Board requests us to look at.
3 . We feel that we have expressed our opinion clearly in previous
communications regarding the inadequacies of the proposed A 1 section.
4 . We recognize that to accomplish the greater good encompassed in the rest of
the Proposed Zoning Ordinance it is best to table the debate on the A 1 issues at
this time.
5 . We feel we can be most publicly supportive of the entire Proposed Zoning
Ordinance if it includes a legally binding section that spells out :
a. That the proposed A 1 Section will be further reviewed and modified.

b . The review process will start at a specific date shortly after the
adoption of the Proposed Zoning Ordinance .
Mr. Wertis will present this report to the Town Board with the approval of all members
present.
The members of the Planning Board were updated by Mr. Wertis as to the creation of an
"MS4, Storm water Committee" by Board action at their July 6th meeting.
The meeting was adjourned at 9 : 00 p .m.
