HomeMy WebLinkAboutZBA Minutes 1970-04-15 r TOWN OF ITHACA i ZONING BOARD OF APPEALS MINUTES APRIL 15 , 1970 r' A meeting of the Town of Ithaca Zoning Board of Appeals was held at = ahe Town Offices , 108 East Green Street , City of Ithaca , a.t : 'J : 30 p . m . on Tuesday , April 159 1970 . Members of the Board present : Chairman David Powers , Loran Marion , Roger Sovocoo �l , Andy . Soyring , Zoning Officer David Cowan , and Secretary Charlene Lawson : Others present : Ben Boynton , Robert Poreski , Frank Howell , Lagrand Chase . Appeal of Donald Jewett : This Public Hearing was called . to order at 7 : 30 p . m : Secretary Charlene Lawson read the legal ad as published in the Ithaca Journal . Mr . Jewett had been denied permission for building a garage in the front yard at 212 Tarryton Drive , Ithaca , New York . Permit was denied by the Zoning Officer under Article IV , Section 13 of the Zoning Ordinance . The Board recessed for discussion . Upon resuming , the Board decided to r. e-serv�edecision on this matter , pending re - submission of Jewett ' s plans . Appeal of Lagrand Chase : This Public Hearing was called , " Otoorder at 8 : 15 p . m . Secretary Charlene Lawson read the legal ad as published in the Ithaca Journal . Mr . Chase appealed the decision of the Zoning Officer denying permission for building three houses at BK 100 - 72 Ridgecrest Rd . 45 - 1 - 2 . The permit was denied by the Zoning Officer _under Article V , Section 23 of the Zoning Ordinance . As a neighbor , Frank Howell voiced his opinion as not opposing the construction of either two or three lots in this area . The Board adjourned for discussion . Upon resuming , Roger Sovocool made a motion to grant a variance for the following reasons : ( 1 ) The development will be in harmony with the other plots in the area being that 2 / 3 of the area is devoted now to lots with 100 ' frontage . rw Y - 2 ( 2 ) The proposed use is not detrimental to the character of the neighborhood and will not defer neighboring property . ( 3 ) It will not create health or safety problems since the area is now served by public water and sewer . This variance is subject to the following conditions : ( 1 ) That a plan be submitted to the Zoning Officer showing the proposed sideyard and front yard restr. iLctions and that all side yard and front yard requirements conform with the R3v6" /U'5� existing zone . ( 2 ) That the building be connected to the public water and sewer facilities . ( 3 ) That there be at least 25 , 000 sq . feet in each lot . David Powers seconded the motion , and it was passed .
