ZONING BOARD OF APPEALS

PRESENT : Chairman George Tselekis, Members Jim Hickey, Joel Warren, and Carl
Mann, Code Enforcement Officer Alex Rachun, Typist Karin Lanning.
ALSO PRESENT : Greg Lourey and Mary Ellen Lourey.
The Ulysses Zoning Board of Appeals met for a duly advertised meeting and public
hearing on April 21st, 2004 . The matter before the Board was an area variance requested
by Greg & Mary Ellen Lourey for their property located at 5165 Jacksonville Road, Tax
Parcel 25 . -2-3 .
Chairman Tselekis called the meeting to order at 7 : 35 pm, and asked the applicants to
briefly describe their proposed project.
Greg Lourey explained his plans include changing the location of doors into his
residence : installing one on the front of the house and one on the rear of the house,
adding roofed porches at both of these entrances, and constructing a garage; his plans
also include eventually constructing a pole barn and, possibly, an outbuilding to house an
external residential heating system .
Code Enforcement Officer Rachun noted the property would meet lot size requirements if
the revised Zoning Ordinance currently being considered by the Town Board was
currently in effect.
The Board discussed the application , and posed questions to the applicants and to Code
Enforcement Officer Rachun.
IMr. Hickey noted the following, in preface to a motion :
First, a porch previously existed,
Second, the property has been the site of a residence and accessory buildings for
many years,
Third, adjoining property owners were notified of the area variance request, and
have expressed no objections to the proposed projects verbally or in writing, and
Fourth, the variance requested will encompass variances from the requirements
for lot size, road frontage and the front-yard setback .
Noting the above findings, Mr. Hickey moved the following :
Whereas, in relation to the requirements, the variations are not substantial when
judged in the context of past and current developments on the site, and
Whereas, there will be no effect on the population of the area and no effect on
available government facilities, and
Whereas, there will be no change in the character of the neighborhood and no
perceived or expressed detriment to neighboring properties, and
Whereas, it appears that this difficulty cannot be obviated by any other feasible
method,
Now Therefore, BE IT RESOLVED , that the interests of justice dictate a variance
be granted to allow construction of the following structures at 5165 Jacksonville Road,
also known as Tax Parcel 25 . -2-3 :
- a porch on the front of the residence
- a porch on the rear of the residence
- an outbuilding to house an external residential heating system
- a garage
a pole-barn
Subject to the condition that the outbuilding to house an external residential
heating system shall not set any closer to the road than the front of the residence as it
exists today.
Mr. Mann seconded the motion.

After brief review, Mr. Hickey moved to approve the minutes of the March 31st, 2004
Meeting & Public Hearing as presented . Mr. Warren seconded.

Hearing no further business, Mr. Mann moved to adjourn and Mr. Hickey seconded.
